POLICY CHANGE

This is for informational purposes only. For clarification to the law or specific changes, you need to contact your state representative.

Effective Jan. 1, 2022 Senate Bill 792 requires that as of Jan. 1, 2022, anyone parking in a disabled parking space must have a license plate or a disabled parking placard that features the International Symbol of Access (ISA). Currently, disabled veteran license plates do not feature the ISA, and all Texans with these plates are permitted to use disabled parking.

Veterans with “DV” plates but without the ISA symbol will not be able to park in a handicapped spot, but may still enjoy Texas toll roads free of charge.
DV plates with a handicapped placard may park in disabled parking spots.
Plates with the ISA symbol may park in disabled parking spots.
Eligible veterans may request a DMV form VTR-24 https://www.txdmv.gov/sites/default/files/form_files/VTR-214.pdf [txdmv.gov]) to be filled out by their medical professional to receive a handicapped placard from their local tax assessor office.

What this means

In Texas, 50% or greater disability rating qualifies one to apply for a DV plate. Currently, motorists with Texas Disabled Veteran (DV) license plates are able to park in handicap marked parking spots (ADA parking spaces). With the current change in state policy, effective Sept. 1, 2021, motorists with a DV plate will require an ADA placard in their vehicle to park in the ADA parking space, and in Dec. 1, 2021, the DMV will no longer automatically issue the placard without a doctor’s signature on the placard application.

While some may feel frustrated at this policy change, remember that DV license plates allow veterans to enjoy tollways, and downtown parking free of charge (and many more benifits). Of course, veterans may still apply for the ADA placard as needed to use ADA disability parking spaces after Dec. 1st, 2021.

The City of El Paso has been granted the Temporary Restraining Order against Texas Governor Greg Abbott that would support the Local City-County Health Authority’s proposal to issue a mask mandate for all indoor facilities.

Judge Ruben Morales in the County Court at Law #7 granted the City’s petition, which was filed today, Tuesday, Aug. 17. The court issued a Temporary Restraining Order finding that GA-38 exceeds the Governor’s authority under the Texas Disaster Act of 1975.

The Local Health Authority Order will take effect at 12:01 a.m. Wednesday, Aug. 18, 2021.

On Monday, Aug. 16, the El Paso City Council voted 5 to 3 to file a lawsuit against Texas Governor Greg Abbott that would support local protective measures.

City-County Health Authority Dr. Hector Ocaranza issued a countywide mask mandate for all indoor facilities, which would include the following:

• All individuals over the age of two (2), are to wear some form of face covering over their nose and mouth, while in indoor spaces.
• A face covering may include a variety of options.
• Parents and guardians of children over the age of two (2) and under the age of ten (10) shall be responsible for appropriately masking children when outside their residence.
• A face covering is not required on anyone who has trouble breathing, has a medical condition or disability that prevents wearing a face covering, or is actively exercising indoors and not within 6 feet of any other individual not from the same household.
• A person is not required to wear a face covering while the person is consuming food or drink.
• Wearing a face covering is not a substitute for the COVID-19 vaccination, for maintaining 6-feet social distancing and handwashing, as these remain important steps to slowing the spread of the virus.

VA spotlights special benefits for elderly wartime Veteran population

WASHINGTON — During National Financial Literacy Month, the Department of Veterans Affairs is launching an awareness campaign to inform elderly wartime Veterans and their families of their lesser-known pension, funeral, burial, and survivor benefits.

“VA’s pension benefit helps Veterans and their families cope with financial challenges by providing supplemental income,” said Acting Under Secretary for Benefits Thomas Murphy. “Currently, only 189,800 wartime Veterans and 139,800 surviving spouses are using their needs-based pension benefits that are meant to ease the burden on them, their families and caregivers. We need to ensure all of our wartime Veterans and their survivors are aware of their benefits.”

The following benefits are available through VA’s Pension and Fiduciary Service [gcc02.safelinks.protection.outlook.com]for use in planning and preparing for the future.

VA pension [gcc02.safelinks.protection.outlook.com] is payable to wartime Veterans who are permanently and totally disabled due to non-service connected disability, or who are age 65 years old or older, and who meet certain income and net worth limits.

Special monthly pension [gcc02.safelinks.protection.outlook.com] is an additional benefit for Veterans in receipt of pension who are housebound, require the aid and attendance of another person to help them with daily activities (such as eating, bathing and dressing), have very limited eyesight or require nursing home care.

For surviving spouses, there are two types of benefits P&F Service offers. Survivors Pension [gcc02.safelinks.protection.outlook.com] provides monthly payments to qualified surviving spouses and unmarried dependent children of wartime Veterans who meet certain income and net worth limits. Special monthly pension is also available to surviving spouses who are housebound or require the aid and attendance of another person.

Dependency and Indemnity Compensation [gcc02.safelinks.protection.outlook.com] is available to dependents and parents and generally is not based on income and assets (except the income limits apply to parents). DIC is a monthly monetary benefit paid to a surviving spouse, child or parent of a Veteran who died from a service-related injury or illness, or when an active-duty service member dies in the line of duty. Special monthly DIC is also available to surviving spouses who are housebound or require the aid and attendance of another person.

A surviving spouse of a Veteran who served on a Blue Water Navy vessel offshore of the Republic of Vietnam, or on another U.S. Navy or Coast Guard ship operating in the coastal waterways of Vietnam between Jan. 9, 1962 and May 7, 1975, may be eligible for DIC benefits — even if they were previously denied [gcc02.safelinks.protection.outlook.com].

VA’s funeral and burial benefits [gcc02.safelinks.protection.outlook.com] are available for both service-related and non-service-related deaths. New regulations allow a flat-rate burial and plot or interment allowance with decreased paperwork and maximum payment permitted by law.

For those interested in burial benefits such as a Presidential Memorial Certificate, burial flag, headstone or marker, the National Cemetery Administration [gcc02.safelinks.protection.outlook.com] has information about pre-need eligibility.

Many vulnerable senior wartime Veterans are targeted with misinformation. In many cases, this is because they are not fully aware of their benefits, which increases the chances of them being taken advantage of and/or defrauded.

VA encourages elderly wartime Veterans and their family members to consult a VA-accredited representative [gcc02.safelinks.protection.outlook.com] if they want or need help filing a claim. They are reminded to beware of individuals or companies that promise benefits or ask for money upfront, as only VA can make final determinations on eligibility [gcc02.safelinks.protection.outlook.com].

Thank you to all of you who have bravely served our country, you're incredible heroes! I've been feeling very patriotic recently and decided to watch a new documentary on Army Aviators deployed in Afghanistan called Above the Best. The film is the latest work of director David Salzberg, who has produced many other noteworthy combat films such as Hornet's Nest and Citizen Soldier. The film reminded me of how truly incredible our soldiers are and I thought it was really wonderful that the veterans within the documentary were open to having such an honest discussion on the mental health struggles they've faced. Just thought it shined a well-deserved spotlight on these men and women and wanted to share with others who I felt might appreciate it. The trailer is on the official website and the movie is available on VOD pretty much everywhere if you're interested!
