The AILA (a great organization) has provided a practice alert tip to attorneys re: individuals being asked to relinquish green cards and signing Form I-407. LPRs returning to the U.S. SHOULD NOT automatically surrender their green cards. An LPR does not lose LPR status for being abroad. LPR status is removed only until a final order of removal is issued by an immigration court because the government has proved that the LPR abandoned LPR status! Form I-407 MUST be signed voluntarily and there are no negative consequences for refusing to sign other than being issued a Notice to Appear before an immigration judge to determine whether the LPR has lost LPR status.

THE FUTURE OF DACA: The President-Elect stated in his campaign website that he pledged to end DACA. Therefore, he may take action on DACA after the inauguration. This may mean that USCIS may stop certain parts of DACA, such as accepting initial DACA applications or stop renewing DACA applications or revoking DACA for those who currently have DACA (this would mean that the work authorization would also be revoked). Because DACA is uncertain at this time, those who believe they are eligible for DACA, are DACA recipients and those that are up for renewal, please contact an immigration law attorney for important and detailed legal advice. Please also know that under the DACA initiative, there are no protections for the information given in the DACA applications, thus the information may be shared with CBP and ICE. Contact an immigration law attorney to discover when the DACA application information can be shared with CBP and ICE.
