Specifically, you have used the Gernon twins’ real names, images, story, and family tragedy as a “tragedy lure” to drive engagement and traffic to a paid company advertisement for HotelsApp, accessible via the link:

Unauthorized commercial exploitation of minors;
Intentional infliction of emotional distress upon the surviving family members;
Potential false light invasion of privacy and misappropriation of likeness for profit.
The surviving twin brother remains a minor child, and any continued exploitation of this tragedy for advertising purposes is especially egregious and harmful.DEMANDYou and all persons or entities acting in concert with you are hereby demanded to immediately and permanently:Cease all use of the Gernon twins’ names, images, likenesses, story, or any reference to the 2021 tragedy in any advertisement, video, post, link, or promotional material whatsoever.
Remove all content (including the linked HotelsApp advertisement and any derivative or reposted versions) from every platform, website, social media account, or other medium where it appears.
Delete or disable the specific link https://hotelsapp.onelink.me/fSyN/w9x4zjbp (and any similar redirect or tracking links) in any context that references the Gernon family or twins.
Provide written confirmation (via email to [email protected]) within 10 calendar days of receipt of this letter that all such content has been fully removed and will never be republished.
CONSEQUENCES OF NON-COMPLIANCEIf you fail to comply fully within the 10-day deadline, the Cash Gernon family, through Connie Ward and Sharleen Angelastro, will pursue all available legal remedies without further notice, including but not limited to: Filing a civil lawsuit in the appropriate court seeking injunctive relief, compensatory and punitive damages, and attorneys’ fees and costs;
Claims for violation of the right of publicity, invasion of privacy, intentional infliction of emotional distress, and any applicable state or federal laws protecting minors from commercial exploitation;
Reporting the matter to relevant advertising platforms and regulatory bodies;
Seeking any other relief the court deems just and proper, which may include substantial monetary awards.
