📢 Gratuity Charges Are Optional! 📢

Business owners and customers, take note!

According to Section 35(5) of the Labour Act (2021 Revision):

"The prescription of a minimum rate of gratuity in respect of a business or an activity carried on by a business, or the inclusion of a gratuity in an account rendered by a business does not imply a contractual obligation on the part of a customer of that business to pay any gratuity shown or included in an account rendered on behalf of the business."

💡 This means that while gratuity may be suggested or added to a bill, customers are not legally required to pay it.

✔️ Transparency matters! Businesses should ensure clarity in their billing practices, and customers should be aware of their rights.

Important Reminder to Service Employers 🚨

You are legally required to have an approved and registered gratuity scheme with the Department of Labour & Pensions (DLP) before collecting any gratuity from customers.

📌 What the law says:
Under Section 37(1) of the Labour Act (2021 Revision), any service employer who collects gratuity without an approved and registered gratuity scheme commits an offence.

⚖️ Penalties for non-compliance include:
• A fine of CI$25,000
• Imprisonment for 12 months upon conviction, and;
Distribution of outstanding gratuity for the relevant period

Compliance isn’t optional — it’s the law.

An Approved Gratuity Schemes Register is now available on the DLP’s website under publications – www.gov.ky/dlp

📢 Approved Gratuity Schemes Register

The Department of Labour & Pensions’ list of establishments with an Approved Gratuity Scheme is now available to the public.

The list provides a useful reference for employees, employers and members of the public who would like to confirm whether an establishment currently operates under a gratuity scheme approved by DLP.

The information reflects approved gratuity registrations as of the date of publication. Approvals issued after the publication date may not yet be included.

The list will be updated monthly to reflect subsequent approvals and provide the public with the most current information available.

Need to report a workplace issue to the Department of Labour & Pensions (DLP)? It’s important to use the right reporting channel.

The DLP Confidential Tip Line is for persons who have information about a possible breach of labour, pensions, minimum wage, gratuities or workplace safety requirements and wish to remain anonymous. Tips can be left by calling 1 (345) 945-3073.

Please note: the Confidential Tip Line is not a formal complaint process. If you would like DLP to formally review a matter or investigate a complaint, you should complete the Preliminary Investigation Form available at gov.ky/dlp and submit it to DLP for review.

The right personal protective equipment can reduce the risk of serious injury. Essential PPE includes:

✅ Hard hat
✅ Safety glasses
✅ High-visibility vest
✅ Protective gloves
✅ Proper work boots — no Keds, Flip-flops or Crocs
✅ Hearing protection
✅ Respiratory protection, when required
✅ Fall-protection harness, when required

PPE is the last line of defence. Always wear the correct equipment for the task and ensure it fits properly and is in good condition.
