Sheriff Manuel Gonzales III will be assigning additional deputies to specifically respond to calls of criminal violations to the Election Code on Friday, October 30th, Saturday, October 31st, and Tuesday, November 3rd, 2020. Deputies assigned to specific districts historically respond to any reports of violations to the Election Code and have throughout this election cycle. The additional deputies assigned for this weekend and on Election Day will provide a faster response time if called upon and prevent other deputies from being pulled away from emergency calls for service in their assigned areas.

Violators of the Election Code can face petty misdemeanor charges or 4th-degree felony charges. Petty misdemeanor charges include, Obstructing the Polling Place, Disturbing the Polling Place, and Electioneering too Close to a Polling Place. 4th-degree felony charges include Intimidation and False Voting. BCSO will refer any Election Code violation cases to the District Attorney’s Office for review and prosecution.

The Sheriff’s Office serves a vital role in upholding the Election Code and preventing any unlawful interference with the election. Election Code relies on law enforcement for essential election functions and responds to criminal violations of the Code. Also, part of the responsibility of the presiding judge and the election judge is maintaining order within the polling location, they “may call upon any peace officer to assist.” That assistance may include “standing outside the polling entrance and controlling the admission of voters at the polling location.” The Code places a mandatory duty on peace officers to assist “when so requested” by the presiding or election judge. In addition, upon request, peace officers “may enter a polling location to observe the conduct of the election” but cannot interfere in any way except to assist in maintaining order and controlling access as requested by the presiding or election judge.

The Sheriff’s Office also provides the Bernalillo County voting warehouse’s physical site security and security to transport ballot boxes from various polling locations back to the voting warehouse during every election cycle. Our involvement includes a physical presence to ensure only certified and authorized poll workers enter and access the secure voting warehouse. Security at the voting warehouse has been provided by uniformed deputies 24 hours a day since October 19th and will continue through November 16th.

County Clerk Linda Stover stated, “The Sheriff’s Office has my full trust and support as they work tirelessly to protect the integrity of the Bernalillo County ballots. We appreciate the excellent working relationship we have with law enforcement in our community and their proactive approach to election security when called upon by my office.”

Sheriff Manuel Gonzales III stated, “The right to vote is a constitutional right, and we want to ensure all registered voters in New Mexico get to cast their ballots safely. As the Sheriff, I will help secure election integrity and ballot secrecy while guarding against any election process abuse. We are thankful for great partnerships throughout the county to ensure a safe and secure 2020 election.”

Linda Stover of the Bernalillo County Clerk's Office confirms that early voting convenience centers are open and operating on a regular schedule today.

“Thanks to dedicated poll officials and staff, Bernalillo County early voting convenience centers are open today and on a regular schedule,” says Clerk Linda Stover. “At last report, 548 voters had already cast a ballot. Please check road conditions in your area and if it is safe, vote in-person or hand deliver your absentee ballot.”
Most of the 17 early voting convenience centers are open until 7 p.m.

Linda, once again, great job. I was at UNM today (Nov. 5) and saw absolutely no signs outside of the Student Union Building, a voting location, that there was voting inside. I looked outside each entrance. I went inside and inquired at an info desk and was told voting was upstairs. Nowhere in the downstairs lobby of the SUB was there any information that there was voting upstairs. Why is this? Thanks.
