Now it's starting to hit home to more residents: the Texas grid operator, ERCOT says it can't be sued. Why? Because of SOVEREIGN IMMUNITY.

We've been preaching about this for awhile now.

Even as lawsuits emerge after Texas' winter storm, the power grid operator says it wouldn't benefit anyone to sue them.

"It all started a few years back when the entity responsible for getting water to Fort Worth, the TRWD - Tarrant Regional Water District, let it be known that it intended to take part of Bennett’s ranch and lay a pipe across it. The water district sued Bennett in an attempt to get the land. The case made its way to the Texas Supreme Court, where Bennett won on a procedural matter before being bounced back to a district court in Athens, where it now sits."

My, oh, my. Does this sound familiar? And this isn't even the North Texas Municipal Water District! It shows how widespread these issues are!

How is Monty Bennett working to keep a pipeline off his land? With endangered animals, a cemetery, and a whole lot of money.

Well, here we go again. Below is the motion for a new trial filed with the Fifth District Appellate Court in Dallas. Stand by for the brief, which will be forthcoming. The tables have turned and it seems we now have ALL the leverage (not that we were at a disadvantage before.) :)

Governmental immunity affects every Texan, whether you know it or not.

The light bulb came on recently for a friend. Paraphrasing here, he said "Let's say I am in an accident and knocked unconscious. The ambulance takes me to a state-run hospital and they make a mistake. Because of governmental immunity, I or my family will have no way of receiving compensation?"

That's exactly right. Governmental immunity protects hospitals, government agencies and those agencies who claim to be "government" (but really are not.)

The page has highlighted the landowner fight here in Collin County, but this is EVERY TEXAN'S PROBLEM. Sorry to shout, but from no-knock raids to landowner fights, YOU could be a target and will have zero recourse to fight it.

Let's change that.

After numerous conversations with Representative Noble's Chief of Staff Suzanne Bowers, it is clear Representative Candy Noble holds the responsibility to represent her constituents as paramount. She believes in landowner rights, due process, and eliminating governmental abuse.

As a current member of the Texas House General Investigating Committee, Representative Noble and the committee have the obligation to conduct investigations on any agency or subdivision of government within the state on matters necessary for the welfare and protection of state citizens. As such, an investigation in to the North Texas Municipal Water Districts ongoing practices to victimize and exploit Texas landowners is more than warranted. Please join us in supporting Representative Noble, and her efforts to eliminate governmental abuse towards Texas landowners.
