Pursuant to an order by the United States District Court for the Eastern District of Virginia, effective June 1st, individuals in the Commonwealth with a felony conviction can only lose their voting rights if convicted of an offense that existed as a common law felony in 1870. If an individual has a felony conviction that is not an applicable common law felony, they may be eligible to register to vote upon further evaluation.
