Mr Samuel Mbiriri and Ms Caroline Kaganzi, both qualified mediators shared their practical experiences within the Private Mediation Space.

Did you know that Private Mediation Process does not have a Qualified Mediators remuneration structure?

The facilitators encouraged the qualified mediators to be practical when charging the clients to encourage people to opt for Private Mediation.

A Private Settlement Agreement should be:
1. Written in the language of the Court (english/swahili)
2. Should be clear and not ambiguous
3. Should deal with all issues
4. Should be accurate
5. Should be logical
6. Should be practical
7. Should be enforceable

Do you also know that only a qualified mediator is one who has been accredited by Mediation Accreditation Committee (MAC) or Accredited by an institution recognised by MAC?

Do you know that acquiring certification (CPM) alone does not make you a qualified mediator?

Do you know that Rule 46 Court Annexed Mediation rules lay the basis for what can be presented as a Private Settlement Agreement?

August 2026 Raw Highlights from the Mediation Space in Kenya.‼️‼️

The Steering Committee On Mediation (SCOM) successfully completed the zero draft of the Judiciary Mediation Action Plan (JMAP) which is a five year structured roadmap on mediation from 2026-2031.

The mediation secretariat held a mediators roundtable with the accredited mediators from the Isiolo region. The roundtable discussions included sharing of experiences, challenges and best practises within the mediation space.

The Mediation Secretariat held a sensitization session with the Court Users Committee of both Isiolo Law Courts and Merti Kadhis Court.

The programme included the sensitization of both Court Annexed and Private Mediation and the distinction of mediation and other Alternative Dispute Resolution Mechanisms including AJS and the qualifications of an accredited mediator.

In attendance was the Head of station Merti Kadhis Court; Hon Mohamed Noor and various stakeholders in the justice system.

The Mediation Secretariat undertook a monitoring and evaluation exercise at Isiolo Law Courts. The exercise included a courtesy call on Hon. Maureen Odhiambo the Mediation Deputy Registrar and a sensitization session with the staff at the Court on the mediation practises and emerging trends.

The Secretariat also met with the members of the public and informed them of the mediation services available in Kenya.

The Mediation Secretariat conducted a monitoring and evaluation exercise at Marsabit Law Courts. The Secretariat paid a courtesy call on the Head of Station and Mediation Deputy Registrar, Hon. Christine Wekesa. The monitoring and evaluation exercise provided an opportunity for the Secretariat to engage with the staff and appreciate the support and cooperation of the station in the implementation of Court-Annexed Mediation activities.

Since the establishment of the registry in 2025, the court boasts of a settlement rate of 70% compared to the national average of 59%.
