I am at a turning point in my life. After 30 years of successfully defending people accused of crime, I am adding a new area of practice: Family & Estate Planning.

After cleaning up messes for 30 years I now am helping people PLAN to avoid problems in the future.

It's not all wills and powers of attorney. There is so much I have learned to help people plan for those unexpected events or even their death.

Totally different from how others are doing it. The old way doesn't work. With my new way you won't be paying hourly so you can call whenever you need to. We will have an informal meeting to discuss your current situation and how you want things handled in case you are in an accident or die.

Not only will we develop a plan together but I will make sure our plan works and we will review it every 3 years to make sure nothing major has changed.

The fun part is we are going to have a "Legacy Interview" which is recorded for you. In this interview we will be talking about what is most important in your lives that you want to pass on to your family, your values.

We will talk about: "What do you want to tell your daughter before she gets married?" "What would you like to tell your son when he graduates from High School/College?Med School/ Law School?" "What's your religion and how important is it for you?" "What is the most valuable lesson you have learned in life that you want to share?"

Doesn't that sound fun? And you will have it on a USB drive to play for your family if you are still around or not. This is just not done in Estate Planning today.

I want to make your experience with me and my office to be one that you will never forget and tell all of your friends about me.

So keep coming back to the page because I am going to start posting articles for you (Am open for suggested topics) and offering advice to help you and your family RIGHT NOW.

I will continue my DWI practice, but will be much more selective in the cases that I take.

So sorry for the long delay in posting, but a lot of moving pieces in my life and going back to school took a bit of time.

How Booze Built America- Final

I graduated with a History degree from Ole Miss. A college known for the first tailgate party in America. It’s simply called “The Grove”. The Grove is packed with football fans who have partied at this location for a long time. Rows and rows of tents. Each one ornately decorated with everything from chandeliers to lawn chairs. As you stroll by you are offered a drink ranging from cold beer to mint juleps.

I concentrated on the American Revolution. A very interesting subject. I read many biographies of our Founding Fathers and learned way more than ever taught in High School. I have continued to study about it and realize I may have some information that you may not have learned in High School or College. In line with my profession I began to study the history of alcohol in America. I thought I might share it with you. The majority of the research for this paper are a three-part television program called “How Booze Built America” on the AHC network.

Alcohol played a major role in the founding of America. When the Mayflower set sail for the Virginia colonies in 1630 it had a bounteous supply of alcohol for the passengers. It was well stocked for the journey. The Mayflower was supplied for each passenger to have 1 gallon of beer per day per passenger. As it approached the colonies however a problem developed. They ran out of beer. Initially planning on landing in Virginia, they decided to land in Massachusetts where they landed and promptly built a brewery.

It is not that the colonists were alcoholic, but it was much safer to drink beer in 1630 because water was full of problems. People who drank water rather than beer were more prone to dysentery, cholera and typhus. Life expectancy at that time was 25-30 years of age. Beer was much safer. Ingredients were maize, corn and anything else they thought would make a good ale.

The production of alcohol became the major industry in America. It employed farmers, tree growers, barrel makers, transporters and merchants. Taverns became the cornerstone of every settlement. By law, Taverns were required to be built next to churches.

Churches conducted services all day long, but churches had no heating. Taverns did. Whenever there was a break in the services, the congregation would gather in the Taverns to keep warm. They even made “small beer” for the children. It came in a smaller quantity and a lower alcohol level. The colonists consumed about 960 pints per year. Twice the annual consumption of the British.

Last week I went out in Uptown to see what was going on. I don't go out that much anymore, but I like to go out and observe people's drinking habits and compare it with previous times I have specifically observed it.

This time I noticed a marked behavior change in the 21-30 year old patrons. They don't go out to have a few drinks. Now everyone seems to be binge drinking. Binge drinking is loosely defined as having 5 or more drinks in an evening out.

What I observed was three bartenders pouring over 30 shots in less than 30 minutes. This leads me to conclude that most people are now going our for a beer and shots, plural.

Shots are fun and I am a fan of tequila shots, but you need to be careful if this is your drink of choice. They reason you get in trouble with shots is it does not take long to drink them.

Alcohol is a poison in the human body. As soon as it is consumed, the body immediately starts to work at eliminating it from the body. Alcohol is eliminated through, liver metabolism, breath, sweat and urine. The normal human body eliminates about one drink in an hour. If you drink more than that, you will get a buzz and if you keep drinking you will get drunk.

So I believe that these patrons were consuming 3 or 4 shots in an hour together with their beer. This leads quickly to intoxication because your body cannot keep up with your consumption.

Now in 2017, we are also seeing much higher alcohol concentrations in our DWI cases. A few years ago you would typically see people at .10 -.14. Today I see many clients wit concentrations of .20-.30. That's a lot. It is 3 times the legal limit of 0.08

People at these concentrations certainly shouldn't drive at all. They are a HUGE risk to everyone on the road. At this level you should be really drunk. However it seems that young people are more quickly developing a tolerance for alcohol This means they drink a lot, but they don't look drunk.

If you are a shot person, I am warning you to think about it before you do it repeatedly. Not only are their health risks but also, blackout, likelihood of getting into fights, getting kicked out or worse dying.

Be careful this holiday week and remember to take a breath test if you are arrested and asked for one. You will get the results immediately. You will learn how well you tolerate alcohol and have more information for more responsible drinking in the future.

Starting tonight at 6 pm Dallas has gone to a "no refusal" DWI policy. This means that if you refuse a breath test, the police will get a warrant and they can forcibly take your blood for a blood test. Juries like blood tests more than breath tests. So do yourself a favor and take the breath test. Even if you test over 0.080, you will have a better chance of winning your case at trial.

Drink responsibly and be careful over the holidays. If you or someone you know gets arrested for DWI call me as soon as you can. I will meet with you for free and evaluate your case so you can make a good decision when you choose your attorney.
