პრაღა, ჩეხეთის რესპუბლიკა – 2025 წლის 4 მაისი

თბილისის საქალაქო სასამართლომ 2025 წლის 12 თებერვალს მიიღო საბოლოო გადაწყვეტილება ჩეხეთის მოქალაქე ბატონ ანტონის სასარგებლოდ და სრულად გააუქმა 2020 წელს გამოცემული ადმინისტრაციული გაფრთხილება და ფულადი ჯარიმა, რომლებიც საქართველოში მოქმედმა სოციალურმა სამსახურმა და მასთან დაკავშირებულმა სახელმწიფო ზრუნვისა და ტრეფიკინგის მსხვერპლთა სააგენტომ (LEPL) დააწესეს.

თავდაპირველი სანქციები — წერილობითი გაფრთხილება (№04-00/3157, თარიღით 22.01.2020) და 500 ლარის ოდენობის ჯარიმა (№07-08-465, თარიღით 10.02.2020) — ეფუძნებოდა ბრალდებებს, თითქოს ბატონ ანტონის არ დაეცვა სასამართლოს განკარგულება ვანესასთან დედის, ოლივია ანტონის, რეგულარული შეხვედრების შესახებ. აღნიშნული ბრალდებები წამოიწყო ოლივიამ და შესაბამისმა უწყებებმა იმოქმედეს მტკიცებულებების გარეშე და სათანადო ადმინისტრაციული პროცედურების გარეშე.

2025 წლის 12 თებერვალს, თბილისის საქალაქო სასამართლოს ადმინისტრაციულ საქმეთა პალატამ, მოსამართლე მანუჩარ წაწუას თავმჯდომარეობით, დაადგინა, რომ ადმინისტრაციული აქტები იყო უკანონო, პროცედურულად ხარვეზიანი და ეფუძნებოდა უსაფუძვლო და მიკერძოებულ ბრალდებებს.

„ამ გადაწყვეტილებამ დაადასტურა, რომ მე დავსჯილი და ბულინგის მსხვერპლი ვიყავი სოციალური სააგენტოს წარმომადგენლის, ნინო იობაშვილის მხრიდან — იმის გამო, რაც მე არ ჩამიდენია. ამ უწყებებმა ვერ დაიცვეს ჩემი უფლებები — და რაც ყველაზე საგანგაშოა — ისინი ვერ დაიცვეს ჩემი შვილი, ვანესა. ისინი დღემდე აზიანებენ მის ცხოვრებას — წაართვეს სამი წელი განათლებიდან. ჩვენმა იურიდიულმა გუნდმა შეიტანა ახალი სარჩელები, რათა მომავალში არც ერთი ბავშვის ცხოვრება არ დაიკარგოს საქართველოში, განურჩევლად მათი ეროვნებისა“, — განაცხადა ბატონმა ანტონიმ.

⚖️ მიკერძოებისა და დარღვევების მოდელი
სასამართლოს გადაწყვეტილება ამხელს ბავშვთა დაცვის სისტემაში არსებულ ინსტიტუციურ ჩავარდნას საქართველოში. LEPL-ის თანამშრომლები — ნინო იობაშვილი და მაკო სანაკოშვილი — დასახელებული არიან როგორც ძირითადი პირები, რომლებიც პასუხისმგებელნი იყვნენ:

მამის წინააღმდეგ ცრუ ბრალდებების მიზანმიმართულად გავრცელებაზე;

მიკერძოებულ და არაობიექტურ ქმედებებზე, რომელთაც უარი თქვეს ფაქტობრივი ანალიზის ჩატარებაზე;

ბავშვის, ვანესას, ემოციური და იურიდიული საფრთხეში ჩაგდებაზე.

ეს არ არის ერთეული შემთხვევა. ამჟამად მიმდინარეობს რამდენიმე სამართლებრივი პროცესი:

ოლივია ანტონის წინააღმდეგ — ცრუ ჩვენებებისა და მამისგან შვილის მოცილების მცდელობებისათვის;

LEPL ზრუნვის სააგენტოს წინააღმდეგ — ინსტიტუციური მიკერძოების, უფლებამოსილების ბოროტად გამოყენებისა და ბავშვის კეთილდღეობაზე ზრუნვის ვალდებულების უგულებელყოფისათვის.

