Official people democratic party (PDP) Demands Disbandment of Plateau State Election Appeal Court Panel Over Varying and Conflicting Judgments …Seeks Review of Judgements, Petitions NJC

Gentlemen of the press we invite you today to draw attention of Nigerians and the International Community to a dangerous pattern of varying and conflicting judicial pronouncements by the Plateau State Election Appeal Court Panel sitting in Abuja to undermine Democracy and the expressed Will of the people of Plateau State in the 2023 National Assembly Elections.

This frightening pattern by the Plateau Appeal Court Panel constitutes a clear and present danger to our democratic process, national peace and stability; a bad precedent for judicial mischief and particularly a recipe for anarchy, chaos and breakdown of Law and Order in already tensed Plateau State.

The people of Plateau State are unsettled by allegations in the public domain that the Plateau State Election Appeal Court Panel has been hugely compromised and induced by the failed All Progressives Congress (APC) in Plateau State to undermine the Will of the people by snatching elections clearly won by the PDP and awarding same to the APC as now evidenced in its inexplicable varying judgments on same election context and circumstances.

What can explain the brazen departure by the Appeal Court Panel from the judicial practice where cases with similar facts and applicable laws, especially before the same Court, at the same material time, result in different outcomes?

Curiously, the Panel in the most concerning pattern reached different conclusions with respect to election appeals with the same subject matter, same facts, same circumstances and same applicable laws in bias judgements clearly skewed against the PDP in favour of the APC.

As you are aware, from the votes cast in the 2023 general elections, the PDP recorded a sweeping victory over the APC in Plateau State.

However, apparently in a mission to assist the APC in its plots to rob our Party of victory, the Plateau State Election Appeal Court Panel gave varying and conflicting judgments in Appeals before it despite the clear similarity in facts, circumstances and applicable laws.

What is more disturbing is that in all the Appeal cases, the Court ordered a rerun where the PDP won and the APC came third, while where the APC came second, it ordered that the Certificate of Return issued to the victorious PDP candidate be withdrawn and a new Certificate of Return be issued to the APC candidate, who came second in the election.

Specifically, in the case of Plateau North Senatorial District won by Sen. Simon Mwadkwon of the PDP and the APC candidate coming third, the Panel in its judgment in Court of Appeal No. CA/J/EP/PL/SEN/12/2023 delivered on

Sunday 22nd October, 2023 curiously annulled PDP’s victory and ordered INEC to conduct a rerun election among all the Parties.

In the case of Jos North/Bassa Federal Constituency won by Hon. Musa Agar of the PDP and where the APC candidate also came third, the Panel in its judgment in Court of Appeal No. CA/J/EP/PL/HR/14/2023 delivered on Friday 27th October, 2023 annulled the victory of the PDP and ordered a rerun excluding the PDP.

In the third Appeal Case of Shendam/Quaan-Pan/Mikang Federal Constituency, won by Hon. Isaac Kwallu of the PDP with John Dafwan of the APC as runner-up, the Appeal Court Justices in Court of Appeal No. CA/J/EP/PL/HR/18/2023 annulled the victory of the PDP candidate, declared the APC candidate as outright winner and ordered that the Certificate of Return issued to the victorious PDP candidate be withdrawn and a fresh Certificate of Return issued to the APC candidate.

Rivers crisis: There’s nothing wrong with father and son having problems, says Fubara


Siminalayi Fubara, governor of Rivers, says the political crisis in the state will be resolved.

The governor spoke on Wednesday when Christopher Musa, chief of defence staff, led a military delegation to visit him at the government house in Port Harcourt.

Alluding to Nyesom Wike, his predecessor who is the minister of the federal capital territory (FCT), Fubara said there is “nothing wrong if a father and a son have a problem”.

“For our dear state, I know everybody is wondering what’s going on, what’s not going on. We are okay, there is no problem,” Fubara said.

“If we have an internal issue, it will be resolved and everything will go back to normal.

“There is nothing wrong if a father and a son have a problem. If there is any problem — but I don’t think there is anything. Whatever it is, we will definitely resolve the issue.”

On Monday, political tension heightened in Rivers state when some lawmakers in the house of assembly moved to impeach Fubara.

Ehie Edison, Fubara’s ally, was removed as the leader of the state assembly but hours later, he was elected as the new speaker.

The crisis in the state is linked to a rumoured rift between Fubara and Wike.

On Tuesday, Wike and Fubara met at the presidential villa — the first sit-down between the duo since the crisis.

