【 #案件速遞 廉署、警方與競委會三方聯合行動 打擊樓宇維修貪污圍標集團拘50人】

廉政公署(廉署)聯同香港警務處(警方)及競爭事務委員會(競委會)上星期(8月26日及27日)採取代號「鐵盟」的三方聯合行動，打擊一個以一間工程承辦商為首的樓宇維修貪污圍標集團。廉署及警方在行動中拘捕共50人，包括集團主腦及骨幹成員，部分被捕人士有三合會背景。涉案樓宇維修項目涉及全港27個屋苑及大廈，工程合約初步估計總值近五億港元。

三個機構共搜查了39個處所，包括多間工程承辦商及顧問公司的辦公地點，以及涉案人士的住所，檢走相關樓宇維修工程文件和會計紀錄，並掃蕩涉嫌由相關有三合會背景人士操控的非法場所。

廉署、警方及競委會於是次行動成功瓦解該貪污圍標不法集團。三方重申會繼續緊密合作，全方位打擊涉及樓宇維修工程的貪污、圍標、黑社會活動、以及其他違法行為，並會持續加強相關宣傳及教育工作，向相關持份者提供指引及支援，防範貪污、反競爭行為及其他非法活動在樓宇維修工程中出現。

【ICAC Commissioner in Vienna to Meet UNODC Chief and Unveil ICAC’s AI Enforcement System “Tianma”】

ICAC Commissioner Mr Woo Ying-ming, leading his delegation, concluded a five-day visit to Vienna, Austria today (August 28). During the visit, Mr Woo and Ms Monica Juma, the newly appointed Executive Director of the United Nations Office on Drugs and Crime (UNODC), held their first bilateral meeting, finalising key future cooperation projects.

The delegation also introduced ICAC’s newly developed artificial intelligence (AI) enforcement system “Tianma” and a relevant development blueprint to over 130 experts from about 70 anti-corruption, law enforcement and regulatory agencies at the anti-corruption workshop under UNODC’s Global Operational Network of Anti-Corruption Law Enforcement Authorities (GlobE Network), drawing overwhelming responses. “Tianma” is developed to enhance corruption investigations by consolidating and analysing information with AI, as well as enhancing the effectiveness of computer forensics and forensic accounting. Experts attending the workshop actively exchanged with ICAC representatives and highly appraised the system, affirming that AI represented the future and vision of anti-corruption agencies, which would bring transformation to investigation while enhancing efficiency and effectiveness. In the future, the ICAC would continue to refine the system by incorporating the latest technologies to further enhance investigation quality and efficiency.

During the visit to Vienna, the delegation also met with Mr Yin Haigang, Charge d’affaires of the Permanent Mission of the People’s Republic of China to the United Nations and Other International Organisations in Vienna, to share the ICAC’s anti-corruption work.

The ICAC and the UNODC were close partners who have jointly delivered more than 20 initiatives over the past three years. The two parties also explored launching a high-level anti-corruption cooperation initiative in Hong Kong next year, advancing global anti-corruption cause.

【廉政專員於維也納 會見聯合國毒罪辦新任領導及介紹廉署全新「天馬」人工智能輔助執法系統】

今日（8月28日），廉政專員胡英明及其率領的代表團完成在奧地利維也納的五日訪問行程。胡專員更與聯合國毒品和犯罪問題辦公室（毒罪辦）新任執行主任莫妮卡 · 朱馬進行首次雙邊會議，敲定未來重點合作項目。

廉署代表團亦於毒罪辦轄下「全球反腐敗執法合作網絡」（GlobE網絡）會議的反貪工作坊上，向全球約70個反貪、執法和監管機構超過130位專家，介紹廉署自主研發的全新「天馬」系統及其發展藍圖，現場反應非常熱烈。「天馬」旨在以科技輔助貪污偵查，包括應用人工智能協助資料整理和分析，及提升電腦法證和法證會計的成效等。各國專家踴躍與廉署代表交流和學習，高度讚譽系統並認同人工智能是反貪機構的未來發展方向和願景，能改變未來貪污調查的模式，大大提升效率與成效。未來，「天馬」系統將不斷發展，引入最新技術以持續提升調查質素和效率。

