Patriot Act requires that a lender have proof of a physical address on file, but does not require that the physical address be the mailing address or that utility bills be addressed to that physical address. I contend the application of the physical address provision of Patriot Act by SoFi and potentially other lenders violates both federal and state fair credit requirements and that their application of the address requirements is potentially unconstitutional in application. I’m trying to survey the breadth of the problem before deciding how I need to address it. As a 30 year federal litigator now happily living on the poverty stricken Hopi Reservation in Northern Arizona I know I have an obligation to address the issue in Court, but I don’t know whether there are others who would like to join in. Let me know if you have had the same problem and are interested in joining.


Have you or one of your friends or clients had a loan denied for alleged lack of an adequate physical address under Patriot Act? I am strongly considering a lawsuit specifically against SoFi but also possibly other lenders for their denial of loan applications for lack of proof of physical address. I contend Patriot Act’s requirements are being misapplied in a manner which renders them unconstitutional.


Law Offices of Karen H Pennington purchased the RV that is the useless unusable pile of $65,000+ junk as its mobile office sight unseen in Utah based on interstate internet advertising because it is already set up and usable as an office inside. We are not the lawyers in the case at this point, we are the victims. If Utah RV dealers and allegedly reputable national name brand diesel brand Cummins Diesel treat an out of state law office purchaser in this manner, I believe it to be incumbent on the law office to warn consumers of the risk of purchasing an RV or having it repaired in Utah.


My office purchased the RV that is the useless pile of $65,000.00+ junk as a mobile office sight unseen in Utah because it is already set up and usable as an office. It was being utilized by Sr. Associate Judge Jeremy Brave-Heart as a temporary residence for the last two weeks. It was embarrassing to have him witness the expensive fiasco that is the mobile office of Law Offices of Karen H. Pennington. I’m not the lawyer in the case at this point, I’m the victim.


Beware Cummins Diesel Sales and Service in Salt Lake City, Utah. I posted two years ago about the RV we bought in Salt Lake City that was a complete lemon with zero recourse under Utah law. We ended up paying Cummins Sales and Service in Salt Lake City $30,000 for a complete engine rebuild. It took them almost a year and we have never even gotten 2000 miles out of the engine. It breaks down every 20 to 50 miles and they have not honored their warranty. We have just broken down 5 times in the 60 miles between Winslow and Flagstaff Arizona. I wouldn’t recommend Cummins Sales and Service to my worst enemy.


WARNING: Do not ever purchase a used vehicle in Utah. There is no lemon law or other consumer protection. I paid $32,000 cash to RV Sales, Inc., 12715 Minuteman Dr, Draper, UT 84020. I paid them another $1200 cash to service the engine before I picked it up. The engine lasted 103 miles. The motor home blew its engine in Price, UT. The estimate to replace the engine is $$23,000$$. Yes, twenty-three thousand dollars and the seller won't even talk to me. BEWARE consumer fraud in Utah. There are no protections. It looks like I'm going to have to hire a lawyer to sue them in federal court.

Good things can happen for detained clients when the government screws up and doesn't own up to it in court. ICE released my Honduran client to get himself back to Philadelphia without having to go back to court on a bond hearing. The Immigration Judge vacated a previously approved ICE venue change motion last week because ICE served the venue motion on my client directly rather than on his attorney up in Philadelphia who was representing him in immigration court. Woo, hoo!!!


I am sad and frustrated. I just completed a reasonable fear interview with a Guatemalan client who was beaten so badly by the Guatemalan Army and national police that he was left for dead in front of a hospital and woke up there three days after the beating. He is a Mayan and is from a village where violent massacres have been carried out by the Guatemalan military of people believed to be Mayan rebels. Despite my working with him on the issue before the interview, he never mentioned his Mayan ethnicity and said that he does not fear persecution in Guatemala on the basis of race, ethnicity or nationality. The officer agreed to note the issue, but didn't include it in the summary of the testimony because the client never even affirmed it after I made a lengthy statement about it.

I strongly contend that the religious establishment clause of the US Constitution should be found to prohibit any US funding of Israel in any manner if it elects to become a Jewish state only. The constitutional prohibition on the "establishment of religion" does not have a limitation on the US territorial limits. The First Amendment's Establishment Clause prohibits the government from making any law “respecting an establishment of religion.” This clause not only forbids the government from establishing an official religion, but also prohibits government actions that unduly favor one religion over another. It also prohibits the government from unduly preferring religion over non-religion, or non-religion over religion.


Trial this afternoon for a detained Honduran with serious mental health issues. Three members of his family have already been deported to Honduras. Two are known to be dead, his brother presumed to be dead. The US government has little sympathy. Good thoughts and prayers for my client and his family greatly appreciated.

The BIA recently recognized in an unpublished decision that address changes to the immigration court are required only after the NTA has been properly served.

In an unpublished decision on August 29, 2014, decision posted on Scribd by IRAC, the Board of Immigration Appeals (BIA) rescinded an in absentia order of removal upon finding the Notice to Appear (NTA) and hearing notice were not mailed to the address most recently provided by the respondent. The Board noted that the obligation to file a change of address form with the immigration court does not arise until a respondent can be charged with receiving the warnings contained in the NTA. The decision was issued by Member Michael Creppy and joined by Member Hugh Mullane and Member Ellen Liebowitz.
