Family Law- Custody modification procedure violations warrant reversal and remand

This is an interesting article because many courts, because of administrative efficiency reasons, refer all change of custody motions to the FOC to complete an investigation on whether a change would be in the best interest of the child... But as stated in this MI Court Of Appeals unpublished opinion:

"A trial court can only order an investigation by the friend of the court after the trial court first finds that proper cause or a change of circumstances exists. In this case the MI Court Of Appeals vacated the trial court’s order because “the court’s ruling on the threshold question may have been influenced by the portion of the [friend of the court’s] report addressing the best interests, which would put the best interest cart before the threshold horse.”

What this means is that when a party files a change of custody motion the court must first determine, usually after a hearing, whether proper cause or a change of circumstance exists to change custody and then determine whether the change is in the best interest of the child (ren)....

The court can amend a custody order only upon a showing of good cause and a change of circumstances. The moving party must make this showing by a preponderance of the evidence.

Family Law- Deference is owed to the parents’ decision

I have had several calls from grandparents whom are being denied grandparenting time asking if there is anything they can do to receive visitation with their grandchildren. Here is the short answer: The court ruling below says that when both parents are fit and agree that the grandparent(s) of their children not be allowed to have any contact with the parties' children the courts will not grant grandparents any visitation. Courts have held that parents have a constitutionally protected right to raise their children as they see fit and thus deference will be given to the parents decision. Now there are exceptions to this general rule, specifically when one or both of the parents are deceased or when the parents have been deemed unfit parents.

Parents have a constitutionally protected right to raise their children as they see fit, therefore, if two fit parents both oppose visitation, their joint opposition effectively creates an irrebutt…
