August was a good month in many ways.

I was able to celebrate another birthday. Got to catch up with a few old friends. And most of all had some time-when work would allow—to reflect.

I am blessed and many of my blessings come from a strong group of friends.

A lot of firms you see advertised are marketing machines — built to capture cases, not try them. Sign with them, and your case gets shipped off to someone else who actually does the work.

Some of those ‘trial attorneys’ on your feed? Never been to trial. That’s a business model and it’s fine. But the client thinks they hired a seasoned helluva courtroom attorney — when that attorney couldn’t tell you what it means to invoke the Rule, let alone run a direct or cross.

Everything that glitters isn’t gold. I retuned to private practice in October 2025 and tried more cases in this short time than other have the entire 7 plus years I was serving a a judge.

Now — every result depends on the facts and the law, and yes, trial carries real risk. No one disputes that. But as I learned in the military: it comes down to who will go. Who will answer the call. And who’s just a one-trick settlement pony.

If you don’t know the difference — trust me, defense counsel does. And they’ll use it against you.

It’s like a boxer who can only throw a jab. Good luck with that.