While addressing a delegation of south-south leaders in Abuja, Wike who spoke about the crisis for the first time, said the political turmoil in the state is a party affair.

Bala Mohammed, governor of Bauchi and chairman of the PDP governors forum, had said President Bola Tinubu has intervened in the crisis, expressing optimism that peace will be restored in the state.

The PDP had also called on all actors in the state to “sheathe their swords and allow for a peaceful and amicable resolution of all the issues”.

Appeal court sacks Suswam, declares APC’s Udende as Benue north-east senator


The court of appeal in Abuja has sacked Gabriel Suswam of the Peoples Democratic Party (PDP) as senator representing Benue north-east.

The appellate court, in a unanimous decision by a three-member panel, declared Emmanuel Udende of the All Progressives Congress (APC) as the duly elected senator representing Benue north-east district.

The Independent National Electoral Commission (INEC) declared Udende as the winner of the February 25 election after polling 135,573 votes to defeat Suswam who garnered 112,231 votes.

Not satisfied with the outcome of the poll, Suswam, a former governor of Benue, approached the state national assembly election petitions tribunal on the ground that the exercise was marred by over-voting, alterations and falsification of results.

On September 8, the tribunal sacked Udende and declared Suswam as senator representing Benue north-east.

In the lead judgement, Ory Zik-Ikeoha, chairman of the three-member panel, declared that the evidence provided by the petitioner’s counsel established that there were cases of over-voting, falsification and mutilation of result sheets as well as malpractices “in five out of the seven LGAs that make up the senatorial district”.

The panel cancelled 51,895 votes entered for Udende and also cancelled 21,229 votes recorded for Suswam.

After subtracting the votes, Suswam was left with 90,590 while Udende scored 82,699 votes.

However, the appellate court on Wednesday reversed the judgement of the tribunal, noting that it found merit in the appeal that was lodged before it by the APC candidate.

The panel led by Abimbola Adejumo held that Suswam was not the valid winner of the election.
“The judgement of the tribunal delivered on 8th of September, 2023 is hereby set aside,” Adejumo said.

“The return of the appellant as the winner of the Benue north-east senatorial election that was held on February 25 is hereby affirmed.

“Parties are to bear their respective cost.”

President Tinubu targets $1 trillion economy by 2026, $3 trillion by 2030

FG budgets N5 billion for presidential yacht, N5.5 billion for student loan

The federal government has proposed to appropriate the sum of N5.095 billion for the purchase of a presidential yacht under the capital expenditure Nigeria Navy and N5.5 billion for education loan funds in the 2023 supplementary budget.

This is contained in the 2023 supplementary appropriation details of MDA spending obtained by Nairametrics.

According to the document, the Nigerian Navy proposed a capital expenditure of 42.3 billion and a recurrent expenditure of N20.42 billion, making a budget of around N62.8 billion.

Other items in the budget proposal from the Nigerian Navy include the purchase of vehicles, construction of the naval base in Lekki and Epe, provision of critical equipment, and purchase of ammunition.

The student loan program
The federal government, under the capital supplementation for the 2023 supplementary budget, proposed the sum of N5.5 billion as an education loan fund to fund the student loan. The total capital supplementation for the 2023 supplementary budget totaled N210.5 billion.

The Access to Education Act, also called the Student Loan Act, was sponsored by Rt. Hon Femi Gbajabiamila passed by the ninth NASS but signed into law by President Tinubu in June.

The law seeks to provide interest-free loans to students of higher institutions across the country and bring an end to incessant industrial actions plaguing higher institutions of learning in the country.

President Bola Tinubu, during a recent address at the Nigeria Economic Summit, noted that the student loan program “must begin in January 2024” after initial delays.

Industrial Actions in Nigerian Universities
Nigerian higher institutions have been plagued by recurring industrial actions from staff unions, ASUU, ASUP, etc. Major reasons for the actions range from lack of funding and autonomy of tertiary institutions.

In 2022, around 8 months of learning in Nigerian universities was lost due to industrial action from the Academic Staff Union of Universities.

In 2020, the university staff union also embarked on a 9-month strike to press home their demands from the government.

Tinubu asks n’assembly to approve $7.8bn, €100m in FG’s borrowing plan

President Bola Tinubu has asked the national assembly to approve the sums of $7.8 billion and €100 million in his administration’s proposed 2022 – 2024 borrowing plan.

Tinubu’s request was contained in a letter read by Senate President Godswill Akpabio on the floor of the upper legislative chamber on Wednesday.

