GPS Records

Today Bernalillo County District Attorney Raúl Torrez announced that he has filed a lawsuit under the Inspection of Public Records Act (IPRA) to compel the Second Judicial District Court to produce the pretrial GPS data of two dangerous, repeat defendants. The public’s right to know this information and the need for transparency can be no more critical than in the context of public safety.

Yesterday evening a jury found Luis Chaparro guilty of shooting at or from a motor vehicle and criminal damage to property. The trial lasted four days and Chaparro could face up to four years in prison for these convictions. Before this case went to trial we filed a preventative detention motion which was denied. Despite Chaparro's conditions of release, he was then charged with first degree murder and aggravated battery only a few months after this case. The first degree murder case is currently pending trial. While we share the frustration and disappointment that many in our community have over today’s acquittal of Kyle Rittenhouse in Kenosha, Wisconsin, we remain committed to the rule of law and respect the jury’s verdict. The outcome of this case should not be used by anyone to engage in political violence nor as a license for vigilantism.

Our office remains steadfast in its commitment to hold the line against armed extremists and anyone who feels empowered to assume the role of the police or the military.

#RittenhouseTrial

A jury in Kenosha, Wisconsin, acquitted Kyle Rittenhouse on five felony counts on Friday, clearing him of criminal culpability in the shooting of three men, two of them fatally, last year. https://nyti.ms/3kSz2uA

Opinion | Prosecutors must police the police

"One way prosecutors can effectively fulfill their ethical obligations and hold officers accountable is by keeping office-wide databases of police officers whose credibility has been questioned. A small but growing number of prosecutors — including those in Ramsey County, Minnesota, and Bernalillo County, New Mexico — are creating police disclosure lists (which have also been called “Brady lists,” “Giglio lists,” or “do-not-call lists”) that help prosecutors demonstrate to their communities that they are independent of the police and are taking steps to ensure the integrity of their cases by disclosing the problematic behavior to the defense."

Click the link below to read the full NBC News opinion piece written by John Choi, county attorney for Ramsey County, Minnesota, Alissa Marque Heydari, deputy director of the Institute for Innovation in Prosecution at John Jay College, and #BerncoDA Raúl Torrez.

We need to know which police officers have engaged in misconduct to hold them accountable and prevent them from tainting trials.
