I wonder if a banker's education and other training may have exposed him or her to Frédéric Bastiat. Bastiat argued that for the government to organize charity, it would have to disorganize justice. ARTICLE IV. - CONDITIONAL USE PERMITS Sec. 138-112. - Approval, procedure, responsibility and appeals. (2) Application concerning permits for those uses which are conditional shall be automatically referred to the planning and zoning commission for a public hearing. Never happened.
Commissioner, good intentions aside, do the ends justify the means - for city leaders ? The McAllen City Commission approved a conditional use permit for a respite center for itself when it did not even follow the procedures which it imposes on its citizens. It is abundantly clear from a reading of the ordinance that it did not. (link posted below) The matter was never presented to the Planning and Zoning Board as required. And the application was not submitted with required site plans and drawings. And never mind that the city, by making the application, indicates it the "certified agent" for the owner of the building. So how is the lease going to be drawn and who will negotiate the best deal for the city when the city clearly has adopted the view that the "ends do justify the means"> This is, among other things, also about equitable standards. Who can abide by the expression "do as I say, not as I do"? City leaders have acted in a manner that is, If not deceitful, certainly deceptive. I know the city would not tolerate the same behavior by its citizens.
The City Commission voted to approve a conditional use permit for institution use (respite center) at its regular meeting of April 22, 2019. It was clear from the agenda and the memo from the Interim Director of Planning to the City Manager that the City of McAllen was the applicant. However according to the appropriate ordinance "The PROPERTY OWNER or certified agent shall make application on a form prescribed by the city and such application shall provide drawings as set forth in section 138-114." Part II - Code of Ordinances Subpart B - Land Use Regulations and Related Activities Chapter 138 - Zoning Article IV - Conditional Use Permits Section 138-113 - Application, filing procedures and fees
I'm not in your district but wanted to express my appreciation for your vote this afternoon on the conditional use permit (CUP) for the city. Thank you Commissioner. I'm sure legal beagles have determined that the city asking itself for a CUP is legal but it seems like a conflict and sure does have the appearance of impropriety. The mayor already admitted on the record in January that the 'respite center' did not have a CUP at its two previous locations and code violations at the third location. Why would or should anyone believe the city will 'police' itself in this instance?
If it hasn't already, I'm quite sure UTRGV will reach out to someone or everyone on the city's commission for it's annual subsidy. And a subsidy for a state institution is exactly what it is. When will enough be enough? In addition to whatever the local inflation rate is, and regardless or purpose or amount, increased city fees and taxes have raised a McAllen citizen's cost of living. Socioeconomic data are readily available for any one willing to find it. Fully one quarter of the city's residents live in poverty. The median income is $45,568, and the per capita is not quite 22k. The number of households of with incomes under $50,000 is just shy of fifty-seven per cent. That's 57% ! Most families base their spending on their income. But I think the commission spends public money from the perspective of their own individual circumstance, i.e. what impact another $5, $10, or $25 in monthly expense would have. It would be interesting, and revealing, to compare the commission's median income with that of the rest of the city. When is enough enough?
Thank you for your most recent Nay vote. It was greatly appreciated. My District 2 Commissioner knows I am disappointed in his vote - not that this constituent's disappointment matters. Thanks again.
As your constituent, I ask about the traffic pattern at the Idea school on Bentsen and Business 83. By what authority is the right southbound lane of Bentsen FORCED to enter the school? What signage advises that one must enter the school? Thank you.
Thank you for taking the time to speak with me, though not a constituent, following the Tuesday noon commissioner's meeting. And thank you for expressing your apprehension over the pending resolution during the meeting and for your abstention.
I am reaching out to you today regarding the Mcallen City Commission’s consideration of a resolution against the borderwall. The city’s proposed resolution largely ignores many of the concerns Mcallen residents share. We urge the city to utilize the strong resolution Mcallen constituents have written, which includes language that opposes the construction of levee borderwalls. The third section of the city’s proposed resolution is problematic, as it states: Whereas, the existing levee walls that are necessary for flood protection in our region are being repaired regularly and need to be improved. Current data from the International Boundary and Water Commission (IBWC) and the Federal Emergency Management Administration (FEMA) indicate that the levees no longer need rehabilitation. Therefore, we, the constituents of Mcallen, cannot and will not support a resolution that supports any possible development of future levee borderwalls. We urge you to join Rio Grande Valley cities such as Brownsville, Hidalgo County, La Joya, Mission, and Weslaco as they stand in opposition to the development of levee walls, walls, and fences along the border.
As I am unable to attend tomorrow's meeting due to a doctor's appointment, please allow me to go on record as a concerned citizen of McAllen, TX that is VERY strongly against having a Wall. We are an international community, with many in our community with family members on BOTH sides of the Rio Grande. Walls do not fix the problem, Immigration reform in the interest of making it both humane and fair is the better solution. Please advocate for our community!
