Competition and Fair Trading Commission of Malawi CFTC is dedicated to improving the efficiency of Malawi’s economy for the benefit of all Malawians.

The Competition and Fair Trading Commission is a body corporate established under the Competition and Fair Trading Act of 2024 to promote competition and safeguard the welfare of consumers in Malawi. The Competition and Fair Trading Commission (CFTC) was established under the Competition and Fair Trading Act of 2024 with a mandate to regulate, monitor, control and prevent acts or behaviours which

would adversely affect competition and fair trading in Malawi. This is done in the following ways:

(1) Regulation of mergers and acquisitions of companies
(2) Monitoring monopolies and concentration of market power and taking corrective action against abuse of dominance
(3) Prohibiting anti-competitive practices by enterprises against each other
(4) Consumer Protection: Taking corrective action against enterprises that create unfair trading conditions for the consumer

MARKETERS URGED TO DISCLOSE TERMS AND CONDITIONS

The Competition and Fair Trading Commission (CFTC) on Tuesday evening encouraged Malawian marketers to disclose the Terms and Conditions (T&Cs) of their campaigns to consumers.

Speaking during a webinar organized by the Institute of Marketing in Malawi (IMM), CFTC Chief Consumer Analyst Augustine Nyirenda emphasized the importance of marketers presenting T&Cs at the onset of a campaign.

“Where applicable, terms and conditions may be negotiated and agreed upon,” Nyirenda stated.

He further noted that the Competition and Fair Trading Act (CFTA) stipulates that a contract is regarded as unfair if it causes a significant imbalance between the parties involved.

During the hour-long session, which was attended by over 60 IMM members, Nyirenda also highlighted, legal and ethical responsibilities of marketers, common unethical marketing practices and their legal consequences, best practices for responsible marketing and the role of the CFTC in safeguarding consumer interests.

CFTC CONCLUDES WORLD CONSUMER RIGHTS DAY CELEBRATIONS

The Competition and Fair Trading Commission (CFTC) wrapped up this year’s World Consumer Rights Day celebrations with a series of outreach visits to four districts on Wednesday, March 18, and Thursday, March 19.

The Commission targeted rural communities to ensure that consumer protection information reaches those who need it most. The itinerary included meetings at Kanyenda and Mpalale in Dedza, as well as Mponela and Mvela in Dowa on Wednesday, March 18. On Thursday, March 19, officers visited TA Kwataine and TA Makwangwala in Ntcheu, concluding the tour at the Mchinji Boma.

Between Monday and Thursday, the Commission successfully conducted 15 sensitization meetings across various rural areas. To provide a comprehensive look at consumer safety, these sessions featured presentations from the Malawi Bureau of Standards (MBS) regarding safety standards and certification processes.

This year’s celebrations were held under the theme “Safe Products, Confident Consumers.” The CFTC specifically tailored its community sessions for rural and vulnerable populations, who are often at the highest risk of falling victim to unfair trading practices. By bringing these discussions directly to the communities, the Commission aims to build a more informed and protected marketplace for all Malawians.

In celebrating this year’s World Consumer Rights Day under the theme Safe products, Confident Consumer, we are reminded that the Competition and Fair Trading Act (CFTA) under Section 51(e) provides as follows: A person shall not, in relation to a consumer supply any product which is likely to cause injury to health or physical harm to consumers, when properly used, or which does not comply with a consumer safety standard which has been prescribed under any written law.

CFTC EMPOWERS RURAL COMMUNITIES IN THYOLO AND RUMPHI

On Monday 16th March, the Competition and Fair Trading Commission (CFTC) conducted sensitization meetings at Saint Anthony, Khonjeni, and Mtambanyama in Thyolo, reaching over 1,200 consumers. Participants expressed that they now feel empowered to identify and report unfair trading practices.
In the Northern Region, the Commission visited Mhuju and Chinyolo in Rumphi, reaching out to over 250 people. These sessions included representation from the Malawi Bureau of Standards (MBS) and the respective District Offices.

To celebrate this year’s World Consumer Rights Day under the theme “Safe Products, Confident Consumers,” the CFTC will continue to host community sensitization sessions. These programs are specifically tailored for rural and vulnerable populations, who often face the highest risk of falling victim to unfair trading practices.

Kennedy’s 1962 address to the US Congress, which highlighted four fundamental consumer rights: safety, information, choice, and the right to be heard.
