What is your mediation process in your state or country for civil and family cases? In Houston, and USA in general, there are five steps. The (1) introduction of the mediator and the process, (2) parties tell their stories of about the event that brought them to mediation and what they hope to get out of the process without interruption, (3) identifying issues and options to explore, (4) negotiate the viable options, (5) the mediator is the scribe for the Memorandum of Understanding (Mediated Settlement Agreement). Caucus or separate meetings are used to reality check and to offer conflict coaching, not as the whole process of the mediation. Conference style and quality conversation are the hallmarks of a quality mediation process. Tell me about your mediation style!

The Place of Faith-Based Mediation In A Secular World

April 24, 2016 --- 1:30 pm - 3:00 pm

Event Description:

In this interactive discussion, Dr. Mohammed Keshavjee will explore critical issues affecting Alternative Dispute Resolution, with a particular focus on mediation. He will situate the conversation within the larger issues affecting mediation as a global phenomenon, drawing on his many decades of experience studying and training practioners on emerging trends in international mediation. In this context, Dr. Keshavjee will deconstruct the notion of faith-based mediation and analyze its strengths and weaknesses. This discussion should be of interest to all practioners, academics, and students of Alternative Dispute Resolution.

Dr. Mohamed Keshavjee

About the Speaker:

A member of the Law Society of Upper Canada and an Advocate of the High Court of Kenya, Dr. Mohamed Keshavjee is a lawyer-mediator-trainer, and a global specialist on international cross-cultural family mediation. Dr. Keshavjee has a Doctorate in Alternative Dispute Resolution, from London University. He has trained youth leaders, imams, and pastors globally on mediation and conflict resolution. Dr. Keshavjee has also trained family mediators in 27 countries of the EU in dealing with cross-border child abduction, and has helped design guidelines for family mediators for the International Social Service of Switzerland.

Dr. Keshavjee has worked for 30 years with the Aga Khan Development Network (www.akdn.org), an international, non-denominational network of programs, institutions, and agencies committed to the improvement of the human condition. He is also a member of the Steering Committee of the Charter for the International Institute of Compassion in England, the Three Faiths Forum of the UK, the Abrahamic Community of the Chautauqua Institution of the USA, and of the Board of Governors of the Institute of Ismaili Studies, London.

Dr. Keshavjee’s work culminating in his text, Islam, Sharia, and Alternative Dispute Resolution, surveys mechanisms for legal redress in the Muslim community. His memoir, Into that Heaven of Freedom highlights the struggle for human rights, communal and individual identity, the role of civil society and the work of Mahatma Gandhi and Nelson Mandela in promoting peace. In connection with these two books and more broadly for his efforts championing peace through transformative mediation, Dr. Keshavjee has been named the recipient of the 2016 Gandhi King Ikeda Award for Peace bestowed by Martin Luther King Jr. International Chapel at Morehouse College in Atlanta, GA.
