The supreme legislative authority in Botswana is Parliament; consisting of the President and the National Assembly, and where tribal and customary matters are involved, Parliament is obliged to act in consultation with Ntlo Ya Dikgosi. The President is a member of the National Assembly and has the power to address, summon or dissolve it anytime. Normally the President addresses the National Assembly at the opening of a new Parliament every five years, or whenever there is an important national issue and at the end of the life of Parliament when he/she dissolves it to call a general election which leads to a new Parliament.
Functions of Parliament
Parliament is charged with the following;
(a) Responsibility of legislation - It makes laws for the peace, Order and good Governance of Botswana.( sec.86)
(b) Representative role - Represent the interests and concerns of their constituents through questions and motions
(c) Oversight role - It watches over and checks the activities of Government.
In exercise of these functions, Parliament becomes the watchdog and brings relevant issues to the attention of both government and the electorate.
The National Assembly is consulted before the President can sanction international treaties and agreements. The normal life-span of Parliament is five years, but if need be, Parliament may be dissolved and general elections held before the expiry of five-year period. For instance, there is provision empowering Parliament to extend its normal life-span by 12 months at any time or for more than five years at any time when Botswana is at war. So far there has never been an occasion to prolong the life-span of Parliament. Dissolution is ordered by the President and must be followed by issue of an election writ within sixty days. The first session of Parliament normally commences within 30 days from the date of the general election.
Constitutionally, Parliament is required to hold at least one meeting every year, but a period of six months should not pass between the last sitting of Parliament in one session and the first sitting in the next session.
