*Mother of Four Sentenced to Death for Allegedly Setting Husband of 26 Years Ablaze; She Maintains Her Innocence*

One of our sisters visited a prison for a special visitation and met a woman serving a life sentence. This woman was Commutted to life imprisonment from death row last year by the Executive Governor of Ogun State, who acted with magnanimity. She shared her claims of innocence with us, groaning in pain as she did so. According to this mother of eight (four of whom are surviving) and the breadwinner of her family, she was accused of sprinkling and setting ablaze her husband of 26 years, the father of her four surviving children, on October 21, 2014. He was sentenced to death on July 5, 2018.

However, the woman insists that her husband died mysteriously in a fire incident on the morning of that date while she was feeding her chickens in the backyard. Her husband ran out engulfed in flames, and she managed to extinguish the fire and called for help from neighbors, who rushed him to the hospital. Unfortunately, he died the same day, and she was subsequently held responsible for his death.

There is a similar story of a woman who attacked her husband with acid because he was in love with another woman. This woman, who was among those released last year, confided in us that she acted out of desperation, as her husband wanted to bring another woman to inherit the house they had built together, to which she had significantly contributed.

In a similar vein, the woman we are discussing claimed that she built her house without any contribution from her husband. She confided in us that there was a time when her husband wanted to marry another woman, and she stood against that move, but that was long ago.

The mother of four pleaded with our organization to intervene in her case for total freedom. We contacted her eldest son, who testified that there had been no previous misunderstandings between his parents that could have led to such tragic events. He explained the hardships they have been enduring without their parents, which have severely affected their education.

Navigating the brief of argument presented by the lawyer *(Francis Ogunbo wale Esq)* before the Appeal Court, CJMR noted that the woman was convicted based on inconclusive circumstantial evidence. It was also observed that the police did not allow the woman to confront her husband face to face to confirm the statements made against her. Furthermore, the police did not bring the accused face to face with the man who testified against her during the investigation and lastly,

The lawyer who reviewed the court records accused the prosecution of withholding evidence that could have favored the accused during the trial most importantly the evidence of her son. Notably, the doctor who prepared the medical report did not appear in court throughout the trial.

Our comprehensive evaluation suggests that this woman may have a chance at total freedom if we can present her appeal to the Board of Mercy for their kind consideration.

If you have 100 reasons to quit, find just one reason to forge ahead. If you discover a wide gap to fill, stand in that gap no matter what. If you encounter a broken bridge, look for a plank to help others cross. Many individuals are struggling, often unsure of whom to turn to or where to go. God has a purpose for our lives, and nothing can cancel that purpose—not even our ignorance.

We have reached out to her son, whose evidence was withheld during the trial. He firmly maintains that his mother had no reason to harm his father in such a manner. His testimony adds weight to her claims of innocence and highlights the need for a thorough reevaluation of the case.

I am the Executive Director for the Centre for Justice Mercy and Reconciliation, CJMR.

The Centre for Justice Mercy and Reconciliation, is a grassroot Non-Governmental Organization based in Ibadan, Oyo State Nigeria with focusing on the inmates on death row and those in the awaiting trial section with dedication to listen to their complaints and seek redress for justice on behalf of the individual affected with the justice system in Nigeria without ethnicity, gender or religion.

We specialize in the areas of Research, Investigation, Advocacy, Review of cases and analysis, Restorative Justice and Rehabilitation.

We seek improvement in Criminal Justice System in Nigeria with Non-Judicial approach.

This organization was founded in 1999 and established in 2009.

We have successfully facilitated freedom of 22 people who were victim of wrongful conviction including the recent two people granted by the Ogun State Governor.

We have secured freedom of over 700 detainees and over 300 beneficiaries have been properly integrated into the society through the Halfway Home facility.

We do this by reviewing their judgement and analysis of the Court proceedings from the layman perspectives, we link the individual affected to a lawyer who can take up such cases to the Higher Court for appeal on Pro-bono.

Through this process if the appeal failed, we shall take our case before the states Board of Mercy for consideration.

Through this approach, we have secured freedom of 4 cases in Ogun State, 1 in Ondo State and 17 people in Oyo State after spending 17 to 28 years behind bar unjustly.

We are the silent voices in the wilderness of jungle justice for the voiceless and hopeless individual affected.

A 16 year old boy sentenced to death with his mother

A 16-year-old boy and his mother have been sentenced to death on the allegation of murder in a certain town in Nigeria. Our investigative efforts to ascertain the boy's age have proven to be true.

In our attempt to reach out to the sister of the boy's mother, we coincidentally stumbled upon her daughter who answered the phone.

Me: Where is your mum?

She: My mum has gone to the market. She doesn't take her phone out during the rainy season, so she left it with me.

Me: What is your relationship with Rasheed?

She: Rasheed is the son of my mum's junior sister.

Me: What is Rasheed's age?

She: Rasheed should be 23 years old because we are the same age.

I asked her about her age, and she said she is 23 years old. I then asked for her birthday, and she replied that she was born on December 20, 2001

I inquired about Rasheed's birthday, and she responded,

let me go and check the wall.
"Rasheed was born on February 25, 2002, with the help of a midwife from Etsako West Local Government, Agbede. I miscalculated, but we are the same age."

The boy was arrested on 26 April, 2017 and he was sentenced to death on 7th August, 2020

Age may not matter as much as whether the boy and his mother truly committed the crime. What strong evidence is before the court that warranted such injustice?

The Centre for Justice, Mercy & Reconciliation (CJMR) is making frantic efforts to shed light on the case.

