Elizabeth Holmes Fraud Trial (QUESTIONS AND ANSWERS)

Our team has been asked a number of questions about the Elizabeth Holmes Trial. The answers to the questions, I think, can help anyone going through the criminal justice system.

In this video, I answer some of the questions and comments we received, including:

1:12 Why would Elizabeth Holmes go to trial?
2:17 How much do you think her defense attorneys are making?
4:07 What is Elizabeth Holmes (or any federal defendant) going through every day?
6:05 How will Elizabeth Holmes make money again?
9:58 Are there any benefits to going through through this experience?
12:20 What will federal prison be like for Ms. Holmes?
15:49 What could Ms. Holmes have done differently?

Federal Judges WANT These Questions ANSWERED Before Sentencing Hearings

Hardly a day passes in federal prison without someone saying,"My sentencing judge had his mind made up before I was even sentenced.Nothing my lawyer or I could have done would have changed the Judge's mind."

As an exercise, let's work under the idea the Judges mind is indeed ALREADY MADE UP before the sentencing hearing.

What then?

If that is the case, defendant's need to ensure their sentencing mitigation was extraordinary. That includes having a favorable pre sentence report (PSR), compelling first person narrative, character reference letters and a well documented history of community service work, amongst other items.

Mitigation work, in our opinion at White Collar Advice, should tackle the eight questions I pose below and address in our new video:

1:50 - What have you been doing since getting arrested?
2:44 - What does that mean you are sorry?
3:38 - How do I know you will never return to this courtroom as a federal defendant?
5:04 - How will you make your victims whole?
6:08 - What will you do with the rest of your life?
8:25 - What fractures have you had in your life?
10:14 - What have you learned through this experience?
13:12 - In what ways do you give back to your community?
14:55 - Have you been working leading up to your sentencing hearing?

Thank you,
Justin

Advice For NEW You Tubers!

Two days ago a client sent me this message, "Can you help me create my Youtube channel? I am lost. I want to help doctors better understand the importance of being compliant."

A conviction requires many people to start over professionally. In my case, I could no longer sell real estate or stocks. I had to re build---YouTube helped.

When I launched the White Collar Advice YouTube channel, I was also lost. In the early days, I was obsessed with getting views and I tried to please everyone. I was not successful.

Within 12 months of creating the first video, I finally gained some traction, albeit modestly in my very small niche market.

If you are forced to start over professionally, or want to grow your existing business, you should consider using YouTube.

This new video will help you get your channel started correctly and it will ensure you avoid so many of the mistakes I made when I created the White Collar Advice channel.

When I launched the White Collar Advice YouTube channel, I was lost--I had no idea how to use YouTube effectively. In the early days, I was focused on the wr...

Federal Prison Camp Crash Course (End in Mind)

When I finally got my act together in prison, I wasn't focused on being a consultant or speaker. Instead, I focused on something much more important: "what do I need to do today and tomorrow to ensure my parents are not supporting me for the rest of my life."

What that end in mind (namely that I must become self sufficient), I began to make better choices.

I talk about that process in the second video in our Federal Prison Crash Course Series. We call this class, End in Mind.

In our first class, I spoke about the importance of a proactive federal prison adjustment. If you have not watched the video, do that now:https://youtu.be/4H...

Character Reference Letters - White Collar Advice

Getting a character-reference letter isn’t always easy. It’s especially difficult for people who’ve been accused of misconduct.

How does a person ask for a character-reference letter when their headlines, or allegations that someone has done something wrong?

Despite the difficult in asking for a character-reference letter, they can have a huge influence on advancing possibilities for a better outcome. This is particularly true for people that face criminal charges, or people that face hearings in front of professional boards that can threaten a person’s livelihood.

When liberty or livelihood are at stake, an individual should take meaningful steps to influence stakeholders.

An effective character-reference letter authenticates the positive attributes of an individual’s life. They need not address the allegation of misconduct. Rather, a character-reference letter shows that the individual makes efforts to contribute in positive ways to the lives of others and to society. They humanize a person, helping judges see mitigating factors that may advance prospects for mercy.

For example, let me share the story of Steven, a medical doctor who faced charges in federal court for violations of the Stark Act. Steven worked with our team to prepare for the best outcome at sentencing. Part of that scope of work included a campaign to collect character-reference letters.

Although Steven pleaded guilty to accepting kickbacks from a laboratory that analyzed blood samples, his character-reference letters were able to soften the blow. Scores of people wrote that they reached out to Steven for medical treatment. Without medical insurance, they could not afford treatment. Steven treated those people without charge.

Those letters helped stakeholders learn more about Steven’s character. Although he pleaded guilty to violating the Stark Act, his character-reference letters showed that his motivation was to help people who would have otherwise been denied medical treatment. They did not excuse his violation of the law, but they resulted in leniency at sentencing.

If you’re facing allegations of misconduct, make sure that you learn more about the purpose of a character-reference letter. For more details on writing effective character-reference letters, check out our free course.
