The supreme court will be hearing three cases challenging the constitutionality of criminal refusal laws. Oral Arguments are scheduled for April 20th. If the Supreme Court strikes down these laws, it will have major implications on many cases here in Va.. Here is some info on the cases.

Bernard v. Minnesota (14-1470): is it constitutional for a state to criminalize the act of refusing to submit to a warrantless DWI search?
Birchfield v. North Dakota (14-1468): Is it constitutional for a state to criminalize the act of refusing to submit to a warrantless DWI search?
Beylund v. North Dakota (14-1507): Is it constitutional for a state to claim that a driver "consented" to a warrantless search when that driver was threatened with the crime of refusal?

A branch of the Prince William County probation office that monitors people who are on bond pending trial released some interesting statistics about our county jail:
1) the Prince William County Adult Detection Center currently houses approximately 1066 inmates per day. (Prince William County has a population of about 440,000 so that is 0.24% of the population in the county jail)
2) Of those, 300 were booked on a drug charge.
3) All inmates are classified by their risk for violence or causing trouble in the jail. 72% of the inmates are categorized at the minimum risk level.
4) 11.2% are currently listed at maximum security level, this 11.2% includes mental health cases who require special supervision and those in protective custody.
5) Approximately one-third of the inmates are pre-trial meaning that they have not been convicted and are presumed innocent.

DUI CHECK POINT NEWS RELEASE FROM PRINCE WILLIAM COUNTY PD

Sobriety Checkpoints are Underway this Holiday Season

In an effort to ensure that too much holiday cheer does not endanger lives this holiday season, the Prince William County Police Department is participating in the states Checkpoint Strikeforce campaign. The theme this year is Drive Sober or Get Pulled Over. This campaign runs from Dec. 1, 2013, to Jan. 1, 2014.

Checkpoint Strikeforce is a research-based, multi-state, zero-tolerance initiative designed to get impaired drivers off our roads using checkpoints and patrols when and where drunk driving is most likely to occur. The campaign also educates the public about the dangers and consequences of drunk driving. The premise behind this program is simple: There will be sobriety checkpoints, every week, everywhere, so you never know when or where you may encounter one. Additionally, Prince William County police officers will be conducting targeted DUI enforcement on County roadways from Dec. 24, 2013, to Jan. 1, 2014.

This enforcement effort serves dual purposes: to deter and detect drunk and impaired drivers, and to make the public more conscious of the dangers of operating a vehicle while impaired and the penalty for doing so.

It is hoped that through these coordinated efforts, the motoring public will designate a sober driver in advance of holiday partying or choose alternative methods for returning from events that include the consumption of alcohol.

Help ensure that the law-abiding citizens of Prince William County can travel on the roadways and highways in a safe manner by celebrating responsibly and either designating a sober driver, calling a taxi, or making arrangements to stay put. The Police Department wants everyone to make sure this is a happy and safe holiday season for everyone.

BREAD VS IGNITION INTERLOCK:

I fleshed out my bread & breathalyzer experiment last night and this is what I found. You can quite easily blow more than a .02 by eating nothing more than white bread. However, it dissipates rather quickly. How much time has passed since swallowing the bread is more important than the quantity of bread you eat.

So my conclusion: if you have ignition interlock in your car do not try to drive within 10-20 minutes after eating. You could blow a false positive.

.014 BAC from eating bread?...and I am a nerd.

I am sitting in my living room playing with my breathalyzer machine ("Nerd!") and I want to find out if I could get a false positive from eating white bread. So one slice of white bread later I blew a .014. That raised my eyebrows!
So for those of you with ignition interlock in your car - be careful! That is enough to get you a probation violation and land your butt in jail.

Virginia passed a law just this year making it illegal to get or keep a concealed weapons permit if a person get convicted of the following offenses:
1) DUI
2) Drunk in Public
3) Assault/Battery
4) 2 or more misdemeanors (not listed under 46.2)
5) A bunch of other stuff too.

Being in a resident substance abuse or mental health treatment facility recently OR being dishonorably discharged from the military are also bars.

Tricks of the trade:

Field sobriety tests are typically divided attention tests. This means the officer gives you multiple tasks in order to gauge your ability to perform with a divided attention.

For example: The "walk the line" test is not really about how well you walk a line. While you are focusing on walking the line, the officer is scoring you on how well you remember and follow the myriad of instructions he gives you prior to the test. Arms at the side, heel to toe, counting out loud, proper turn, starting and stopping only when instructed, ect.

DUI vs. DWI

DUI means "Driving Under the Influence" and can apply to alcohol or drugs. DWI means "Driving While Intoxicated" and generally only applies to alcohol.

In Virginia, DUI and DWI are essentially the same law with the same code section and the same punishments so most people use the words DUI & DWI interchangeably.

You can not be force to take an alcohol breath or blood test unless you are arrested for DUI within 3 hours of being behind the wheel.

If get in an accident on your way home from the bar it may be a good idea to lay low for at least three hours. I can't tell you how many clients were arrested on their way back to their car.

The DUI laws are set up so crazy drivers, serious drunks and jerks get deals and nice people get the book thrown at them. The prosecution don't make deals hardly ever anymore so nice people aren't rewarded for cooperating and the crazy cases are the hardest to prove so they get the best outcomes.

I once got a DUI breath certificate kicked out because when the police found my client his car was sticking out of the side of a house 3 feet off the ground. I successfully argued that they couldn't prove when the accident occurred or whether he was drunk while on public property. So the guy with his car inside someone's house gets treated better than the guy who sleeps it off on the side of the road with his keys in the ignition.
