ORDINANCE NO. 98-012
AN ORDINANCE REQUIRING THE USE OF CRASH HELMET BY MOTORCYCLE DRIVERS
AND RIDERS THEREON IN THE CITY OF NAGA AND PRESCRIBING PENALTIES FOR
VIOLATION THEREOF:

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:
SECTION 1. - DEFINITION OF TERMS. - As used in this ordinance:
a. CRASH HELMET - shall refer to any padded metal or plastic for
motorcycling, flying bob sleighing, etc., word to protect the head in a
crash or impact.
SECTION 2. - It is hereby required of all motorcycle drivers thereon to wear crash
helmet while driving said motor vehicle in the City of Naga.
SECTION 3. - It is hereby required of all riders of any motorcycle to wear crash helmet
while riding said vehicle.
SECTION 4. - PENALTY - Any person or persons found guilty of violating any of the
provisions of this Ordinance shall be penalized as follows:
First Offense A fine of Three Hundred (P300.00) Pesos
Second Offense A fine of Five Hundred (P500.00) Pesos
Third Offense A fine of One Thousand (P1,000.00) Pesos
Any violator may at his/her option, avail of the administrative fine as follows:
First Offense 25% of fine above-cited
Second Offense 50% of fine above-cited
third Offense 75% of fine above-cited
SECTION 5. - EFFECTIVITY. - This ordinance shall take effect upon its approval and
publication in a local newspaper of general circulation.
ENACTED : January 28, 1998. WE HEREBY CERTIFY to the correctness of the foregoing ordinance.