A similar letter from the president was read by Tajudeen Abbas, speaker of the house of representatives, on the floor of the lower legislative chamber.

The president said the funds when obtained would be used to assuage the current economic realities and undertake a number of projects cutting across various sectors of the economy.

“The projects cut across all sectors with specific emphasis on infrastructure, agriculture, health, education, water supply, security and employment as well as financial management reforms, among others,” Tinubu said.

“The total facility of the projects and programmes under the borrowing plan is $7,864,508,559 dollars and then in euro, €100 million respectively.

“The senate is invited to note that following the removal of fuel subsidy and its impact on the economy in the country, African Development Bank (AFDB) and the World Bank Group (WBG) have indicated interest to assist the country in mitigating the economic shores and recent reforms with a sum of $1 billion and $2 billion respectively.

“In addition, the federal executive council approved the 2022-2024 external borrowing plan. Consequently, the required approval is in the sum of $7,864,508,559 dollars and in terms of euro, €100 million.”

The president added that projects would be implemented in all the states and the federal capital territory (FCT).

After reading the president’s communication, Akpabio announced that Tinubu attached details of the projects in his request.

Sam Adeyemi: Nigeria’s leaders driven by money — but sacrifices must be made

Sam Adeyemi, senior pastor of Daystar Christian Center, says leaders in Nigeria are driven by money.

He spoke on a Channels Television program on Wednesday while discussing redefining leadership in Nigeria.

Adeyemi said there are institutions that help to build someone into a leader, and it starts from the family.

He added that the pressure on families because of the economic hardship is eroding national values.

“The very place character should be built, families, are chasing after what to eat,” he said.

On how collaboration can thrive between ministries, agencies, and state governments, Adeyemi said people in leadership have to make sacrifices and have clear visions.

“What drives people in leadership now is money,” he said.

“Nigerians are not foolish. The instinct for survival is the strongest. The people you are asking to collaborate with, the only collaboration that makes sense to them, is how they make more money.

“All the contracts going out of the MDAs (ministries, departments and agencies), even the oversight functions for the national assembly, it is money driving it.

“That is why vision is very important as a leader. You got to sell that idea, transfer that idea to people’s hearts about where we are going and how we will get there and it’s that where we are going to that will give motivation to people to sacrifice.

“The people in leadership need to make sacrifices now for that collaboration to happen, but I promise you most people in leadership now are not thinking sacrifice. They are thinking survival.”

He said most Nigerians want development, and that is why the people and the leaders need to develop the country to be like those nations Nigerians are migrating to.

He added that there must be a conversation among Nigerians about where they want Nigeria to be, adding that it must start with dusting the report of the 2014 national conference and implementing some of its recommendations.

Supplementary budget: FG to spend N1.5bn on vehicles for first lady’s office

On Monday, the federal executive council (FEC) approved the submission of a supplementary budget of over N2.17 trillion to the national assembly.

The President Bola Tinubu-led federal government had proposed the sum of N26 trillion for the 2024 budget, which will also be submitted to the national assembly before December 31.

The unprecedented budget sum was announced when the council approved the 2024-2025 medium-term expenditure framework (MTEF) and fiscal strategy papers (FSP) at the FEC meeting held on October 23, in Abuja.

Following the announcement of the supplementary budget on Monday, the house of representatives quickly passed the bill for a second reading.

Similarly, the senate also passed the supplementary budget for a second reading — after Tinubu asked the senate to “speedily” consider and approve the appropriation bill.

The national assembly’s approval of the supplementary budget will increase the country’s total budget to N28.17 trillion.

Here are a few highlights of the budget.

STATE HOUSE BUDGET

The federal government plans to spend N28 billion on the needs of the State House. A breakdown of the figure showed that the federal government earmarked N2,900,000,000 for the purchase of SUV vehicles.

The sum of N2,900,000,000 will also be spent on the replacement of “operational pool vehicles”. The renovation of residential quarters for the president, and Aguda house will gulp N4,000,000,000; and N2,500,000,000, respectively.

Others include:

Computerisation and digtalisation of the State House N200,000,000
Construction of office complex within State House N4,000,000.000
Renovation of Dodan barracks — official residence of Mr. president N4,000,000,000
Renovation of official quarters of vice-president in Lagos, N3,000,000,000
Acquisition, renovation and rehabilitation of 2Nos. EFCC forfeited quarters as State House at Mabushi, N1,500,000.000.
Acquisition, renovation and rehabilitation of 2nos. EFCC forfeited quarters as State House at Guzape, N1,500,000,000.
Purchase of official vehicles for the office of the first lady, N1,500,000.000.
FEDERAL MINISTRY OF WORKS

The federal government also budgeted N300,000,000,000 for the ministry of works. Out of the sum, N15,000,000.000 will be used for the urgent comprehensive repairs/rehabilitation of the Third Mainland Bridge and others.

