A big win in federal court for Wendell and Brian. Our client was charged with filing a false tax return and conspiracy to defraud the United States in the Western District of Texas. If convicted, the client faced up to 5 years in a federal prison. The trial was set for September of 2021.

After a thorough review of the client's business records, it was apparent that his tax practices, though not 100% accurate, did not support a criminal indictment. Last week, the government agreed and dismissed both criminal counts.

The client is now free from potential prison time, will not suffer a felony conviction, and can continue operating his business. Dismissals are rare in federal court. We will enjoy this one.

Big time win yesterday in federal court. The client came to us in 2018 under investigation by the criminal division of the IRS. The IRS Agent was alleging the client had $1.7 million in unreported income. This equated to a tax loss of over $500,000 and a recommended guideline sentence of 27-33 months in federal custody.

Wendell Odom and Brian Hobson took a look at the numbers, and noticed the government failed to give credit for large business deductions throughout the years in question. After the investigation, the government agreed that the appropriate tax loss was $100,000. The unreported income went from $1.7 million to ~$300,000 (an 82% reduction).

The client was sentenced yesterday in federal court. Based on the new numbers, and the client's stellar mitigation, the Court sentenced the defendant to 5 years probation. The client will spend no time in prison and will continue to run his business.

The Harris County Criminal Lawyer's Association is the largest local defense bar in the country. We are honored to be recognized by the association as Lawyers of the Year in 2020. The notable victories for our firm in 2019-2020 included 1) successfully overturning our client's conviction for capital murder on appeal in state court, 2) obtaining a dismissal on a federal death penalty case (the first in decades nationally), and 3) obtaining verdicts of not guilty on all 25 counts of healthcare fraud in the Southern District of Texas.

Amazing result today! In 2010, Odom, Davis & Hobson began representation of a defendant charged with capital murder in federal court. The government obtained approval for the death penalty in 2012. Today, the district court granted a motion to dismiss the indictment on speedy trial grounds. This is the first dismissal of a federal death penalty case in decades. A special thanks to resource counsel from the Baltimore Public Defender's Office who assisted over the last 5 years. It does not get any bigger than this result.

Big time win today! In 2018, Odom, Davis & Hobson teamed up with William McMurrey to represent a doctor charged with 18 counts of Medicare fraud and 7 counts of money laundering. Following a lengthy bench trial before Judge Lee Rosenthal, the judge returned verdicts of not guilty on all 25 counts this afternoon. The client was facing up to 20 years in federal custody, and revocation of his medical license, if found guilty.

Another big win for Brian Hobson on a criminal tax case. The Criminal Investigation Division of the IRS shut down their case today. The client is now back in front of the civil division of the IRS for tax assessment. Prison time is off the table.

Following a thorough review of a client's business and tax filings, Brian Hobson and Wendell Odom were able to close a criminal tax investigation into their client's business. The case is now heading back to the civil division of the IRS, and no criminal charges will be pressed against the business owner. In any CID investigation, it is always our goal to take prison time off the table. Glad we could get it done.

Today, Brian T. Hobson obtained an appellate win out of the First Court of Appeals in Houston. The defendant was convicted in 2014 for capital murder and sentenced to life in prison with no possibility for parole. After finding harmful error, the Court of Appeals reversed the conviction and remanded the case to the 228th District Court. The defendant is now awaiting a new trial.

This morning, Brian Hobson obtained a dimissal on a charge of assault family member - choking out of the 177th District Court of Harris County, Texas. The defendant was facing 2-10 years in prison if convicted.

On June 14, Neal Davis, III obtained a Not Guilty on one count of Aggravated Robbery and one count of Aggravated Kidnapping in the 262nd District Court of Harris County, Texas. The client was facing 15 years to life in prison if convicted. Big win for Neal

Four years after Alfred Dewayne Brown was freed from prison and 16 years after the crime that sent him there, a Harris County judge on Friday signed the order declaring the former death row inmate actually innocent.

This morning, Neal Davis obtained a dismissal on a charge of prostitution out of County Court 11 in Harris County, Texas. The defendant was facing up to 180 days in Harris County jail if convicted.

On October 15, Brian Hobson obtained a trial day dismissal on a charge of Assault Family Member - Impeding Breath out of the 405th District Court of Galveston County, Texas. The defendant was facing up to ten years in a Texas prison if found guilty.
