PREAMBLE & CONSTITUTION of JKDYF
Preamble to the constitution
Jammu and Kashmir Democratic Youth Federation (JKDYF) undertakes the task of organising the youth of the villages and towns in Jammu & Kashmir State into a well-knit all-State youth organisation, and build a powerful youth movement to fight for a democratic, just, and a rational society in Jammu & Kashmir and for the upliftment and betterment of the lot of the youth as a whole. It shall strive to revive and strengthen the Kashmiri ethos, based on harmony, fellow feeling, tolerance and liberal thinking.
Young men and women are an integral part of our society and their upliftment and betterment, in the final analysis are dependent upon and determined by all round development of our State: industrial, agricultural and educational, and the material and cultural progress of the workers, peasants, middle classes and all other progressive people which constitute 90% of our population. Since many of the difficulties and problems that confront youth are directly connected with and dependent upon the prevailing socio-economic conditions and since the young men and women share all the sufferings, oppression and exploitation, their families are subjected to, they can not but evince keen interest in the socio-economic condition of the State and its radical all round development and progress.
The JKDYF is aware of the fact that the State was subjected to a foreign and dynastic rule and ruthless exploitation by native feudals, it produced nothing but mass scale poverty, hunger, misery, squalor for the vast majority of our people, forcing them to lead a sub-human existence. More than half a century of class rule and political uncertainty prevailing in the State, have done very little to alter their degrading and inhuman condition and it helped the growth of the domination of a handful of wealthy vested interests, which gave rise to divisive tendencies and obscurantism, hitherto unknown to the State. Earlier the Younger generation had played their proud and glorious part in fighting for the achievement of political independence, now it is the bounden duty of our Younger generation to actively engage themselves in the struggle for the liquidation of the evil legacies of dependence, backwardness and poverty, and for the laying of the foundation for a really free, prosperous and progressive future for our State and peaceful resolution of all contentions issues through reconciliation and dialogue.
Experience in post independent India, as well as the lessons from several other countries in the world, demonstrates the truth that the evil legacies of colonialism and backwardness cannot be liquidated and the State cannot be lifted out of its present morass unless the last vestiges of foreign and native exploitation are put an end to, unless feudal and semi-feudal landlordism is uprooted, unless social and economic injustice is eliminated and unless political uncertainty in the State is addressed through a process of reconciliation and mutual dialogue. The JKDYF as a forward looking and progressive youth organisation shall make common cause with most of the political parties, groups, class and mass organisation which pledge themselves to the cause of down-trodden people of the State, democracy, accountability and transparency, brotherhood, harmony, progress and peace, and support our aims and objectives, notwithstanding the fact that there are different and divergent views among them as to what they have come to consider the meaning of democracy and progress and the means and methods of achieving the same.
Our Youth is confronted with the spectre of unemployment in its most ominous proportion due to the bankrupt socio-economic policies pursued by the ruling classes. Against the background of this stark reality they are sought to be lulled with such shameless, demagogic slogans as poverty and unemployment will be eliminated and progress will be established by the ruling classes. The JKDYF is of the considered view that there are politics behind such deceptive slogans and platitudes and the youth community has no other alternative but to advance more and more united struggles against unemployment and poverty.
The JKDYF realises the fact that students constitute an important section of the youth and is aware of the urgent necessity of overhauling the present educational system and developing a scientific and democratic education suited to social needs and capable of developing all the abilities and creative faculties of students. Education can not achieve these aims unless the medium of instruction is the mother tongue and all private educational institutions are nationalised. Education should be freed of its pro-rich and elitist shackles. The JKDYF shall also encourage a free and frank discussion on how to rid the State of continuing violence and achieve progress and prosperity for the youth and the correct means and methods of achieving it. At the same time, the JKDYF is alive to the need of launching mass literacy campaigns, which should be state financed and should involve both official and non- official organisations participating fully to fight backward ideas and ignorance in our society.
