TRAFFIC VIRGINIA LAWYER MARYLAND FAIRFAX RICHMOND PRINCE WILLIAM FAQS

Our Maryland and Virginia traffic defense attorneys are frequently asked questions regarding traffic defense. We hope that the answers you find here answer to some of your basic questions regarding traffic defense in Virginia and Maryland. After you read this, if you wish to talk to our Virginia or Maryland traffic defense attorneys, feel free to contact us. We are here to defend you.

Many people think that they can go to court on their own and just explain their situation to the judge and they will get their charge reduced. Others think that on their own they will be able to convince the judge to treat them humanely. To be frank, it is possible to do anything on your own. On the other hand, even if you hire an attorney, no attorney can guarantee a particular result.

Most people’s first reaction when they are stopped by police and issued a traffic ticket is to blame themselves for not monitoring their speed or obeying traffic laws. Very few motorists consider fighting the ticket or seeking reduced charges.

If you have received a speeding ticket or if you have been charged with a traffic crime such as reckless driving or driving after suspension, do not take your charges lightly. Traffic tickets can damage your driving record and may possibly result in a sharp rise in your auto insurance rates. More serious traffic offenses such as driving under the influence or driving with a revoked license, could potentially result in jail time and other serious criminal consequences.

Traffic charges are serious, do not take them lightly. But you do have rights. If you have been charged with a traffic violation, call our office today for assistance with your traffic ticket in Virginia or Maryland.

Most people believe that a traffic citation is frustrating and somewhat expensive, but essentially a small matter that only requires paying a fine. What many people do not realize is that even the most minor traffic ticket can have a significant impact on your insurance rates for years to come. Most traffic violations also add points to your record that could ultimately result in a driver’s license suspension.

A traffic violation can be defended like any other criminal charge. You should not just pay the fine or plead guilty because you want to dispose of the matter quickly. Our attorneys know how to investigate and challenge evidence such as Breathalyzer test results, radar gun readings, hood-mounted video camera recordings, the contents of police reports, and other evidence.
While in many cases a traffic ticket is not the end of the world, they can be costly. Not only is there a fine to pay, but you will also be liable for points against your license plus your insurance company may even raise your premium.

If you need help with this type of case in Fairfax, Prince William (Manassas), Fauquier (Warrenton), Loudoun (Leesburg), Caroline, Stafford, Spotsylvania (Fredericksburg), Chesterfield, Henrico, Arlington, Richmond, Alexandria, Warren (Front Royal), Clarke, Shenandoah, King George, Charles City, Frederick (Wi******er), Fredericksburg, Gloucester, Hanover, Hopewell, James City, King & Queen, King William, New Kent, Newport News, Petersburg, Prince George, Rappahannock, York, call our law firm immediately for help and speak to a lawyer about your options. In Maryland, if you need help with this type of an issue in Montgomery County, Rockville, Bethesda, Howard County, Ellicott City or Frederick, do not hesitate to call us for a consultation.

The SRIS Law Group can help you best possible outcome based on the facts of your case. If you wish to consult an SRIS Law Group, P.C. attorney, call us at 888-437-7747.

FAIRFAX VIRGINIA TRAFFIC LAWYER RECKLESS DRIVING SPEEDING AGGRESSIVE HEAT

Victim of Fairfax Operation Summer HEAT?

In general, reckless driving is defined as any person who drives a vehicle in a manner or speed that endangers the lives and property of others. That can include driving that endangers health or property of any other people on any church, school, recreational facility, business or government property, driveways, or parking lots or structures, or on Virginia highways.

Fairfax County is one of the counties in Virginia that is participating in a traffic ticket enforcement program called HEAT. The determination of the program is to step up traffic enforcement. Fairfax County Officers will be on the targeting moving violations such as reckless driving, speeding, improper passing, disregarding traffic signs and lights, following too closely, and failing to yield the right of way.

There are fourteen types of reckless driving tickets you may get in Fairfax, Virginia. The two main types of tickets given for reckless driving in Fairfax are for speeding and driving in a manner to endanger life limb or property.

Fairfax County traffic violations carry serious consequences. A criminal traffic charge is not a simple citation or moving violation. Some major traffic offenses are considered to be criminal acts and could result in a jail sentence, not to mention a significant fine. If you have been accused of reckless driving, whether by speeding, an accident case, or other types of recklessness, you are going to need expert legal representation from someone who is familiar with the Fairfax County traffic court.

Reckless driving is not a civil infraction. It is a criminal offense classified as a Class I misdemeanor, punishable by up to a year in jail. Even a simple traffic stop can lead to a criminal conviction. If the driver’s actions caused the death of another or if one is arrested for reckless driving while driving with a suspended license, the charge is upgraded to a felony. These serious traffic violations have a profound and lasting impact.
Aggressive driving will be punished as a Class 2 misdemeanor; however, aggressive driving with the intent to injure another person shall be punished as a Class 1 misdemeanor. In addition to the penalties, the court may require successful completion of an aggressive driving program

The average person has no idea who their judge is or what the most effective way to deal with certain legal records and arguments may be. The amount of increase in points on your driver’s license and potentially higher insurance costs can far exceed the reasonable expense.

Many people who get stopped on the interstates in Virginia get home to find out that they were actually charged with a crime. It is called reckless driving, and it prohibits going over 80 mph or any speed 20+ over the speed limit. This is a misdemeanor offense in Virginia, which is the same level of offense as DUI.
What can you do when ruined for a traffic violation in Fairfax County? If you are a Virginia resident, attending voluntary traffic school can add 5 safe driving points to your license. If you have a good record and all the safe driving points already, sometimes taking that traffic school course before your court date can influence a judge or prosecutor to reduce your fine or even reduce the level of offense. Fairfax County is not a merciless jurisdiction just because they do not offer traffic school as a way out for those one-time traffic offenders. It just takes a little knowledge of their system to know how to navigate it and receive the results you want.

