Despite the courthouse being established in the 1890s, the first hearing wasn't until 1904!

I will post soon the details as to whom fought hard to have the District Court brought from Palmerston North and Wellington to finally be local in Pahiatua!

I had to have a wee giggle at Judge Ward's insight into Pahiatua in 1904, shared with the local Telegraph:

District Judge Ward said at Pahiatua: “I was informed before accepting the appointment of Judge in this district, that there would be nothing to do here. But Pahiatua is indeed a lively place. Milk and mosquitos appear to he the chief products of the country. The mosquitos stimulate the people to litigation, and the milk enables the litigants to pay costs, and thus all things work together for good, and the legal profession are enabled to earn an honest living."

It's good to see that, despite the passing of more than a century, Pahiatua has remained as resilient and spirited as ever. While the district has changed in many ways since Judge Ward's time, his observations certainly provide an entertaining snapshot of local life and character in the early 1900s.

In 1904, District Judge C. D. R. Ward (Charles Douglas Robert Ward) held jurisdiction over the Pahiatua District Court circuit. He managed extensive sittings across both the North and South Islands, presiding over local civil, bankruptcy, and criminal matters before retiring later that year after 42 years on the bench.

On 1 June 1857, 18 months after his election to Parliament, Ward was appointed chairman of the Courts of Sessions of the Peace for the Province of Wellington and presiding judge of the Magistrate's Courts for Hawke's Bay, Wairarapa and Wanganui. On 1 January 1864, he was given a two-year appointment as Resident Magistrate at Wellington, the capital. The remainder of his career was appointments as District Judge for a series of individual provinces until, after more than 49 years service, his retirement in March 1906, aged almost 79, on a pension of £800 per annum. https://en.wikipedia.org/wiki/Dudley_Ward_(judge)

Pahiatua, May l9 1904

At a sitting of the District Court, in the case of Dampney Bros, versus McAllistar, an action for slander, council on defendant's behalf apologised, and agreed to pay costs, which was accepted. Appeals by Farrelly and Gregory against the decision of the Stipendiary Magistrate in fining them for cutting a dam were allowed. Within costs. This case of Fisk v. Farreily, a claim for £490 alleged damage to plaintiffs land through defendant cutting a dam and thus flooding plaintiff's property is now being heard lasted all Wednesday and Thursday.

The case of Fisk v, Farrelly aud Gregory, a claim for .£490 for alleged damage to the plaintiff’s land, through defendants damaging a dam, was concluded in the Pahiatua District Court on Friday night after occupying the attention of the Court for three days. The jury returned a verdict for the defendants, which carries costs.

The first sitting of the Pahiatua Courthouse in 1904 was presided over by a well-known Judge from Otago gold fields;

PAHIATUA DISTRICT COURT. (By Telegraph — Press Association). Pahiatua, This Day The first sitting of the District Court will be held here, to-morrow, before His Honor Judge Ward. There is no criminal business. Three important civil cases are set down, including a claim for £200 for alleged slander.

Plaintiff is Miss Fogarty, barmaid, and the defendants are Mr T. Cotter and wife, of the Club Hotel. A man named Robertson, some weeks ago, alleged that he had been "gone through " at the Club Hotel. The barmaid alleges that Mr and Mrs Cotter accused her of being connected with the disappearance of the money.

A SLANDER ACTION.

[Per Press Association.] PAHIATUA, May 18. In the District Court, in a slander case*
Miss Fogarty, barmaid, v. Cotter, a publican, arising out of the loss of money by a lodger in the defendant’s hotel, the jury found for the plaintiff, awarding her £5 and costs.
(In a similar action against Mrs Cotter the plaintiff was non-suited with costs.)