Backward and decadent culture is polluting the minds of youth in the narrow interest of the ruling classes and there is the need for a progressive cultural policy, involving a balanced development of the mind and body, which should be propagated widely among the people and be easily accessible to them.
The youth movement is an integral part of the wider democratic movement of the common masses, the workers, peasants and other progressive forces. It can neither achieve its immediate demands nor realise its general aims and objectives except by a combined and united effort of all the progressive, democratic and forward looking forces in our State. As such, it seeks the co-operation and support of the democratic movements of workers, peasants and masses in general. It extends sympathy, co-operation and solidarity to all these movements and their aspirations. It raises its voice against all the exploitation and oppression and seeks the advancement of youth on a rational basis.
The JKDYF is aware of the divisive and disruptive trends that seek to divide the youth in the name of community, caste and place of birth, notes with grave concern the growing aggressiveness on the part of communal and obscurantist organisations which can only damage the basic interests of the youth. Their policies, based on narrow divisive outlook, not only undermine the unity of the youth and the masses at large but pose a grave danger to the integrity of our State. The JKDYF is committed to fight all such disruptive forces. The JKDYF also rejects the slogan of trifurcation or any other division of the State on narrow considerations. Youth cannot be prevented from uniting in struggle for a better future. The JKDYF also can not remain indifferent to the distortion of the slogan Youth power. It is of the firm opinion that youth are an integral part of the society and only by linking with the democratic movement the youth can advance their cause.
The JKDYF is deeply conscious of the fact that our society is based on great values of Noor-ud-Din Noorani and Lal Ded, which envisage a just and humane outlook. The recent efforts to undermine these values need to be fought back to achieve peace with dignity in the State. Narrow divisive approach and outmoded outlook of life, are not only hindering the progress and cohesion of the democratic and progressive movements, but they also threaten the unity and integrity of the State. The JKDYF pledges to uncompromisingly fight against every such outmoded and parochial manifestations.
Life and events in Jammu & Kashmir bear out the truth that parliamentary democracy is not safe in the hands of the ruling classes it’s tampering of adult franchise resulted in imposition of unpopular regimes in the past. The people of Jammu & Kashmir fought back these tendencies and shall continue to do so. Youth of Jammu & Kashmir shall join this fight in future as well. In this context the JKDYF pledges to mobilies the entire democratic and progressive youth of the State to defend and expand the democratic rights of the people.
The JKDYF and its movement, being what it is in the epoch that we are passing through, an organisation inspired by anti-imperialist, democratic and pro-people ideas, warmly extends its fraternal solidarity with all democratic and progressive forces of the world struggling for emancipation, and advancement, against the aggressive onslaught of the world imperialists, headed by US imperialism, who threaten the world with holocaust of a thermonuclear destruction.
The JKDYF seeks to establish fraternal and friendly relation with all other youth organisations, which are pledged to work for social harmony, democracy and social justice. It is prepared to unite with all on specific issues and demands and have united action with them, for the redressal of the grievances of youth.
Constitution of the JKDYF
1. NAME: The name of the organisation shall be THE JAMMU AND KASHMIR DEMOCRATIC YOUTH FEDERATION, hereafter referred to as JKDYF.
2. FLAG: The JKDYF flag shall be white in color with a five cornered red star in the Centre and JKDYF written in red, in English or in any State language, vertically adjacent to the pole stand. The length and breadth of the flag shall be in the ratio of 3:2.
Article 1. Affiliation to Youth organisation:
a). JKDYF may grant affiliation to any youth organisation based on a certain definite area of the state, District Executive Committee, provided the organisation accepts the policy, aims and objectives, and constitution of the JKDYF.
b) The affiliated bodies may have their own constitution provided that they do not transgress or conflict with the provisions of the constitution of the JKDYF.
c) Any organisation desiring affiliation to JKDYF shall pay a sum of 20% out of the membership fee per member on its roll to the central executive committee annually.
