We are pleased to announce that following its approval by the Government Procurement Policy Board (GPPB) on February 4, 2025, the Implementing Rules and Regulations (IRR) of Republic Act No. 12009, or the New Government Procurement Act (NGPA), has been published in the Official Gazette today, February 10, 2025.
The IRR enhances the NGPA for effective implementation by addressing key areas to create a more streamlined, responsive, and modernized procurement process. The improvements include:
Strategic Procurement Planning โ Requiring Procuring Entities to conduct market scoping, assess supplier capabilities, and align procurement strategies with industry conditions to optimize resource allocation and ensure effective contract implementation.
New Procurement Modalities โ Including Competitive Dialogue, Direct Acquisition, Unsolicited Offer with Bid Matching, Direct Sales, and Direct Procurement for Science, Technology, and Innovation, which allow Procuring Entities to adopt fit-for-purpose approaches tailored to their specific needs.
Integration of Electronic Government Procurement Systems โ Enabling real-time data sharing across agencies to improve transparency, efficiency, and collaboration.
Simplification of Bid Eligibility Requirements โ Consolidating these into the PhilGEPS Certificate of Platinum Membership, reducing administrative burdens on bidders and ensuring a more efficient bid qualification process.
These enhancements aim to achieve the NGPA's objectives of modernizing government procurement, fostering transparency and fair competition, and improving procurement outcomes in alignment with national development goals.
It is noteworthy that the GPPB has adopted a modular approach in developing the IRR. This approach divides the formulation process into manageable sections, ensuring that each module is well-developed, thoroughly reviewed, and provides comprehensive guidelines for specific procurement areas. For illustration, the modular approach has enabled the prioritization of above high-impact provisions in the IRR, such on the areas of strategic procurement planning, new procurement modalities, and contract implementation and management, while ensuring that remaining components can be refined through subsequent guidelines. This strategy ensures that the IRR is both practical and responsive to the evolving needs of government procurement.
Moreover, specific provisions still require additional guidelines, such as those for Negotiated Procurement for Defense Cooperation Agreements and Defense-related Inventory Items for law enforcement agencies, livestreaming procurement activities, and the evaluation of contractor performance using standardized metrics. These guidelines will be issued by the GPPB to further enhance clarity, consistency, and transparency across all Procuring Entities.