აღნიშნულ პროცესებს აქტიურად აკვირდება ჩეხეთში დაფუძნებული არასამთავრობო ორგანიზაცია For Vanessa, z.s., რომელიც იცავს ბავშვთა უფლებებს საერთაშორისო და საზღვარგარეთულ ოჯახურ დავებში.

Justice Delivered: Vanessa’s Father Vindicated in 5-Year Legal Battle Against Georgia’s Social Services – Court Recognizes Bias and False Accusations

Prague, Czech Republic – 04 May 2025

The Tbilisi City Court on 12 February 2025 issued a final ruling in favor of Czech citizen Mr. Antony, fully overturning a 2020 administrative warning and monetary fine imposed on him by Georgia’s Social Service Agency and its affiliated LEPL State Care and Assistance Agency for Victims of Human Trafficking.

The original sanctions — a written warning (№04-00/3157, dated 22.01.2020) and a 500 GEL fine (№07-08-465, dated 10.02.2020) — were based on claims that Mr. Antony violated a court-ordered visitation schedule with his daughter, Vanessa. These claims were initiated by the child’s mother, Olivia Antony, and processed by agency officials without due diligence or factual verification.

On 12 February 2025, Judge Manuchar Tsatsua of the Administrative Panel of the Tbilisi City Court ruled that the administrative acts were unlawful, procedurally flawed, and based on ungrounded and biased accusations.

“This decision confirms that I was punished and victim of bullying by social agent Nino Iobashvili for something I never did. The agencies not only failed me — they failed my daughter, Vanessa. Now they continue to damage her life — they have deprived her of three years of education. Our legal team has filed new lawsuits so that no child’s life in Georgia is ever lost again — regardless of nationality,” said Mr. Antony.

⚖️ Pattern of Bias and Misconduct
The court’s ruling underscores a broader institutional failure within Georgia’s child protection system. Employees of the LEPL agency — Nino Iobashvili and Mako Sanakoshvili — are identified as key individuals responsible for:

Knowingly advancing false narratives against the father;

Acting in a biased and non-neutral manner, favoring one parent without factual investigation;

Contributing to the emotional and legal endangerment of the child, Vanessa.

This is not an isolated case. Multiple legal actions are currently ongoing:

Against Olivia Antony, for repeated submission of false testimony and parental obstruction;

Against the LEPL State Care Agency, for institutional bias, misuse of legal mechanisms, and failure to protect the child’s welfare in accordance with Georgian and international standards.

🔍 Legal and Human Rights Monitoring
These proceedings are actively monitored by the Czech-based NGO For Vanessa, z.s., which advocates for children’s rights in cross-border custody and protection disputes.

Vanessko, tady je online fotoalbum, které zachycuje, jak jsme společně žili v Gruzii od roku 2017 do června 2020. Jak jsi měla kamarády, školku, školu, zábavu a výlety. Pořád jsi se smála a byla jsi svobodná. A pak jsou tam i fotky z temné minulosti kdy tě gauneři nelegálně unesli 2. června 2020 z domova ode mně, od babičky Milenky, od Petra a od tvé Angeliky. Jsou tam fotky, co jsi dělala v Gruzii po únosu, kam tě Olga brala a co z tebou dělala. Na některých fotkách z té doby vypadáš úplně jinak než dříve. Jsi hodně vystresovaná, smutná, bez radosti a bez energie. Ale to se dá moc dobře pochopit. To by se stalo moc dětem, pokud by zažili takové spatné věci, co s tebou dělali a co tě učili. Rozhled jsem se ti ukázat pravdu, abys sama svými oči viděla, jak jsi žila a co se změnilo, znát svou minulost nám pomůže se lépe bránit v budoucnu, víc být silní a mít odvahu se bránit těm kdo tobě ublížili. Chci abys věděla, že jsi měla do 6 let hodnou a milující českou rodinu. Bránil jsem tě před Olgou, jak to šlo a dlouho. Věděl jsem, co se stane, pokud tě Olga unese. Věděl jsem, že je Olga nemocná a zlá, že má řadu problémů i tady ty fotky v albu jsou toho důkazem co ti dělala zlého. Ale taky vidíš, že umíš být moc šťastná a veselá. A proto a nejen proto, pro tebe každý den pracuji s týmem lidí, co nám pomáhají. Ty jsi ta nejdražší holčička a stojí mně za to ti pomoc.