Article 2. Membership, Rights and Duties of Members:
a) Any youth between the ages of 15 and 40 years, irrespective of s*x, religion, caste and language who accepts the policies, aims and objectives and programme of the JKDYF, and pays the annual membership fee is eligible to be a member. The membership will continue normally for one calendar year.
b) The membership fee will be Rs.10/- annually.
c) Every member shall have the right to elect and be elected.
d) Every member shall have the right to express his/her opinion in his/her unit and subsequently before any of the higher committees.
e) Every member shall have the right of resignation.
f) All members shall have the responsibility of implementing all the programmes adopted through conference and decisions taken by their own and higher committees and the right and duty to propagate the aims and objectives, and carry out the activities, of the JKDYF.
g) Any one belonging to any political party/ organisation can become a member of JKDYF provided he/she agrees with the Aims/Objectives and Constitution of JKDYF.
Article 3. Structure of the Organisation:
a) State Conference.
b) State Executive Committee
c) Secretariat
d) District Committee
e) Area Committee
f) Local Units
g) Affiliated bodies organised on certain area basis.
Article 4. The Conference:
a) The State Conference will be the highest body of the JKDYF.
b) The conference shall normally be held every three years.
c) The affiliated bodies of JKDYF shall elect delegates to the All State Conference by voting on the basis of proportional representation in their respective conferences. The number of delegates to be elected shall be fixed by the SEC before every conference on a fixed ratio throughout State of Jammu & Kashmir . SEC members will be ex-officio delegates to the conference.
d) Delegation fee shall be determined by the SEC.
e) The Conference will review the work of the intervening period and will adopt the future programme.
f) The Conference will elect the State Executive Committee.
g) If the Conference fails to elect the SEC unanimously, the voting will be by secret ballot on the basis of proportional representation.
Article 5. State Committee.
a) In between the two conferences, the State Executive Committee (SEC) shall be the highest body.
b) The SEC shall execute the decisions of the conference.
c) The SEC shall elect the President, the General secretary, two Vice-Presidents, two Joint Secretaries and the treasurer from amongst its members as office bearers.
d) The secretariat shall be formed with office bearers of the SEC. If necessary, the SEC can indulge other members of SEC in the Secretariat.
e) The SEC shall draft the rules in conformity with the constitution for conducting the work.
f) The SEC shall meet at least thrice in a year and notice shall be circulated fifteen days earlier. If one third of the members of the SEC demand a meeting, a requisition meeting shall have to be called within two months.
g) The quorum for a SEC meeting shall be one third of the total number of members whereas for a requisitioned meeting it shall be half the total members.
h) The president or in the absence of the President, any one of the vice-presidents shall conduct the meeting of the SEC.
i) If a seat falls vacant due to resignation or for other reasons, the vacant seat shall be filled up by co-option.
j) The SEC shall make necessary arrangements to mobilize funds through mass collections and donations to conduct its activities.
k) The SEC shall have the right to set up the organization or preparatory committee in the district or a certain area of the State.
l) The SEC may form different sub-committees to carry out its work.
m) The SEC shall constitute Editorial Boards for the organs of JKDYF.
n) The State Conference shall be convened by the decision of the SEC.
o) The SEC shall prepare a statement on the work carried out and annual accounts and place those before the conference.
p) If any member of the SEC is unable to function normally as member due to imprisonment, illness, for being forced to go underground, or for any other valid reason, SEC can co-opt another member from the area to which the above mentioned member belongs to. The member so co-opted shall enjoy the rights of full member but when the original member joins the meeting, the alternative member shall cease to be a member of the SEC.
Article 6. Secretariat:
a) In between two SEC meetings the secretariat shall be responsible for the functioning of the organisation.
b) The general secretary, with consultation of the secretariat, shall convene the meeting of the SEC.
c) All bank accounts shall be maintained in the name of the JKDYF. The accounts will be under the signature of the President, the General Secretary and the Treasurer and shall be operated by any two of them. Any amount exceeding Rs. 10,000 for expenditure must be approved by the Secretariat.
