ODP Wants Family Feedback!
The Office of Developmental Programs (ODP) Supporting Families Survey is now available! ODP, its PA team for supporting families, the Information Sharing and Advisory Supports Committee (ISAC), supports coordination organizations, and service providers want to learn if the person you care about is living the life they want to live.

ODP will use the family feedback to understand families’ satisfaction with the support received from Supports Coordinators (SC). The survey asks about areas that are important to all people; such as community living, employment and health. As you know, Supports Coordinators play a critical role in supporting peoples needs. SCs plan with you (and your family member); find, arrange and monitor services; and guide the Individual Support Plan team.

Your feedback and the survey results will guide ODP’s activity to achieve the highest satisfaction. The survey is anonymous and takes 10 minutes to complete. We encourage you and any family members to complete the survey which will help ODP strive to support individuals with disabilities to live their best lives.

Settlement of Lawsuit Gives People with Mobility Impairments Greater Access to their Communities

Harrisburg, PA | Following a class-action lawsuit filed by Disability Rights Pennsylvania, removable medical equipment, such as wheelchair ramps, wheelchair lifts, ceiling lifts, and stair glides, is now covered under Medicaid for children and adults with mobility impairments.

The lawsuit filed on behalf of a class of children in June 2018, B.B. et al v. Miller, 1:18-cv-01257 (M.D. Pa.), alleged that the Department of Human Services (DHS) violated the Social Security Act by denying requests for removable medical equipment. The lawsuit also alleged that the Defendant failed to inform the plaintiff class of the availability of such equipment under Medicaid (commonly known as Medical Assistance) and by leading youth, hospitals, equipment vendors, families, advocates, and others to believe that such devices were not covered under Medical Assistance.

The lawsuit led to a settlement which will now be submitted to the Court for approval on behalf of the plaintiff class. The settlement provides that Medical Assistance now covers wheelchair lifts, stair glides, ceiling lifts, metal accessibility ramps, and other items that are used by a beneficiary with a mobility impairment to enter and exit the home or to support activities of daily living and are removable or reusable without damage to the item. Details of the settlement will be distributed in a notice to the class, and class members will be able to submit comments to the Court on the settlement as part of a hearing on the fairness of the settlement.

As part of the settlement, DHS revised its Medical Assistance regulations to reflect this new coverage, which was approved by the Federal Centers for Medicaid and Medicare Services (CMS), retroactive to April 1, 2021. The revised coverage approved by CMS applies not only to the children in the plaintiff class, but to all Medical Assistance recipients in Pennsylvania, regardless of age.

Kelly Darr, Legal Director for Disability Rights Pennsylvania said, “Medical Assistance coverage of this equipment is essential to ensure that people with disabilities have access to their communities. Pennsylvanians enrolled in Medical Assistance who need this equipment should request it even if they have been denied or told that the equipment was not covered in past.”

C2P2 Early Intervention

Applications are now open for C2P2 EI—Competence and Confidence Partners in Policymaking for Families of Children in Early Intervention.

C2P2 EI is an innovative free training program providing participants with up-to-date information, leadership development training, resources and skills. Participants learn about the local, state and national issues that affect children with disabilities. C2P2EI offers training to help you learn the Early Intervention System and actively participate in your child's team.

Virtual and in-person sessions are planned starting November 4, 2021. Alternative options and participant supports will be available if COVID-19 restrictions occur.

Regional Collaboratives are across PA and consist of county, or multiple counties, agencies, organizations, families, people with disabilities and many others that come together to support those with disabilities and their families at a local level.

The Regional Collaboratives need the individual and family voice in order to know what to work on and how best to support the people they serve. Please consider contacting your county and becoming involved in your local Regional Collaborative and make sure our loved ones have a local voice.

The Regional Collaborative interactive map on Pennsylvania’s CoP for Supporting Families - The Community of Practice webpage has been updated with contact information for each county as well as website/social media links, communication and meetings structure, goals, next steps or action plans, and community partners where available. The CoP webpage on MyODP also includes contacts for the ODP Regional Leads, information about the Charting the LifeCourse framework and tools, and vision and ways to connect with the four Areas of Innovation workgroups within the CoP: Employment, Front Door, Supports Coordination, and Supporting Families. Please take a few minutes to write the IACC about any or all of the following that may be meaningful to you (NCSA considers all of these to be matters of tremendous urgency). Tell your STORY:
--Need for research about causes of autism
--Need for research on prevention of autism
--Need for research on both medical and nonmedical treatments to help those disabled by autism
--Need for crisis care to help children and adults with severe, dangerous behaviors
--Need for viable long-term programs, supports, and housing options for adults with autism, especially those living with parents who are aging or otherwise incapable of meeting their substantial needs
--Need for CHOICE of care and support options that include the severe population (eg, the absurdity of "competitive employment" for our adults, the maliciousness of removing housing options designed to support the severe population)
--Need to recognize that "neurodiversity" does not represent your severely affected loved ones
--Need to prevent neglect of abuse of severely autistic children and adults (eg, videocameras in group homes)
--Whatever is important to you, your affected child(ren) and your family; our community faces countless issues