It is important to speak out against injustice, regardless of whether it directly affects us. The CJMR is working to investigate the matter thoroughly. We must not limit our findings to the claims of these people; we need to extend our investigation to their lawyers and visit the town where the offense was committed to make some crucial aspects and to obtain the judgment and court documents for review.

Recognizing the inherent dignity and worth of every individual is essential. By speaking out against injustice and standing up for those who are mistreated, we can help create a more just and equitable society for all.

When we witness injustice against the poor in our community, it is crucial to take action. Standing up for what is right and advocating for the oppressed is a fundamental aspect of being human and aligns with our Christian faith.

Proverbs 24:11-12 NLT states, "Rescue those who are unjustly sentenced to die; save them as they stagger to their death. Don’t excuse yourself by saying, 'Look, we didn’t know.' For God understands all hearts, and he sees you."

The police collected my new phone and charged me with murder, an offense I knew nothing about.

When someone is locked up behind bars and cries persistently, claiming innocence, someone should have the courage to listen to them and take further steps to investigate their story. If there is truth in their narrative, then someone should stand up and speak on their behalf.

During a recent visit to Kirikiri Maximum and Medium Custodial Centre, we attended to 11 people who strongly believe they are being unjustly oppressed. Here are their stories:

The first man said, "I heard that the police arrested my master and two other apprentices. I followed my master's father to the police station to sympathize with him. Unfortunately, my master's father and I were also arrested and detained in this case. The police tortured me to the point of death until I confessed to something I know nothing about. It is very unfortunate that about 10 of us were charged in court, but 5 people, including my master's father, have been released while I was left behind."

Me: Where is your master?
Him: He is inside the cell.
Me: Officer, can you help us bring his master and other case mate.
Upon their arrival, I ordered him to go out and I asked the first accused about the truth of the matter. Both the 1st accused and his master exonerated him of the crime, and they are ready to write an exoneration letter.

The earlier the exoneration, the better, rather than subjecting him to the agony of a trial.

The second man shared, "My wife's friend and close neighbor falsely accused me of defiling her daughter. I have no idea why she plotted this evil against me. She had already written a letter of apology and retraction before the case was transferred to Panty. Suddenly, I was taken to court and then to Kirikiri, where I have been facing this problem since 2021. A father of five children, I am now languishing in jail. When asked about his wife and children, his wife has abandoned him and is now with another man. She left the children with his mother-in-law." I contacted their lawyers, they felt sorry for them but there is nothing they can do until the state brings forward their witnesses with their evidence. What is your evaluation of the case as a lawyer? I don't think there was any serious evidence in the case.

There was also a teacher who was sentenced to 60 years in imprisonment on a case of defiling a minor, but I couldn't listen to his story. I promised to come back and hear his side of the story.

How can the justice system work towards ensuring that individuals who claim innocence are listened to and that their cases are thoroughly investigated to uncover the truth.?

Except an Independent body established or shown concern to review the claim of an individual and present evidence of their innocence before the Ministry of Justice

There is a need to raise public awareness about wrongful convictions and the importance of ensuring that all individuals are treated fairly and given a chance to prove their innocence at the earliest before is too late.

To ensure that individuals who claim innocence are listened to and their cases thoroughly investigated Centre for Justice Mercy and Reconciliation CJMR is a faith based non Governmental organization that investigates claims of wrongful convictions in Nigeria Custodial and ensures that individuals are given a fair chance to present their side of the story.

Amidst the *COVID-19* Challenges, this is what we are able to accomplish in the prison ministry in 2020. We visited 5 prisons in the Southwest. Agodi, Ibadan, Oyo State. Ijebu Ode and Abeokuta, Prison, Ogun State. Ilesha, Osun State, Kirikiri, Lagos State.
10 gained freedom from Ilegal detention after 4 to 7 years. 4 gained freedom after 17,18, 21 and 28 years. In Oyo State an 80 years old woman gained freedom from Ilegal detention. At the end of the year we fed 1,100 inmates and blessed 10 widows.

2 Cor 1:8-10 _We do not want you to be uninformed, brothers, about the hardships we suffered in the_ _province of Asia. We were under great pressure, far beyond our ability to endure, so that we despaired_ _even of life. 9 Indeed, in our hearts we felt the sentence of death. But this happened_ _that we might not rely on ourselves but on God, who raises the dead. 10 He has delivered us from such a deadly peril, and he will deliver us._

*Year 2020* has come and gone, we all know that the experience of that year perfectly matched the word of Apostle Paul here.

There is no calling without challenges.The road to success was never a smooth highway drive.

Looking back to what we went through in 2020, there is no way we can write another epistle than what Apostle Paul has written above.

No day is free from evil. No year without challenges but year 2020 was particularly a different year for the inhabitant of this planet. Amidst the global Pandemic, followed by the EndSARS protest and mass killing we went through but not withstanding many success stories were recorded and we are forging ahead.

*REPORT IN SUMMARY:* Sitting down reflecting on the activities and accomplishments in *2019 /2020* we have a reason to thank God on your behalf and we know that some people are also thanking God on our behalf because of your support. *Last year 2020* despite the sudden slam of prison gate because of the pandemic the prison gate was thrown opened for 13 people as a result of CJMR intervention. Out of 6 applications made to the Board of Mercy, 4 Convicts from Oyo State serving jail term in Kirikiri Maximum and Ibara Maximum Correctional Service, gained their freedom after *17, 18, 21 and 28* years behind the bar. One person was commuted to life imprisonment after 18 years on death row and the other application was turned down. 9 Detainees from Igbeba Correctional Service, Ijebu Ode, Ogun State gained their freedom after spending 4 to 7 years in illegal detention without case file in the Ministry of Justice.
