🚫 Do NOT risk becoming illegal in Estonia

Unfortunately, we still see many foreigners overstaying their allowed period of stay in Estonia and the Schengen area — often because they misunderstood the rules or simply ignored them.

⚠️ Staying illegally can lead to serious consequences:
• entry ban to Estonia or Schengen area
• visa refusals
• residence permit refusal
• problems with future immigration applications.

If you receive an entry ban, obtaining a visa or residence permit in Estonia can become impossible during the ban period.

If you stay in Estonia on the basis of short-stay (visa-free or Schengen visa), calculate your allowed days carefully.

🎓 PhD student or researcher in Estonia — choose the right residence permit

These two categories are often confused, but the application depends on your purpose in Estonia:

📌 PhD students
→ Apply for a temporary residence permit for studies

📌 Researchers / academic staff
→ Apply for a temporary residence permit for employment (research or academic work)

A research-based permit is possible if:
• you have a contract or hosting agreement with an approved institution
• the institution confirms income, insurance, and research funding
• you have relevant qualifications or experience

ℹ️ In some cases, a separate hosting agreement is not needed if all required details are included in the employment contract.

Make sure you apply under the correct category before starting the process.

🚨 NEW RULES for changing employer in Estonia with a residence permit for employment

In many cases, you no longer need to apply for a new residence permit when changing jobs.

Your new employer must submit:
• an application for registering the job change;
• permission from the Estonian Unemployment Insurance Fund (if required);
• a copy of your passport data page.

📌 The new employer must also meet the salary requirement valid at the time of submitting the application.

📌 You may start working for the new employer only after your employer has received a positive decision from the Police and Border Guard Board.

The application is usually processed within 30 days.

Permission from the Estonian Unemployment Insurance Fund is not required:
• if you change position within the same company;
• or if you have already lived and worked in Estonia for at least 12 continuous months with the same residence permit for employment before changing employer.

Always make sure you continue meeting the conditions of your residence permit.

🎓 Studying in Estonia and want to bring your spouse?

In most cases, a student must first live in Estonia for at least 2 years on the basis of a residence permit for studies before their spouse can apply for a residence permit for family reunification.

❗ This restriction does not apply to doctoral students.

If one of the spouses is studying in a doctoral programme, the spouse may apply for:
• a D-visa;
• or a temporary residence permit.

In other study cases (Bachelor’s or Master’s studies), the spouse may still apply for a D-visa if the general visa conditions are met.

🎓 Studying in Estonia: Temporary residence permit for studies (TRP)

Usually suitable for:
• Bachelor’s studies
• Master’s studies
• PhD studies

💡 Many long term students first arrive on a D visa and then apply for a temporary residence permit.

⏳ A TRP for studies is valid until the end of the nominal study period, but not longer than 5 years.

Where to apply:
• at an Estonian embassy handling visa applications
• or at the Police and Border Guard Board (if the person is already legally staying in Estonia).

⏳ The residence permit procedure takes up to 90 days.

📄 In addition to standard documents (application forms, photo, identity document etc), students also need:
• proof of legal income;
• health insurance;
• criminal record certificate from countries where the person has lived during the last 3 years;
• invitation from educational institution or student organisation.

⚠️ Submitting a residence permit application in Estonia does NOT give a legal basis to stay in Estonia. You must have a valid visa or other legal basis until the decision.

🎓 Studying in Estonia: D-visa (Long stay visa)

Usually suitable for:
• studies up to 1 year
• exchange studies
• short programmes

⏳ A D-visa is valid up to 365 days. Multiple D-visas cannot exceed 548 days in 730 days.

💡 Many long term students first arrive on a D visa and then apply for a temporary residence permit.

Where to apply:
• at an Estonian embassy handling visa applications;
• at the Police and Border Guard Board (if the person is already legally staying in Estonia).

⚠️ Application must be submitted to the Police and Border Guard Board at least 30 days before the legal stay expires.

📄 Usually required:

• photo
• health insurance
• proof of studies
• proof of legal income (for example bank account statements from the last 3 months)
• state fee payment
• data about relatives and family members

Highly qualified professional thinking about Estonia?

The EU Blue Card may be an option for you.

It is a temporary residence permit for employment in Estonia for highly qualified specialists.

Important to know:
👉 It allows you to work in Estonia, not automatically in other EU countries.
👉 It is linked to a specific employer in Estonia.
👉 It may be issued for up to 2 years and 3 months.

To qualify, you usually need:
• higher education (minimum 3 years), or
• professional skills and work experience considered equivalent to higher education.

Salary requirement:
💰 at least 1.5× average gross salary in Estonia
(For certain specialist roles, 1.24× may apply)

If you lose your job, you may remain unemployed up to 3 months (in some cases up to 6 months).

⚠️ Applications are generally subject to Estonia’s immigration quota unless an exemption applies.

Before travelling, make sure you know:

• real company name
• real workplace address
• city where you will actually work
• job position
• promised salary in writing
• whether the salary meets legal minimum requirements
• who your actual employer is

🚩Be careful if someone says:

• “You can work anywhere.”
• “The registration company is only for documents.”
• “Everything is arranged.”
• refuses to share details before arrival
• salary details are unclear or partly unofficial

🚩If important information changes at the last minute, this is a warning sign.

⚠️Clarification: counting residence time

People are often confused about how different periods of living in Estonia are counted for a long-term residence permit.

✅ To apply for a long-term residence permit, a person needs to have lived in Estonia for five continuous years on a temporary residence permit right before applying.

Not adding up all years spent in Estonia, but looking at the last 5 years before the application date.

🧑‍🎓If during these 5 years a person has held a residence permit for studies, this period is counted as 50%. This applies only if they later stay in Estonia on another basis, like work or family.

Remember:
• You cannot simply add up all years spent in Estonia
• Your legal status during the 5 years before you apply is what matters.
• Different types of residence are counted differently.

You must have a clear reason to move (work, study, family) — and an inviter in Estonia.

✔️ No employer = no work visa or residence permit

How it actually works:
1️⃣ Find a job
2️⃣ Employer registers your employment
3️⃣ Apply for a D-visa (up to 1 year) or residence permit

You cannot come to Estonia just to look for a job.
