Self-Defense In Virginia — Petrovich & Walsh, PLC

Virginia does allow claims for self-defense, but there are certain limits and considerations to keep in mind. Read more here https://www.pw-lawfirm.com/blogs/self-defense-in-virginia

When is Self-Defense Valid in Virginia? In Virginia, self-defense can be raised as a defense to an assault, battery, attack or attempted homicide when a person, reasonably believes that they are in imminent danger of bodily harm or death. How Does the Defense Apply? Self-defense is a murky con

Abused and used as a bait dog, Charity and her 7 puppies were dumped at a high-kill shelter. A rescue league picked them up less than 48 hours before they were to be euthanized.

The puppies were cute, fluffy and adorable and found forever homes almost immediately. But Charity didn’t garner as much interest. She’d endured so much at the hands of her abusers that she was literally terrified of her own shadow. Interactions with people were nearly impossible.

This is Charity today. She’s living proof that our past doesn’t need to define our future.

At Petrovich & Walsh, we believe in second chances.

We’re here for you and will do everything possible to help you get yours.

Many thanks to our clients who have hearings coming up. We appreciate your patience with the courts. They are trying their very best to reschedule all the cases that were continued due to COVID closures while arranging the docket in a way that hopefully limits the number of people that are in the building at the same time. Also, just a reminder, please bring a mask with you. You'll need it (or a written medical excuse) to enter the courthouse. We'll get through this together!

We know firsthand how difficult Capital Murder cases are for everyone involved. Having worked tremendously hard to help our Capital Murder clients avoid a death sentence, we can appreciate the gravity of what happened today. We will always fight to oppose a death penalty sentence.

Daniel Lewis Lee executed after Supreme Court clears the way

We don’t need the death penalty. How can we claim to be a civilized nation if this is how we exact justice? The prosecutor opposed the death sentence. The victim’s family opposed the death sentence. And the executed? He was not the ringleader. Ringleader got life.

At Petrovich & Walsh, we defend those that have been charged with Capital Murder. We have intimate knowledge of the many difficult factors in these cases. We strongly believe that the death penalty is unnecessary and have seen it unjustly imposed.

Daniel Lewis Lee, a convicted killer, was executed Tuesday morning in the first federal execution in 17 years after the Supreme Court issued an overnight ruling that it could proceed.

Larceny means theft, or taking property that belongs to someone else without their consent. In the legal sense, it is charged when the intent is to “permanently deprive” the owner of something; in other words, it’s stealing. In the Commonwealth of Virginia, there are two types of larcenies: petit larceny and grand larceny.

There are several differences between the two. In Virginia, both petit larceny and grand larceny are criminal offenses and convictions will permanently stay on your record.

FOURTH AMENDMENT RIGHTS

Under the Fourth Amendment, every person has the right to be free from unreasonable searches and seizures. This means that no person has to allow the police, without a warrant or probable cause, to search their person, their car or their home. The police cannot search for something based on a general hunch. While there are times when police can search without permission, they are trained to know the steps required, such as obtaining a search warrant. Typically, if police ask if they can perform a search they realize they do not have grounds to search without permission. Under those circumstances, there is no reason to agree to be searched by police.

The Fourth Amendment also protects you against unreasonable stops or seizures. The Constitution establishes an officer may not stop your vehicle, or you, without at least a reasonable suspicion you are violating a law. Any type of Constitutional violation may form a basis to eventually dismiss a drug charge. Therefore, it is extremely important to accurately recall details of any police encounter.

Awareness: New Road Laws, Effective July 1.

The General Assembly passed new laws that took effect July 1, and we wanted to make sure you knew about them. Information below is from House Bill 1705 and Senate Bill 437 and applies to the entire Commonwealth.

§ 46.2-924 Drivers must now *STOP* for pedestrians in crosswalks. No pedestrian shall enter or cross an intersection in disregard of approaching traffic. Once it is safe to cross and the pedestrian steps into the crosswalk, drivers must stop. This includes drivers in all lanes, both directions (even if the road has a median). So if the road is three lanes in each direction, drivers in all lanes must stop, not just ones immediately closest to the pedestrian at the time. Once the pedestrian has cleared your lane, you may proceed again. This includes crosswalks that are marked and unmarked (unmarked are at intersections on roads with a speed limit of 35 mph or less—mainly neighborhoods). This does not supersede a traffic signal—pedestrians still cannot cross on a red “no walk” hand. Cyclists in crosswalks should be treated the same as pedestrians.

§ 46.2-816.1 Vulnerable road users: If you seriously injure a vulnerable road user due to careless or distracted driving, you can now be charged with a class 1 misdemeanor (the same as reckless driving). Vulnerable road users are: people using wheelchairs; pedestrians; skaters (board or roller); people on electric scooters, bikes, or boards; cyclists; equestrians (or those riding other animals); and people in animal-drawn vehicles.

§ 46.2-841 Not using a bike lane to pass. If a vehicle is stopped waiting to make a left turn, vehicles behind cannot pass on the right by driving in the bike lane to get around the stopped vehicle.

Mr. Walsh added the most memorable smile on my face, when I was facing a domestic case from my ex-spouse. He has been in my mind for at least 15 years. I will never forget how he represented me in that criminal case even when (in my innocence) all of the odds were against me. All charges were dropped. #IWILLNEVERFORGET. 💯🦋🌹🤩😍
