While this is all well and good, it is still very important to carry as much UM/UIM Coverage as you possibly can to protect yourself from those who are not insured or who do not have enough insurance coverage on their vehicles. UM/UIM Coverage: What is it? How can it help you?

What happens if you are involved in a wreck and the driver who hit you doesn't have enough liability coverage? Or, even worse, none at all?

I have handled many cases recently where this scenario has adversely affected my clients. So, I decided to write something about “UM” and “UIM” coverages to explain how they work, and why it is important to have as much of this type of coverage as possible.

Uninsured (“UM”) and underinsured (“UIM”) motorist coverages exist to protect you from irresponsible drivers.

Let’s say you get into a car accident, but it wasn't your fault. In most circumstances, you would file a claim with the at-fault driver's car insurance company, get your car repaired, and recoup compensation for any lost wages and medical expenses with no out-of-pocket expenses to you.

But in some cases, the driver who sideswiped you does not have car insurance, or at least doesn't have enough of it. This happens more than you might think. The minimum requirement for liability insurance in Alabama is $25,000.00. With medical bills being usually very high, that $25,000.00 can be used up and exceeded quickly. That is when your personal UM/UIM coverage comes it. These are coverages that you purchase to protect yourself in case someone causes a wreck with you and does not have enough insurance, or none at all.

What is the difference between UM and UIM insurance?
Uninsured (“UM”) motorist coverage protects you if you're in an accident with an at-fault driver who doesn't carry liability insurance.

Underinsured (“UIM”) motorist coverage, on the other hand, steps in when you're in an accident with an at-fault driver whose liability limits are too low to cover the damage or medical expenses. The at-fault driver's insurance will typically pay for all damages up to the policy limits, and then your underinsured motorist coverage will cover the excess amount up to the limits you select.

When you are in an accident and you don't have uninsured or underinsured motorist coverage, you'll need to pay out-of-pocket for damages and medical expenses not covered by the other driver. This is why it is very important to carry as much UM/UIM coverage as possible.

I always counsel my clients to be sure they have as much of these coverages as possible, but sometimes that advice comes too late. They have already become a victim of a nasty car wreck, and become a victim once again because the at-fault party was not properly insured and they are left holding the rest of the bill because they did not know how UM/UIM coverage could protect them.

If you are unsure of how much uninsured or underinsured motorist coverage you have currently, a quick phone call to your agent will be in order. Having enough coverage can mean the difference between peace of mind, or being left holding the bag.

A word and personal view of the developments from the Birmingham city council meeting tonight regarding Über:

Two of the major sticking points for the city on the proposed legislation (ordinance) which would control ride sharing services like Über, Lyft, etc., has been background checks for drivers and proper insurance coverage for accidents. Certainly, public safety should be a top priority for elected officials in any matter. But, the city must be willing to take steps to meet at arms length with these companies to form an agreement on these issues. I think both sides came a long way to make that happen tonight.

Adequate background checks for drivers are needed for passenger safety, no question. From what I know about Über's standard background checks, I would rather stricter standards be in place. I believe Über would be amenable to this to get into the Birmingham market.

As it relates to insurance, I represent people every day who have been injured (some seriously and horrifically) in automobile wrecks. Most of the time, the amount of insurance available from the negligent person's insurance policy is not adequate to properly cover my client's injuries, to make them whole, and put them in a position they were in prior to the wreck. I believe it is imperative that adequate insurance coverage be in place on cars operated by Über drivers, so that passengers and other drivers can and will be adequately covered should a wreck and injuries be caused by an Über driver. No question.

Now that the city is in a posture to deal with Über meaningfully, I believe they will come together to craft meaningful and good legislation built on compromise to the benefit of all.

Stay patient a little while longer. Über and other ride sharing services will be here before you know it.
