PAY RULES FOR REGULAR HOLIDAYS AND SPECIAL (NON-WORKING) DAY
Regional Director Atty. Sixto Popoy Rodriguez, Jr. reminds employers to observe payment of wages for the regular holidays on April 2 (Maundy Thursday), April 3 (Good Friday), and April 9 (Araw ng Kagitingan) and for the special (non-working) day on April 4, 2026 (Black Saturday) as per Labor Advisory No. 5, series of 2026.
Pursuant to Proclamation 1006, series of 2025, the following pay rules shall apply to ensure workers of their rightful wages for regular holidays and special non-working day:
๐๐๐ผ๐ฟ ๐ฟ๐ฒ๐ด๐๐น๐ฎ๐ฟ ๐ต๐ผ๐น๐ถ๐ฑ๐ฎ๐๐ ๐๐ฝ๐ฟ๐ถ๐น ๐ฎ,๐ฏ ๐ฎ๐ป๐ฑ ๐ต, the advisory states that employees who do not work are entitled to 100% of their daily wage, provided they report to work or are on approved leave of absence on the workday immediately preceding the regular holiday (๐๐ฎ๐๐ถ๐ฐ ๐๐ฎ๐ด๐ฒ ๐
๐ญ๐ฌ๐ฌ%).
๐When the day immediately preceding the regular holiday is a non-working day in the establishment or the scheduled rest day of the employees, they shall be entitled to holiday pay if they worked or were on approved leave of absence with pay on the day immediately preceding the non-working day or rest day.
๐Employees who render work during the regular holiday shall receive 200% of their daily wage for the first eight hours (๐ฏ๐ฎ๐๐ถ๐ฐ ๐๐ฎ๐ด๐ฒ ๐
๐ฎ๐ฌ๐ฌ%).
๐Should the employee perform work beyond eight hours, they shall be paid an additional 30% of the hourly rate for that day (๐๐ผ๐๐ฟ๐น๐ ๐ฟ๐ฎ๐๐ฒ ๐ผ๐ณ ๐๐ต๐ฒ ๐ฏ๐ฎ๐๐ถ๐ฐ ๐๐ฎ๐ด๐ฒ ๐

๐If the regular holiday falls on the employeeโs rest day and work is rendered, the employee shall be paid an additional 30% of the 200% basic wage (๐๐ฎ๐๐ถ๐ฐ ๐๐ฎ๐ด๐ฒ ๐
๐ฎ๐ฌ๐ฌ% ๐
๐ญ๐ฏ๐ฌ%). Overtime work under the same conditions shall likewise be compensated with an additional 30% of the hourly rate on said day (๐๐จ๐ฎ๐ซ๐ฅ๐ฒ ๐ซ๐๐ญ๐ ๐จ๐ ๐ญ๐ก๐ ๐๐๐ฌ๐ข๐ ๐ฐ๐๐ ๐ ๐ฑ ๐๐๐% ๐ฑ ๐๐๐% ๐ฑ ๐๐๐% ๐ฑ ๐ง๐ฎ๐ฆ๐๐๐ซ ๐จ๐ ๐ก๐จ๐ฎ๐ซ๐ฌ ๐ฐ๐จ๐ซ๐ค๐๐).

๐จ๐ซ ๐๐ฉ๐ซ๐ข๐ฅ ๐ (๐๐ฅ๐๐๐ค ๐๐๐ญ๐ฎ๐ซ๐๐๐ฒ), declared a special (non-working) day, the โno work, no payโ principle shall apply unless a favorable company policy, practice, or collective bargaining agreement (CBA) grants payment on a special day.
๐If an employee reports for work during the special day, the employee is entitled to an additional 30% of their basic wage for the first eight hours (๐๐๐ฌ๐ข๐ ๐ฐ๐๐ ๐ ๐ฑ ๐๐๐%).
๐Overtime work shall be paid an additional 30% of the hourly rate on said day (Hourly rate of the ๐๐๐ฌ๐ข๐ ๐ฐ๐๐ ๐ ๐ฑ ๐๐๐%x130% x number of hours worked).
๐Should the employee perform work on the special day that also falls on the employeeโs rest day, the employer shall pay an additional 50% of the basic wage for the first eight hours of work (๐๐๐ฌ๐ข๐ ๐ฐ๐๐ ๐ ๐ฑ ๐๐๐%). Overtime work under the same condition shall likewise be compensated with an additional 30% of the hourly rate on said day (๐๐ค๐ช๐ง๐ก๐ฎ ๐ง๐๐ฉ๐ ๐ค๐ ๐ฉ๐๐ ๐๐๐จ๐๐ ๐ฌ๐๐๐ ๐ญ 150% ๐ญ 130% ๐ญ ๐ฃ๐ช๐ข๐๐๐ง ๐ค๐ ๐๐ค๐ช๐ง๐จ ๐ฌ๐ค๐ง๐ ๐๐).