The government said N12,876,566,404 will be spent as a 50 percent part payment for urgent comprehensive work on other critical bridges.

In addition, N11,400,024,608 was earmarked as an “outstanding sum owed to contractor for certified works on Eko and Marine Bridges”.

Ayo Adebanjo: I defended Tinubu on certificate controversy until new facts emerged

Ayo Adebanjo, leader of Afenifere, the Yoruba socio-cultural group, says Nigerians should be ashamed to have a president with a certificate “baggage”.

Adebanjo spoke in a 41-minute interview published by PUNCH on Sunday.

During the presidential election tribunal, Atiku Abubakar, flagbearer of the Peoples Democratic Party (PDP) in the election, had contested the authenticity of the Chicago State University (CSU) certificate presented to the Independent National Electoral Commission (INEC) by President Bola Tinubu.

Tinubu had said he lost his original certificates and presented a replacement of his CSU diploma to INEC for the 2023 presidential election.

Following a court order, the university later released Tinubu’s academic records, saying his replacement certificate matched its format.

But the Afenifere leader said without technicalities, no honest person can defend Tinubu on the matter.

“There is no truth in what he says. That’s the unfortunate thing. I feel sorry for the country, particularly Tinubu defenders, can they be proud? Whether true or not, why is it him? When they finally produced the record from the university, it was even more damaging,” Adebanjo said.

“In this Tinubu saga, you presented the certificate from the university, now they are trying to change (the conversation) to his attendance at the university.

“How many people attended the university and never completed it or even dropped out? You said you attended and have the certificate, and the registrar said they don’t know about the certificate. What more do you want?

“This is what makes me sad in this country and those still saying something in defence of this ugly situation where we should cover our face as Nigerians that the man we produced to be our president has his baggage. I am concerned.”

Adebanjo said he had defended Tinubu on the certificate scandal in the past because of the little knowledge he had on the matter.

“Mind you, I should be one of those who should be proud that Tinubu is the president of this country because I made him the governor of Lagos state. When this certificate saga started, I was the one who defended him. I defended him from the fact I saw at that time. But when some facts are now coming up, I folded my arms,” he said.

“Forget technicalities, do the substantial justice. Can any honest person, in view of the exposure from the university, say he (Tinubu) got that certificate from the university?”

COMMUNIQUE ISSUED AT THE END OF THE MEETING OF PDP GOVERNORS’ FORUM HELD IN ABUJA ON TUESDAY 31ST OCTOBER, 2023.

The PDP Governors’ Forum held a meeting under the leadership of H.E Governor Bala Mohammed, CON, at the Oyo State Governor’s Lodge in Abuja on Tuesday, 31st October, 2023.

2. The Forum deliberated on issues of concern to the Forum, the Peoples Democratic Party (PDP), and the nation and reached the following conclusions:

i. The meeting noted the recent judgment of the Supreme Court on the 2023 presidential election and believes that this brings an end to the presidential election cycle as there must be an end to litigation. As a forum, we believe and re-state our faith and confidence in the judiciary to do justice in political and other cases before the courts. We are concerned that while the Supreme Court has laid down precedents on pre-election issues, PDP candidates in Plateau State are being disqualified on the same grounds. We urge the judiciary at the apex level to ensure that our jurisprudence is not distorted. We remain vigilant in the struggle for democracy and good governance in the country.

ii. The meeting vowed to reposition and strengthen PDP as a viable opposition political party ready and willing to play its role as the vanguard of the Nigerian people for democracy, good governance, and accountability.

iii. The PDP governors were alarmed at the recent developments in Rivers State and welcomed the intervention of Mr. President to bring the crises to an end. The meeting urged all parties to the Rivers State crises to sheath their sword and resort to peaceful means of resolution. The Forum further offers its platform for a quick and just containment of the issues involved.

iv. On the national economy, the meeting urgently requested the patriotic intervention of the federal government to stabilize the Naira, control inflation, stem the unemployment crises, and bring more succor to Nigerians

3. The PDP Governors congratulated the host, His Excellency, Governor Seyi Makinde, for his hospitality in hosting the meeting.
