An appeals court recently upheld a lower court ruling against IberiaBank, which previously agreed to pay an $11.6 million fine to resolve allegations of violating the False Claims Act by falsely claiming they were complying with federal mortgage loan requirements, according to a recent court decision by the United States Court of Appeals, Fifth Circuit, which has jurisdiction over Texas, Louisiana and Mississippi.

Trial in massive fraud against troops’ healthcare program ends in Dallas with mixed results

Houston Attorney Sean Buckley recently won big in a massive $100 million federal criminal trial where his client was accused of defrauding the TRICARE federal healthcare program. His client, along with 12 other defendants, were accused of conspiring to bill the government for expensive compounded pharmaceuticals like pain and scar creams that were allegedly not needed.

His client was found NOT GUILTY.

It’s one of Texas’ biggest federal criminal cases brought in connection with the government’s nationwide criminal investigation into compounding pharmacies and their marketing operations that have received federal money.

COVID-19: Federal Wire Fraud and Mail Fraud Statutes | Brewer, Pritchard & Buckley, P.C.

Law enforcement agencies across the U.S. are cracking down on federal wire fraud and mail fraud amid Covid-19.

Attorney Sean Buckley – who won a stunning acquittal late last year in a federal Healthcare Fraud case involving $120 million in alleged fraud – believes that successfully defending complex federal criminal fraud cases boils down to the issue of intent. “Federal prosecutors cast a wide net when charging defendants,” says Buckley. “Indictments commonly rest on the superficially nefarious outward appearance of a transaction, while giving little or no consideration to the actual intent of the defendant at the time he participated in that transaction.” Stated differently, the federal government shoots first and asks questions later. “In some cases,” adds Buckley, “a federal criminal indictment represents little more than a bet by prosecutors that the issuance of the indictment alone will sufficiently intimidate defendants and witnesses into providing the government with the evidence it needs to prove its case. “At the end of the day,” says Buckley, “regardless of the facts, federal prosecutors bringing Wire Fraud and Mail Fraud charges must eventually develop sufficient evidence to prove to a jury beyond a reasonable doubt that the defendant acted with a specific intent to defraud.”
