Great news!

Dear friends, family, former and present clients,
The Virginia Supreme Court announced yesterday that all Virginia State Courts have been suspended until April 6, 2020.
This means that only arraignments, bail reviews, protective order cases, and emergency child custody cases, etc. will be heard in court.
So, if you have a pending court case through April 6, 2020, your case will automatically be continued and you can find out the new court date later when it's been reassigned.
Our office will remain open virtually via phone and email. If you have any questions or concerns, please do not hesitate to reach out.
Despite this tumultuous time, we at the Yoon Law Firm will continue to provide excellent service to the community and anyone who seeks legal advice.
Your friend and attorney,
Joseph Yoon

Good info about criminal offense classifications found by our good friends at Childress Law Firm, PC.
In the United States, there are three primary classifications of criminal offenses - felonies, misdemeanors, and infractions. Each classification is distinguished from each other by the seriousness of the offense and the amount of punishment for which someone convicted of the crime can receive.

Great work by a great colleague! Congrats in achieving justice my friend.
Jim Childress successfully had a jury trial REVERSED by arguing an error in the trial to the Virginia Court of Appeals. The case involved a man facing 10 years to life, if convicted, for distribution of drugs. The jury pool had two prospective jurors who each knew a Commonwealth's witness personally and the Court did not strike those jurors from the panel after Jim Childress objected to them staying on the panel

Courtroom Identification to be eliminated?
It’s one of the oldest courtroom gambits in America: a prosecutor in a criminal trial asks a key witness if he sees the person who committed the crime anywhere in the room. The witness turns and points to the defendant, as the jurors take it all in. But this enduring practice has come under fire in the last few years as an often unreliable tool.

Happy Independence Day America!
If America was born on this day, then yes, the Declaration of independence is her birth certificate. Did you know there are at least 25 copies? Did you know that King George III may not have even seen a copy? Even if he did, not until months after it was "actually" signed. Makes 26 U.S. Code § 7502 - Timely mailing treated as timely filing and paying, amusing. But, the Declaration was more of a, "hey colonists, we, your delegates decided to officially state that we want to be on our own, so get ready to fight for it."

The Supreme Court ruled on the travel ban injunctions today splitting the categories of people who can be excluded (not allowing people to be banned if they have a tie/relationship with a relative or school or employer but keeping people out if they have no bona fide relationship or tie of that sort. This potentially excludes a large amount of refugees.Keep in mind the merits of the travel ban case will be argued in October (including an analysis of whether it is moot since supposedly the administration was going to spend 90 days to study and roll out "extreme vetting" and it is unclear if anything has happened on that front). So not necessarily a total win for the Trump administration but not a loss either.https://www.supremecourt.gov/opinions/16pdf/16-1436_l6hc.pdf

More great advice on Immigration Law from our extremely knowledgeable colleagues at the Law Firm of Priale & Racine, PLLC.
While there is a great deal of fear, victims of crime in the DC, MD VA should continue to consider applying for "U" visas as it is a good opportunity to obtain legal status for them and for their family. Do you know someone who was a victim of a crime and cooperated with the investigation and/or prosecution of the perpetrator? Have them speak to a legal aid org or immigration attorney about applying for a visa to see if they qualify.

Held: Where a juror makes a clear statement indicating that he or she relied on racial stereotypes or animus to convict a criminal defendant, the Sixth Amendment requires that the no-impeachment rule give way in order to permit the trial court to consider the evidence of the juror’s statement and any resulting denial of the jury trial guarantee.
In short, if a juror used his stereotype bais to convict you, you get a new trial.
