Urgent Report on the Arbitrary Arrest and Detention of Chairman Fayyaz Ali

Introduction
The Mazdoor Kisaan Party (MKP) strongly condemns the unlawful arrest and secretive detention of our Chairman, Comrade Fayyaz Ali, former Mayor of Tehsil Tangi, Charsadda. This action, taken by the state without due process or transparency, is a clear act of political repression meant to dismantle the growing resistance to forced land evictions of landless agricultural workers.
Background
Comrade Fayyaz Ali has been leading MKP’s campaign to resist land evictions scheduled for 21 May 2025 in Gulbagh, Turtun, and Safrii — areas where landless peasant families are under threat of displacement by state-backed landlords and development authorities.
On a recent visit to Safrii, Comrade Fayyaz delivered a public speech, reaffirming the Party’s commitment to defend the homes and livelihoods of these communities. Upon returning to his hujra, he was approached by community members requesting his assistance with work in Abbottabad.
Due to previous surveillance and false association with the PTM, Fayyaz informed them that, in good faith, he would first seek permission from the Mandani Police Station before traveling. He reported to the station and signed his intention to travel.
Details of Arrest
Immediately after his departure from the Mandani Police Station, a directive was issued by the DSP Tangi and DPO Charsadda, stating that Comrade Fayyaz’s movements were to be tracked and that he was to be arrested wherever seen. This instruction, based purely on his identity and political role, is a grave abuse of power.
As soon as he exited the Haripur Interchange on the Motorway, law enforcement officers were waiting. He was:
Arrested without warrant or explanation
Detained for 4–5 hours at an undisclosed location
Transferred to Charsadda Police custody
And then, around 4:00 AM on 17 May 2025, forcibly moved to Dera Ismail Khan Prison
All of this has taken place without any official charge being communicated, and without allowing access to legal counsel or family members.
Feared Charges under MPO
We have credible reason to believe that Comrade Fayyaz has been detained under Section 3 of the Maintenance of Public Order Ordinance (MPO) — a colonial-era law frequently misused in Pakistan to suppress political dissent and grassroots mobilization.
The police are not cooperating, and no formal notification has been provided to MKP, his family, or his legal representatives. This level of secrecy and procedural violation raises serious concerns about Comrade Fayyaz’s safety and the motives behind his detention.
Political Motivation Behind the Arrest
This is not an isolated incident, but part of a broader crackdown on peasant movements and democratic resistance. Comrade Fayyaz’s arrest is a deliberate attempt to sabotage the growing unity of landless agricultural workers and their movement to protect their homes and land from illegal eviction and land grabs.
Our Demands
The Mazdoor Kisaan Party demands:
Immediate and unconditional release of Comrade Fayyaz Ali.
Full disclosure of charges (if any) and production before a competent court of law.
An independent judicial inquiry into the role of DSP Tangi and DPO Charsadda in this politically motivated arrest.
Access to legal counsel, family, and medical care during his detention.
An immediate halt to the land evictions in Gulbagh, Turtun, and Safrii, and open public consultation before any state action affecting landless communities.
Conclusion
The arrest and detention of Comrade Fayyaz Ali is a gross violation of fundamental civil and political rights and a clear example of the state's repression of organized peasant resistance. The Mazdoor Kisaan Party will not be silenced. We stand firm in our commitment to defend the rights of workers and peasants across Pakistan and demand justice for our Chairman.
We call on all democratic forces, human rights defenders, legal organizations, journalists, and working-class allies to raise their voice and demand his immediate release.
