Patriot Act requires that a lender have proof of a physical address on file, but does not require that the physical address be the mailing address or that utility bills be addressed to that physical address. I contend the application of the physical address provision of Patriot Act by SoFi and potentially other lenders violates both federal and state fair credit requirements and that their application of the address requirements is potentially unconstitutional in application. I’m trying to survey the breadth of the problem before deciding how I need to address it. As a 30 year federal litigator now happily living on the poverty stricken Hopi Reservation in Northern Arizona I know I have an obligation to address the issue in Court, but I don’t know whether there are others who would like to join in.
