iObject were entrusted with preparing a planning objection to a development application (DA) for a North Harbour-fronting site overlooking Fairlight Rockpool. Due to the severity of the proposal’s impacts, a Comprehensive Principal Objection was prepared by iObject that sought to ensure any development would be consistent with the built form of the area whilst protecting the amenity of our Clients’ strata block.
iObject's objection highlighted key issues such as Solar Access, Height, Floor Space Ratio and Rear Setbacks. The proposal would have largely eliminated solar access to numerous habitable rooms, including living areas of our Client’s property. Given these rooms had very little winter sunlight already, iObject argued that these spaces deserved protection, lest sunlight be stripped entirely.
In addition, the proposed 4 to 6-metre rear building setback broadly failed Council’s 8-metre control, effectively creating a new protrusion that have blocked some Client views. Whilst not conforming with the predominant setbacks along the foreshore, such an arrangement would have caused our Clients to feel ‘hemmed-in’. iObject therefore sought a retraction of the rear building line in order to soften the building mass.
Council sided with iObject's evaluation, agreeing on a number of fronts - determining the application via refusal. The DA later proceeded to appeal via the Land & Environment Court, involving iObject’s continual representation of our Clients. Significant design changes ensued as part of the conciliation process, when amended plans were brought to the Court. The final court-approved plans saw several major improvements, including reduction in overall bulk and scale, retention of neighbouring solar access, and resolution of the setback issue.
