The Secured Transaction and Collateral Registry is an electronic public database that contains information on security interests on movable assets and the secured parties’ priorities. It will be maintained and managed by the Central Bank of Liberia (CBL). The Registry is for all types of financial transactions secured by movable assets. The Collateral Registry’s main purpose is to ensure /induce t

ransparency to the Liberian’s credit system by: (i) providing publicity that a security interest may exist in an identified collateral and (ii) establishing priority of secured parties by day and time of registration. The Registry provides for searches to be conducted on its database so that a secured party can find out if there is/are prior security interest/s in the properties offered by any debtor/s as collateral for a loan. The Secured Transaction and Collateral Registry will encourage access to finance through the use of movable assets and will bring transparency to the credit system. Enforcement:
In the event of default (the debtor does not repay a loan), the secured party has the right to enforce their security interest in the collateral. In enforcing, the secured party will use legal remedies that include either taking possession of the pledged collateral, disposing of the collateral through a sale and keeping some or all of the proceeds depending on the amount of security interest or may also choose to apply to the court to authorize enforcement. The law allows the secured party to proceed extra-judicially without having to obtain a court order before repossessing the collateral. The Secured Transactions and Collateral Registry has its legal backing from Chapter 5 of the Liberia Commercial Code of 2010 and The Secured Transactions and Collateral Registry Regulations issued by the CBL in 2013.
