An update from last night’s board meeting.
At last night’s ELCO Regular Voting Board of Education meeting, revisions to Policy 253 Student Physical Privacy in School Facilities were introduced as a first reading. This revised policy for a first reading was passed 5-4 and strengthens the policy’s original intent of biological s*x facilities for these reasons:
Prioritizing Student Safety and Privacy: Designating multi-user facilities based on biological s*x directly addresses legitimate concerns about physical privacy and modesty in vulnerable spaces such as locker rooms, showers, and restrooms. This approach helps ensure every student feels secure and respected, reducing the risk of discomfort or potential harm.
Grounding Policy in Biological Reality: Defining facility access by biological s*x - verified through objective records such as birth certificates or medical determinations - provides clear, consistent, and verifiable standards. This foundation of biological truth promotes fairness, minimizes ambiguity, and maintains the integrity of school policies in an academic environment where evidence-based decisions are essential.
Offering Balanced Accommodations: The policy includes single-user facilities available to any student without explanation, along with case-by-case discussions for individual needs. This allows the district to respond compassionately to students who require additional privacy while preserving safety for the entire student body.
Strengthening Discipline and Respect: Clear rules against misconduct - such as bullying, harassment, unauthorized photography, or invasions of personal space - combined with straightforward reporting and investigation procedures, help create a culture of mutual respect. This policy aims to achieve protection from misconduct for ALL students and staff, supporting a focused learning environment free from unnecessary conflict.
Aligning with Legal and Educational Responsibilities: The changes comply with relevant state and federal laws, including Title IX and Pennsylvania codes, while protecting the district from legal and operational risks. By adhering to objective biological criteria, the policy upholds the school's core mission: providing a safe, orderly, and truthful educational setting for all students.
Eliminating References to Gender Identity: Removing mentions of gender identity eliminates subjective and potentially shifting criteria that can create confusion, disputes, or perceptions of unfairness. Relying solely on biological s*x establishes a neutral, predictable framework that reduces division and allows the school to focus on education rather than ongoing debates over personal identity.
Safeguarding Against Misuse and Building Trust: Objective biological standards help close potential loopholes that could compromise safety or privacy. This step reassures parents and students that school facilities are managed with clarity and consistency, strengthening trust in the district’s commitment to protecting every child.
Supporting the Academic Mission: By rooting facility-use policies in verifiable biological facts, the district models intellectual honesty and evidence-based decision-making - core values of any academic institution. This clarity allows staff and students to concentrate on learning and growth rather than navigating complex or contested social concepts.
I believe that prioritizing student safety and privacy is of utmost importance and that is why policy 253 was originally created in August 2023. A policy that is strengthened and continues to be grounded in biological reality provides clear, consistent verifiable standards. This revised policy is not officially passed yet and will need a second reading before passage. These revisions are needed to keep the original intent of student safety and privacy in the policy.