Vanessa, of course mom will be punished for all the bad things she did to you, the bad things she taught you about very bad things. She wanted to hurt me and my lover too, but she didn't succeed. When your mom was born, she was a good girl, but she experienced and did very bad things in her life, and now she doesn't know how much she hurts you. If she is punished by law, there is little chance that she will be better. Vanessa, please be strong and hold on, I know it's very hard, probably more than I can imagine.

Very bad people ruined your Christmas last year and now they're trying to keep you from getting presents again. You know what Vanessa? There were more bad people, but these are the ones who kidnapped you on Olga's order. The good judges said that it was unjust and wrong, but nothing changed for the better and they just kept bothering you how soon you will read and understand for yourself.

We just know that after two years she hasn't gotten better and is lost. She has only evil and hatred in her heart, which will destroy her.

Moje Vanessko, 3. prosince 2022 se nám podařilo podruhé spolu mluvit přes WhatsApp. Poslal jsem to fotky na email mámy, hned během hovoru. Jsou to dárky co jsem ti koupil na Vánoce 2021 v Tbilisi. Snažili jsme se ti je v roce 2021 doručit 4 dny spolu s se Santou, Sněhurkou a elfy kolem domu kde jsi bydlela. Olga neotevírala dveře a bránila nám ti dárky předat. Domluvili jsme se spolu 3. prosince 2022 na WhatsAppu, že část dárků si necháš v Tbilisi a část dárků ti pošlu poštou do Švýcarska co si vybereš podle čísel na fotkách. Fotky co jsi viděla u mámy na telefonu jsou tady. Když jsme si měli volat spolu v pondělí 5.12.2022 tak jsme ti volal jak jsi chtěla už v 15:30. 2x jsi řekla máme že mně chceš volat ne pozdě v 19:00 večer, ale dříve.

Volal jsem ti už v 15:30 jak jsi chtěla, ale máme to bylo jedno a řekla že se jí to nehodí a ať zavolám až večer v 19:00 hodin. Zavolal jsem v 19:00 hodin a ona mně řekla, že jsi nemocná, že jsi nešla do školy a ať zavolám druhý den. To že jsi nemocná mi měla říct už dříve odpoledne.

A ať ti zavolám druhý den a takhle to říká celý týden když volám a píšu kdy tě uslyším. To znamená, že Olga nám brání si volat. Když ti není dobře a jsi nastydlá, je úplně normální že tě chce tatínek slyšet a naopak ti říct ať tě nebolí v krku a brzy se uzdravíš. To co dělá Olga je úplný nesmysl, jak nám brání si volat. Ale věřím že nám to pomůže v budoucnu u soudu. Máma moc lže a škodí ti, že mně nemáš jako tátu na blízku každý den.

Vanessko, samozřejmě bude máma potrestána za všechno špatné, co ti udělala, co tě zlého učila za moc špatné věci. Chtěla ublížit i mně a Milence, ale nepovedlo se jí to. Když se narodila tvoje máma, byla hodná holčička, ale v životě zažila a dělala moc špatné věci, a teď už sama neví jak moc ti ubližuje. Pokud bude po zákonu potrestána, je malá šance že bude lepší, ale je. Vanessko buď prosím silná a vydrž to, vím že je to moc těžké, asi víc než si dokážu představit.

Moc zlí lidé ti zkazili Vánoce loni a teď se máme opět snaží abys nedostala dárky. Víš, co Vanessko? Budeme si říkat, že Olga je ten zlý skřítek Grinch co krade dětem Vánoce. Vyfotil jsem ti Grinche a dal tady do fotek. Vanesskou věř mi, že zlo bude poraženo a zničeno. Olga se zničí sama, ale jde o tom aby ti už dál nekazila dětství a mohli jsi doma žít hezký a normální život jako do 2. června 2020 kdy tě nelegálně unesli gruzínští kriminálnici Nino Iobashvili (sociální pracovnice) a Lola Kurkumuli (advokátka). Bylo tam více špatných lidí, ale to jsou ti kdo tě na objednávku Olgy unesli. Hodní soudci řekli, že to bylo bezpráví a nesprávné, ale už se nic k lepšímu nezměnilo a jen tě dál trápili jak brzy si přečteš a pochopíš sama.

Jen víme, že máme se po dvou letech nezlepšila k lepšímu a je ztracená. V srdci má jen zlo a nenávist co jí samotnou zničí.

Chci abys věděla, že tě mám moc rád. Žádné Vánoční dárky nejsou tak důležité jako ty a abys byla šťastná.
