Georgia Cannabis Law Update #3: Age Requirements and Signage Requirements for Retail License Holders

1. Purchasers of Legal Cannabis Products MUST BE 21 YEARS OF AGE OR OLDER
2. If the SELLER is within REASONABLE DOUBT of the PURCHASER’S AGE, you MUST ASK FOR IDENTIFICATION
3. EMPLOYEES under the age of 21 years of age ARE PERMITTED to be involved in the handling, dispensing, selling, serving ANY legal consumable Cannabis/H**p product
4. ANY business in which Legal Cannabis/H**p products are being sold must post conspicuous signs to notify the public (front door, throughout the business/restaurant). These signs MUST be printed in all CAPITAL LETTERS at least ½ (0.5) inch height and MUST READ/SAY: SALE OF CONSUMABLE H**P PRODUCTS TO INDIVIDUALS UNDER 21 YEARS OF AGE IS PROHIBITED BY LAW
5. Not having the sign(s) visible or legible or letters too small – penalty for noncompliance is a MISDMEANOR.

Georgia Cannabis Law Update #3: Restaurant Edition 09/26/2024

Georgia Restaurant owners BEWARE.

SB494 affects you in SEVERAL more WORSE ways when it comes to Cannabis infused Beverages/Drinks.

If you don't know how to legally serve these products and lack the proper paperwork which MUST be readily available at all times, you WILL lose your alcohol license, perhaps worse.

Update on Georgia Cannabis Law #2:

There was an open forum at the Department of Agriculture in Atlanta, Georgia on September 9, 2024. The room was full and spilled over into the hallway. At this event, many people in attendance heard The Department of Agriculture state they were giving us an additional 90 days to become compliant past October 1, 2024.

This unofficial-official extension was potentially for two reasons: one is to get rid of any remaining inventory before applying for the new 4th Amendment Violating Permit to SELL Cannabis; two is because there are still THOUSANDS of businesses throughout the State of Georgia who are UNAWARE of these changes made in a bill that was signed in the middle of the night.

There are "rumors" that in some Georgia counties, the local police departments are gearing up to conduct raids on these shops beginning October 1, 2024.

This is probably why the Department of Agriculture has admitted at the open forum that they know they are going to get the HELL sued out of them.

The Georgia Department of Agriculture is 100% FULLY AWARE of the barrage of lawsuits (both Federal and State) that are coming their way beginning October 1, 2024.

Update on Georgia Ca**abis Law as of 09/25/2024 Part I:
1. Milligrams for drinks and beverages are to follow Trump's Cannabis Law/2018 Farm Bill Ratio, NO CHANGES
2. Food products/Edibles: Milligrams per serving are NOT capped at 5mg per serving/150mg packaged total milligrams. Milligrams still following Trump's Cannabis Law/2018 Farm Bill Ratio. The ONLY change to Food products/Edibles: SEE NUMBER 3 BELOW.
3. NEW Food product definitions regarding edibles imposed with SB494 - YOU CANNOT under ANY CIRCUMSTANCES put ANY CANABINOID in ANY food product other than gummies. If it is a food product that is NOT a gummy - it is ILLEGAL. Examples: Honey, Cakes, Cookies, Cereal bars, Chocolates, HONEY.... ANYTHING OTHER THAN A GUMMY IS ILLEGAL.
4. Packaging laws - Absolutely NO PACKAGING that resembles ANY food product readily available, absolutely cannot be appealing to CHILDREN. Child Proof Packaging is MANDATORY. Example: packaging that shows what looks like popular candies, cookies, etc are now illegal.
