Breaking: New Mexico Department of Justice agrees to stop enforcement of HB9 in response to USDOJ lawsuit against New Mexico anti-ICE laws

The New Mexico Department of Justice and A.G. Raúl Torrez agreed to halt attempts to enforce HB9 against the Otero County ICE Detention Center in exchange for the USDOJ withdrawing it's request for a Federal judge to order them to do it.

Mayor Mike Rariden welcomed back to commission, for now, as efforts to restore fire service move forward

Mike Rariden started and ended the Edgewood Town Commission meeting as a commissioner and mayor. That is not normally a newsworthy event but Tuesday’s meeting was not an ordinary meeting.

After announcing in April that he would resign “during the week of May 4-8,” he rescinded his resignation on May 6 citing a desire to remain in office until the town’s fire service agreement with Santa Fe County was finalized. On Monday, Rariden said fellow commissioners had not accepted what he called an indefinite extension of his resignation.

Just before the commission gaveled into session Tuesday, Rariden gave a brief statement saying his computer access had been restored and he would remain.

More than 60 residents packed the commission chambers and lined the hallway outside for a packed agenda. Half of the dozen or so public commenters said they came to ensure that Rariden would retain his seat. Many of those comments were interspersed with criticism of the commission’s handling of the months-long saga over the cancelation of fire and EMS services provided by the county.

Heading into a long, hot and dry summer with regular Edgewood windy days and uncertain fire department coverage, town commissioners passed a new 30-day fireworks ban but postponed a decision on giving the town’s police officers powers to criminally charge residents for violating a long list of new fire restrictions.

Under state law, municipalities can impose fireworks bans for up to 30-days at a time. Aerial fireworks, including “missile-type rockets, stick-type rockets, helicopters and aerial spinners” would be prohibited in Edgewood starting on May 16 through June 15 unless the commission renews the ban in the interim. Violators could be issued a citation with fines ranging from $75-$500.

Town Manager Kelly Hamilton said his experience led him to be most concerned about banning aerial devices but wasn’t sure how the town would regulate “ground audible devices” on streets or public parking lots, for example. Police Chief Aaron Frost agreed that enforcement of those ground devices would be difficult and resource intensive. Commissioners ultimately chose to pass on banning those devices, for now.

In debate over an ordinance detailing prohibited activities during high fire dangers, Former Mayor John Abrams noted during comment that the ordinance, as written, could ban motorized vehicles including most automobiles. “You are going to criminalize any resident of the Town of Edgewood anytime this is in effect.” Other commenters worried that construction and standard farm equipment could also be banned under the broad language. Commissioner Raridan suggested adding language to specify that restrictions would only apply to small engines and off-road vehicles. Commissioner Brennan also raised those concerns before commissioner directed staff to bring back a cleaner draft to a future meeting.

Mike Raridan says he is still Edgewood’s mayor after announcing — then withdrawing — his resignation from his commission seat and the appointed office of mayor last month. The town’s commissioners, however, have scheduled a vote on tonight’s agenda to appoint a new commissioner and elect a new mayor anyway.

“The Town did not recognize my retirement extension that was submitted on May 6, 2026,” Raridan told the Route 66 Independent.

He intends to show up to serve as mayor tonight, but it is not clear what will happen if the other commissioners deny him a seat on the dais.

This is all playing out as the town’s commissioners appear ready to revisit the agreement with Santa Fe County they passed just a week ago to restore fire service to the town before a June deadline for county service to end.

The town’s meeting starts at 6 PM tonight and we’ll be there to report on what happens. The public is invited to sign up for public comment before the meeting.