代表團於維也納期間亦拜訪中華人民共和國常駐維也納聯合國和其他國際組織代表團臨時代辦尹海剛，介紹香港反貪工作。

廉署與毒罪辦過去三年攜手推動超過20個項目，在國際反貪路上合作無間。雙方亦商討明年在香港，推出更高層次的全新國際反貪合作方案，進一步強化全球肅貪倡廉的成效。

【ICAC Attends the “Belt and Road Initiative” Construction Dispute Premier Adjudicator Advanced Seminar】

The ICAC has always been committed to local anti-corruption mission while also deepening international anti-graft cooperation, contributing to the joint building of a “Clean Silk Road” and advancing global anti-corruption cause👏. Last week (August 22), Assistant Director of the Corruption Prevention Department Ricky Lai Wai-Ki, at the invitation of B&R JT Research Co. Limited and the B&R Construction Dispute Resolution Centre, delivered a lecture at The Belt and Road Initiative Construction Dispute Premier Adjudicator Advanced Seminar (2nd Edition, China-Arab Region). The seminar brought together about 30 experts from the fields of law, engineering and arbitration, with the aim of cultivating talent in related international dispute resolution.

At the thematic seminar “Building a Clean Silk Road: Proactive Anti-Corruption Strategies for Infrastructure Projects,” Mr Lai shared the ICAC’s longstanding and effective “Three-pronged” approach since its establishment, as well as the international legal landscape in anti-corruption. The seminar also highlighted areas which were more prone to corruption in construction, and the project integrity management framework. Real cases such as the “short-piling case” and the “Hong Kong–Zhuhai–Macao Bridge Project false concrete cube test records case” were used to underscore how digital controls and multi-layer approval mechanisms can effectively mitigate corruption risks during the assessment and investment processes of Belt and Road Initiative projects.

The ICAC will continue to share Hong Kong’s successful anti-corruption experience with international counterparts and work hand in hand with all parties to ensure that the Belt and Road Initiative remains a clean and upright “Clean Silk Road.”



【廉政公署出席「一帶一路」建設項目爭議首席評審員高級研修班】

廉政公署一直致力本地肅貪倡廉工作，同時深化國際反貪合作，為共建「廉潔絲綢之路」及全球反貪事業作出貢獻👏。上星期（8月22日），防止貪污處助理處長黎偉基應一帶一路建投研究院有限公司及一帶一路建設項目爭議評審中心邀請，於「一帶一路」建設項目爭議首席評審員第二期高級研修班（中阿區域）授課。研修班匯聚約30位來自法律界、工程界及仲裁領域的專家，旨在培養相關國際爭議解決人才。

黎偉基於「共建廉潔絲綢之路：基建工程項目的積極反腐敗策略」的專題講座中，分享廉署自成立以來恆之有效的「三管齊下」策略及國際反腐敗法律體系。期間亦重點介紹建築工程較高貪污風險的環節、工程項目誠信管理框架，並以「短樁案」及「港珠澳大橋工程混凝土磚測試記錄造假案」等真實案件為例，強調數碼管控和多層審批機制，如何有效協助「一帶一路」建投項目評審過程中減低貪污風險。

廉署未來會繼續向國際伙伴分享香港成功的反貪經驗，與各方攜手令「一帶一路」沿線繼續成為風清氣正的「廉潔絲綢之路」。

【企業管理人員反腐敗專業課程 助力在港中資企業廉潔合規】

#香港國際廉政學院 每年舉辦「企業管理人員反腐敗專業課程」，持續提升在港中資企業誠信管理風險能力。本年度的課程已於上星期（8月21日）圓滿結束，在香港中國企業協會協助統籌下，課程獲多間具規模的在港中資企業支持，共有30位高級管理人員參加及交流👥。

課程內容涵蓋香港反貪法例、防貪風險管理和誠信管治策略等課題，由香港國際廉政學院副總監張健寧及香港商業道德發展中心總幹事林淑儀主講，結合真實案例分享相關經驗。學院亦邀請到律政司法治建設辦公室首席政府律師歐陽慧儒，介紹企業如何善用香港的法治優勢及專業服務出海平台，拓展海外市場。

