While I understand the frustration of having to deal with frivolous actions (as I have *plenty* of experience dealing with municipalities that violate our explicit preemption law and precedent - and for which, the courts have YET to issue attorney fees and costs in relation to), a court, of *any* level, should *never* consider issuing an injunction against any person or entity, precluding them from instituting an action or appealing a decision, as, especially a pro se litigant, has no ability to determine what a court *may* consider to be frivolous. The Judiciary in Pennsylvania has become exceeding legislative in its decisions and has invited litigants to ask it to "legislate from the bench." Be careful for which you ask, as you just might get it...

This morning, a split Commonwealth Court ruled that for-profit abortion providers have a "constitutionally-mandated ability to bill Pennsylvania taxpayers to pay for abortions on-demand sought by Medical Assistance recipients...without factfinding, without even an answer to Abortion Providers’ Petition for Review" through a "judicial fiat," as declared by Judge McCullough's dissent, which was joined by Judges Covey and Wallace (and with Judge Wallace writing her own dissent).

Woohoo! Going to be back in front of my favorite court for a lil oral argument regarding the constitutionality of the regulations promulgated and enforced (as well as those unwritten regulations that the PSP enforces) related to Act 235!

For those who are unaware, oral argument before the Commonwealth Court is extremely rare, as oral argument is only scheduled if the court so directs. That being said, I cannot remember the last case that I litigated before the Commonwealth Court (in its trial or appellate capacity), where I didn't have oral argument. I think they just love seeing me there 😁

If anyone is interested in my 3 judge panel oral argument before the Third Circuit from several months ago, regarding whether the Government can prohibit, in perpetuity, the right to purchase, possess, and utilized fi****ms and ammunition as a result of a single DUI, where no was injured nor any property damage occurred, you can find it at the link below.

After argument, I believe because of the issues I raised, the Third Circuit decided to consider the case en banc (meaning before the entire court - i.e. before all the judges), as I suspect the Court is considering adopting my argument and to do so, given all the panel decisions, it needs to issue an en banc decision!

The Pink Elephant in the room that I spoke about, at length, on the campaign trail. Independents (i.e. non-Republicans, non-Democrats) are growing at an exponential rate in Pennsylvania. And if you want to see how tone-deaf the PaGOP is, read the comment from Vice Chair Comfort. And yet, they (allegedly) scratch their head - every election cycle - when they anoint....err endorse, in the primary their chosen candidates, and then lose in the general. This year will be no different. It's time for change. It's time for new leadership and a new vision, that actually thinks outside the box and implements it. As I believe the only Republican candidate in recent history (or perhaps ever) that was endorsed by several Independent Parties during my primary candidacy, the right candidates can get it done, but the Old Guard/Establishment of the PaGOP won't have that...

And for those who disagree, look at this second article in relation to my home-county, Berks. Republicans, *by a hair*, out number Democrats. So, Republicans should win, right? Nope, we just saw losses across the board in the '25 General by Republican candidates. Even school board and local government candidates got hosed! But how could that be? VP Comfort says all that matters is if the Republicans outnumber the Democrats. Well, the numbers don't lie.
