תמ"א 38
ראשי התיבות תמ"א הן קיצור של "תוכנית מתאר ארצית". תמ"א 38 היא תוכנית אשר מטרתה לעודד חיזוק מבנים קיימים אשר אינם עומדים בתקן הישראלי. התוכנית מגדירה אילו מבנים נדרשים לעבור עבודות חיזוק בכדי שיוכלו להתמודד עם רעידות אדמה וכן איומים בטחוניים. היות ועלויות חיזוק מבנים הינן גבוהות, תוכנית זו הוקמה בכדי להגביר את המודעות לצורך בחיזוק מבנים ולעודד ביצוע העבודות על ידי הוזלת העלויות הללו. התוכני
ת מאפשרת קבלת היתרי בנייה לחיזוק מבנים, תוספות בנייה, הקלות מס השבחה ופטורים משמעותיים. לדוגמא, הדיירים פטורים מכל חובת מס וכל העסקאות בפרויקטים של תמ"א 38 הן ללא תשלום מס.
מרבית המבנים אשר נבנו בארץ לפני שנת 1980 אינם עומדים בדרישות התקן הישראלי. היות ומדינת ישראל נמצאת על איזור השבר הסורי-אפריקאי אשר ידוע כאזור רווי רעידות, ישנו צורך לחזק מבנים אלו. תמ"א 38 הוצגה על ידי המועצה הארצית לתכנון ולבנייה, ואושרה על ידי ממשלת ישראל ב-14 באפריל 2005. עם זאת, ביצוע בפועל של פרויקטי תמ"א 38 החל רק בסוף שנת 2008 עם השלמת תיקוני חקיקה (חוק מיסוי מקרקעין, חוק התכנון והבניה וחוק המקרקעין).
תמ"א 38 יצרה הזדמנויות ויוזמות רבות, במיוחד באזורים בעלי ערך קרקע גבוה. עפ"י דו"ח שפרסם מינהל התכנון של משרד הפנים בשנת 2013, במהלך השנים בהם יושמה התוכנית ניתן לראות עלייה הדרגתית עקבית בהיקף הפרויקטים של תמ"א 38. בנוסף, הדו"ח קובע כי האזור הגיאוגרפי בו תמ"א 38 יושמה התרחב, והיא יושמה בעיקר במחוזות חיפה, תל אביב ומרכז הארץ. לפי הדו"ח, תמ"א 38 תרמה באופן משמעותי לתהליך של התחדשות עירונית באזורים עירוניים ותיקים.
כפי שצוין מעלה, בעלי דירות בבניינים שהוקמו לפני 1980 יכולים להרוויח משמעותית מיישום פרויקטים של תמ"א 38. היתרון הבולט עבורם הוא שפרויקטים מסוג זה ממומנים על ידי היזמים. בתמורה, הם מורשים לבנות יחידות דיור נוספות שנמכרות בסוף התהליך. הדיירים, מצידם, נהנים בסוף התהליך מתוספת לשטח הדירה וממגורים בבניין אשר עומד בסטנדרטים הנהוגים בתחום הבניין כיום, עם תשתיות חדשות וחזית מחודשת. היות והממשלה מבקשת לעודד פרויקטים מסוג זה, הרשויות המקומיות פועלות במטרה לזרז מתן היתרים לחיזוק מבנים וביטול כל המיסים הנוגעים לפרויקטים של תמ"א 38. TAMA 38 is meant to define which existing structures do not conform to the Israeli standards and building codes, and therefore require structure strengthening work against earthquakes and security threats. Since the costs of structural strengthening are high, in order to encourage awareness for structure strengthening, and to reduce related expenses, TAMA 38 was created. The plan enables the applicant to receive construction permits, and includes construction additions to existing structures, tax reliefs and substantial exemptions. For example, the tenants are exempt from all tax duties and all deals are tax free in TAMA 38 projects. Most buildings built in Israel prior to 1980 do not meet the requirements of the Israeli building standards. Since the state of Israel is on the Great Rift Valley, an area known for experiencing not-infrequent earthquakes, there is a necessity to strengthen these structures. TAMA 38 was presented by the National Council for Planning and Construction, and was confirmed by the Israeli government on April 14th 2005. However, actual execution began at the end of 2008, with the completion of law amendments providing for it (property tax law, planning and construction law, property law). TAMA 38 has created many opportunities and initiatives, especially in areas with high land value. According to a report issued by the planning management of the Israeli Ministry of Interior in 2013, over the years of TAMA 38 implementation, there has been a gradual and substantial increase in the scope of these kinds of projects. In addition, the report states that the geographical area in which TAMA is implemented has widened, and has been implemented most significantly in Haifa, Tel Aviv, and other areas of central Israel. Acorrding to the report, TAMA 38 has contributed greatly to the process of city renewal in old urban areas. As mentioned above, apartment homeowners can gain significantly from TAMA 38 projects. The most eminent benefit for tenants is that TAMA 38 projects are fully funded by the project owners. Project owners bring pre-1980 buildings up to code and make additional renovations. In return, they get permission to build additional apartments in the building, which are then sold. The profits from selling these new complexes fund additional TAMA projects. Since the government supports these projects, municipalities smooth the process by expediting permit approvals for structural strengthening and canceling any building related taxes involving TAMA 38 projects.