Article 7: Disciplinary Action:
a) Any unit under jurisdiction of the JKDYF, which acts contrary to the interest of the JKDYF, will be liable to disciplinary action by the organisation. The forms of disciplinary action may include warning, criticism in public, or disaffiliation.
b) Any member of the organisation, who acts contrary to the interest of the JKDYF, will be liable to disciplinary action by the organisation. The forms of disciplinary action may include warning, criticism in public, removal from elected post, suspension or expulsion.
c) Disciplinary action will be taken against any member if the member’s activities are against the interest of the constitution of the organisation, by the duly constituted committee under whose jurisdiction the member is enrolled.
d) A unit or a member facing disciplinary charges will have the right to explain its/his/her conduct to the committee initiating action before the action is taken by the organisation.
e) Disaffiliation of a unit will have to be approved by the next higher committee and the unit which is disaffiliated will have the right to appeal to the higher committee and subsequently to the SEC.
f) Expulsion or suspension of a member will have to be approved by the next higher committee and member who is expelled or suspended will have the right to appeal to the higher committee and subsequently to the SEC.
g) The SEC can disaffiliate any unit under it for not conforming to the interest of the organisation or acting against the aims and objectives of the organisation. The SEC, in case of necessity, shall have the right to dissolve and re-organise any lower level committee in consultation with the state-committee concerned. State Executive Committee shall have similar power vis-a-vis unit under them. In the latter case the right of appeal for a unit lies with the SEC.
h) Disaffiliation or reorganization of any District Committee or a Unit by the SC must be placed for approval at the next All State Conference.
Article 8: Change in the Constitution:
a) The conference only can change or amend the constitution.
b) Any notice of proposed amendment in the constitution by any member or unit must be sent to the SEC at least one month before the Conference. The SEC, if it proposes to initiate amendments, must circulate those to the state committee one month before the conference.
c) All amendments to the constitution must be passed by the 2/3rd of the elected delegates attending the conference.
DEMENDS
1. Creation of more job opportunities for the unemployed youth and sanction of unemployment allowance till such youth succeed in getting employment.
2. To formulate State Youth Policy, State youth council and Action Plan that is implemented and evaluated by youth.
3. For a separate department for youth and segregate the department of youth services and sports and allocate special fund for youth department.
4. Creation of State Youth Welfare Board to include young people in large number in the board and decision making process.
5. Special funds for intermediate, college, universities and Non governmental organisation for training, seminar, consultation and awareness program for students and youth.
6. Promote employment oriented education and vocational training to capacitate the youth employability.
7. Introducing special self-employment and entrepreneurial schemes through- interest free loans, funds and subsides for unemployed youth, Youth Club, association and organisation.
8. To make Right to Information (RTI) Act more effective as it embraces not only political freedom but also the freedom to lead a life with dignity unfettered by domination and discrimination.
9. Both the government and non government sector should help the empowerment process which enables young men and women of all cultures to participate effectively and fully in society through leadership, change in mind set, awareness, capacity building and Life skills training.
10. Ensure access of land to youth clubs, organisations and associations.
11. Information technology parks in different pockets of the state to prevent migration and create employment.
12. To activate and make NSS, NCC, Scouts and Guides more youth oriented with inclusion of youth in monitoring local cells.
13. Initiate community based small-scale industries, promote local market and effectively implement NREGA and other centrally sponsored schemes.
14. Regulate and modernize the existing system relating to health of young people to ensure improved health facilities across the state in segments of nutrition, sanitation, hygiene and have access to safe drinking water. A special emphasis on HIV/AIDS (ART facility), tuberculosis, malaria, and rehabilitation of drugs addicts.
15. Address environmental issues through mass youth led projects and campaign to bring awareness in the areas as climate change, deforestation and depleting water level.
16. A special package for restoration and promotion of culture and art in the state and encourage young people to accept and feel proud of it.
