Question 1. How is the assigned judge from Circuit Court Div. VI, Judge Cedrick Wooten, going to hear the case, given that he recused himself from her ouster trial?

Question 2. How can the complaint be heard in Circuit Court if it was addressed to Chancery Court?

Question 3. How can the complaint be heard in any court if state law (TCA 2-17-104) requires the contest to be filed with the state primary board?

Question 4. How can the contest be heard by the state primary board if they have already met and the challenge deadline has now passed?

Question 5. How can there be “approximately one thousand seven hundred (1,700) absentee ballots” that “remained unprocessed, unresolved, uncounted, or otherwise not reflected in the certified election totals” as claimed in the complaint if there were only 503 absentee votes cast in the Democratic primary through the end of early voting?

In just the last 4 years, there have been at least 10 elections decided by fewer than 200 votes in Memphis and Shelby County. All of these are primary or runoff elections, and only one is a county-wide position.

On May 6, the Shelby County Board of Commissioners held a special called meeting to fill a vacancy in TN House District 93.

The Board fills vacancies in accordance with a procedure included in its Permanent Rules of Order (Rule 35b, Exhibit F).

The nominations and votes proceed numerically by district number, in a rotating fashion, with the chair always going last. For this appointment, District 3 was first up.

Of the six individuals who applied for the appointment, four were eligible for nomination, as one did not attend the committee interview, and one withdrew.

Three of the four eligible applicants received a nomination, and one candidate reached a majority in the first round -- T.J. Hardaway.

Ten of 13 commissioners were present for the vote.

It's not my settlement agreement, but it seems to me the options are 1. approve the Sheriff's $18 million in overtime costs now, or 2. return to court for a possible $67 million judgment. So far we've taken door number 3, pretend none of this ever happened.