香港國際廉政學院總監柳智浩及香港中國企業協會副總裁曾燊典亦到場與學員交流，並在結業儀式上為他們頒授課程證書。

香港國際廉政學院將繼續深化企業的合規管理及防貪能力，發揮香港的誠信優勢，助力企業穩步發展海內外市場💪。

【Chinese Mainland Enterprises in Hong Kong Joining Professional Anti-corruption Training to Strengthen Integrity Management】

(HKIAAC) organises “Professional Anti-corruption Training for Corporate Senior Executives” annually, continuously enhancing integrity risk management capabilities of Chinese Mainland enterprises in Hong Kong. This year, the training was successfully concluded last week (August 21). Coordinated by the Hong Kong Chinese Enterprises Association (HKCEA), the course was supported by prominent Chinese Mainland enterprises in Hong Kong, with a total of 30 senior executives participating 👥.

The course covered topics including Hong Kong’s anti-corruption legislation, corruption risk management and mitigation, and integrity governance strategies. During the training, HKIAAC’s Deputy Director of Academy Andrew CHEUNG and Hong Kong Business Ethics Development Centre’s Executive Director Anna LAM shared insights through real cases and the essentials in ethical governance. HKIAAC also invited Principal Government Counsel Peggy AU YEUNG from the Legal Enhancement and Development Office of the Department of Justice, to share how enterprises can make good use of Hong Kong’s advantages under the rule of law and Professional Services GoGlobal Platform to expand their overseas markets.

HKIAAC’s Director of Academy Paul LAU and HKCEA’s Vice President ZENG Shendian also attended the training to exchange with the participants and presented them with course certificates at the closing ceremony.

HKIAAC will continue to strengthen the compliance management and anti-corruption capabilities of different enterprises, leveraging Hong Kong's competitive edge in integrity to aid enterprises in steadily developing local and overseas markets💪.

廉政公署早前起訴1名時任銀行經理，控告她向家人披露對方正被廉署調查，違反《防止賄賂條例》。被告今日(8月24日)在九龍城裁判法院被裁定罪名成立。

裁判官裁決時指，《防止賄賂條例》第30條的立法原意是禁止任何人士洩露任何有關廉署調查的資料，以避免受查人有所警惕，法例因而明文禁止任何洩露廉署調查的行為。

廉政公署昨日(8月20日)落案起訴香港大學1名副教授，控告他涉嫌從1名服務供應商收受現金賄款共約220萬元，向對方批出7份中小學資訊科技(IT)教育項目訂單，總值逾1,000萬元。該名副教授與涉案服務供應商及其妻子和姪兒，另被控涉嫌詐騙港大服務費。案件下星期一(8月24日)在東區裁判法院提堂，以待轉介至區域法院答辯。

【ICAC Invited to Share Asset Recovery Experience at ACFE Conference】

On August 18, the ICAC was invited by the Association of Certified Fraud Examiners (ACFE) to speak at its Fraud Conference Asia-Pacific held in Hong Kong. The conference brought together over 300 anti-fraud professionals from across the Asia-Pacific region, both in person and virtually.

Sudhir Gidwani, Head of Asset Recovery Office of the ICAC, was the speaker at the advanced session titled “Case Studies: Challenges in Restraining and Confiscating Proceeds of Crime”. As an experienced forensic accountant and ACFE member, Gidwani shared the ICAC’s expertise in financial investigations and asset recovery through practical strategies and real cases, particularly on how to trace and recover assets and confiscate proceeds of crime when facing significant challenges.

The ICAC will continue to seize opportunities to collaborate with international anti-corruption agencies and anti-fraud organisations to contribute to the global fight against financial crime.



【廉署受邀於國際註冊舞弊審查師協會會議分享追贓經驗】

8月18日，廉署應國際註冊舞弊審查師協會(ACFE協會)邀請，出席其於香港舉行的亞太區會議。會議匯聚來自亞太地區超過300名反舞弊專業人員親身及透過線上參與。

廉署追贓辦公室總監賈允誠於進階研討會「個案剖析：限制及沒收犯罪得益所面臨的挑戰」中擔任主講。作為一名資深法證會計師及ACFE協會會員，賈允誠透過實用策略及真實案例，分享廉署在財務調查及追贓方面的專業知識和經驗，特別是面對重大挑戰時，如何追蹤並追回資產及沒收犯罪得益。

廉署將繼續把握機會與國際反貪機構及反舞弊組織合作，為全球打擊金融犯罪作出貢獻。