If you need help with this type of case in Fairfax, Prince William, Fauquier, Loudoun, Caroline, Stafford, Spotsylvania, Chesterfield, Henrico, Arlington, Richmond, Alexandria, Warren, Clarke, Shenandoah, King George, Charles City, Frederick, Fredericksburg, Gloucester, Hanover, Hopewell, James City, King & Queen, King William, New Kent, Newport News, Petersburg, Prince George, Rappahannock, York, call our law firm immediately for help and speak to a lawyer about your options.

RECKLESS DRIVING VIRGINIA OUT STATE DRIVERS FAIRFAX WARREN CLARKE

Virginia can be a great place for a family road trip, but the fun can be spoiled when mom or dad is pulled over by a trooper or police officer for something like speeding or passing on a grade and ends up charged with reckless driving. Drivers from other states can be shocked to learn that reckless driving is a crime in Virginia, and they are facing not just a simple traffic ticket, but a criminal charge that can be penalized with jail time and affect their driver’s license back home.

There are numerous factors involved when fighting out-of-state traffic violations received in Virginia. We can provide a free assessment of your case, help you understand what you need to do in regard to clearing your record, and fight to prove your innocence or have your charges dismissed or reduced. Our law firm has successfully helped residents from numerous states including but not limited to North Carolina, Maryland, Pennsylvania, New Jersey, New York, Georgia, Florida, and Washington, DC.

An out-of-state driver who has issued a speeding ticket in Virginia should be 100% certain that they have actually received a speeding ticket and not a reckless driving ticket. The most common way to be charged with reckless driving is for speeding more than 80 mph or more than 20 mph over the posted speed limit. They should look on the document that the officer has given them and see whether it specifies speeding or reckless driving. Usually, the summons will say specifically speeding or reckless driving, and if it does not, then right underneath it, it will say whether the defendant is required to appear in court. If the ticket does not have information explicitly stating that it is either a speeding ticket or a reckless driving ticket, bringing it to a Virginia reckless driving attorney is a good way to determine which charge you are facing.

An out-of-state driver who does not pay the ticket by the due date is treated the same as a Virginia driver would be. In Virginia, unpaid fines are a route to have a license suspension. Even though an out-of-state driver does not have a Virginia license, their privilege to drive in Virginia can be suspended nevertheless.

Each case is different, but we focus on what the allegations are in each case. In some cases, we can tell right away that the person is in a good situation to get the case reduced. In others, we know it is more serious that they could be facing a potential license suspension or high fines and in still others we know there is a possibility that they could spend a weekend or more in jail.
Even though you are required by law to come back to court, if you have been charged with a class 1 driving offense, our attorneys can usually get your appearance waived by the judge if you are from another part of the US. This is done by a motion called waiver of appearance that is filed by the lawyer you hire.
If you need help with this type of case in Fairfax, Prince William, Fauquier, Loudoun, Caroline, Stafford, Spotsylvania, Chesterfield, Henrico, Arlington, Richmond, Alexandria, Warren, Clarke, Shenandoah, King George, Charles City, Frederick, Fredericksburg, Gloucester, Hanover, Hopewell, James City, King & Queen, King William, New Kent, Newport News, Petersburg, Prince George, Rappahannock, York, call our law firm immediately for help and speak to a lawyer about your options.

If you need help with this type of case in Fairfax, Prince William (Manassas), Fauquier (Warrenton), Loudoun (Leesburg), Caroline, Stafford, Spotsylvania (Fredericksburg), Chesterfield, Henrico, Arlington, Richmond, Alexandria, call our law firm immediately for help and speak to a lawyer about your options.

VIRGINIA RECKLESS DRIVING EXPLAINED BY FORMER PROSECUTOR

Virginia has strict laws about speeding that turn some cases of excessive speeding into more severe reckless driving charges.
In this overview of reckless driving in Virginia, we address the different types of reckless driving in Virginia, the consequences of a conviction, and whether you need an attorney to represent you in court for this charge. We also give an overview of some defenses that can be used in a reckless driving case and address a few other commonly asked questions about reckless driving in Virginia.

Our Virginia attorneys will explain the different Virginia reckless driving violations and the penalties that each of the different Virginia reckless driving charges carry. A Virginia reckless driving conviction can result in either a misdemeanor or felony conviction. Most people who are charged with reckless driving in Virginia do not recognize that reckless driving is a criminal act and therefore can result in an actual jail term in addition to a loss of driving rights and high fines. If a death was to occur as a result of reckless driving violation in Virginia, then a person may be convicted of a felony and thereafter be classified as a convicted felon. If a felony conviction was to occur, then in addition to any actual prison confinement, the person will also lose a significant number of their constitutional rights.
Virginia criminal code has several variations of the reckless driving offense, but the most common one is being charged with reckless driving speeding when speeding 20 miles/hour over the speed limit and/or driving above 80 miles/hour anywhere in Virginia – VA Code §46.2-862.

The second most common variation of the reckless driving offense in Virginia is “reckless driving generally.” Under this charge, it is not the speed that is the defining factor but it is the general manner of your driving that endangered the safety of people and property – VA Code §46.2-852.
Reckless driving in Virginia is most often charged as either general reckless driving or reckless driving by speed. However, there are a number of other traffic offenses in Virginia that are considered reckless driving.

If you have been charged with a reckless driving in violation in the general district court or juvenile district court, please do not wait to find out what consequences the Court may impose on you.
