Manitoba Ombudsman joined national colleagues to voice continued support for the creation of a National Indigenous and Human Rights Ombudsperson as called for in the Call for Justice 1.7 Final Report. Establishing a National Indigenous and Human Rights Ombudsperson could address persistent gaps in accountability and provide an independent and impartial avenue for Indigenous people to access justice and resolve concerns. The recommendations made following the inquest into the death of Mr. Bradley Errol Greene marked a turning point for change in how medical services are delivered in correctional centres. However, the resulting changes have been slow. Of the eleven recommendations one has been declined by the department as not feasible, five are implemented, two were not implemented, and three are partially implemented with ongoing progress. Of the four recommendations, one has been fully implemented and three have been partially implemented with progress made. The Ombudsman has published a privacy breach investigation report about a breach that affected 1,361 people. The individuals were receiving services through a service provider under Manitoba Families’ Community Living disABILITY Services program. The investigation resulted in five recommendations made by the Ombudsman. In this investigation, our office concluded the department had not provided sufficient justification for disregarding the request for information under clause 13(1)(d) of FIPPA. We also concluded the department had not fulfilled its duty to assist or its duty to conduct a reasonable search for records responsive to the complainant’s request. Three recommendations were issued including that the request be fully reprocessed.

Dans le cadre de cette enquête, notre bureau a conclu que le ministère n’avait pas suffisamment justifié son refus de donner suite à la demande de renseignements formulée en vertu de l’alinéa 13(1)d) de la LIPVA. Nous avons également conclu que le ministère n’avait pas respecté son obligation d’assister la plaignante ni son obligation de mener une recherche raisonnable des documents répondant à sa demande. Trois recommandations ont été formulées, dont celle de procéder à un nouveau traitement complet de la demande.

Last week, several privacy oversight offices with jurisdiction over private companies released a joint investigation on OpenAI and ChatGPT’s early training model. The regulators’ findings highlighted privacy concerns related to the scale and sensitivity of data collected, and the adequacy of user consent, among other issues. As a result, the regulators concluded that the way that OpenAI had initially trained ChatGPT was not compliant with relevant federal and provincial privacy laws.

In Manitoba, private companies fall under federal privacy legislation (PIPEDA) while the Manitoba Ombudsman has privacy oversight over public bodies and health information trustees under provincial legislation (FIPPA and PHIA). Regardless of which office is providing oversight, the principles of privacy and protection of personal information remain the same. People in Manitoba should have their personal information protected, be informed, and have a level of control over how and when their personal information is being stored and used.
