A Living Trust Doesn't Protect Assets That Aren't in the Trust

Many people believe that once they've signed a living trust, their estate plan is complete. Unfortunately, that's one of the most common and costly estate planning mistakes.

A trust only controls the assets that have been transferred into it. If your home, bank accounts, investment accounts, or other property remain titled in your individual name instead of your trust, those assets may still have to go through probate.

A Real-Life Example
Linda created a revocable living trust because she wanted to avoid probate and make things easier for her children. Her trust clearly explained how she wanted her assets distributed and named her oldest son as the successor trustee.

However, Linda never transferred ownership of her home, bank accounts, or investments into the trust.

When she passed away, her family discovered that although the trust existed, it did not legally control those assets. As a result, they still had to go through probate to gain authority to distribute the estate.

The process delayed settling her estate for nearly a year, increased legal expenses, and created unnecessary stress and disagreements among family members.
