Phil for VA 757 born and raised. Dad to Isa & Maia. Phil is the Delegate for HD-94 (Norfolk) Phil and his wife, Sara, are raising their family in Ocean View.

Phil is stepping up to serve the City of Norfolk in Virginia’s newly-created 94th District. Phil was born and raised in Hampton Roads, attended local public schools, and received a Gates Millennium Scholarship, which made it possible for him to attend William & Mary and become the first in his family to graduate from college. He was determined to put that education to good use, to solve problems,

and to serve others. Currently, Phil serves as the Senior Vice President for Policy & Advocacy for a nonprofit organization. In this leadership role, Phil has been on the front lines fighting for solutions that benefit Virginia families, from raising the minimum wage to increasing teacher pay and funding K-12 public schools. Previously, Phil served as a Senior Policy Analyst in President Obama’s White House Domestic Policy Council, where he partnered with leaders across the country to promote clean energy, fight for clean air and water, and help coordinate the response to the BP Oil Spill, the worst spill in American history. Phil has also worked as a civil rights attorney, a role that allowed him to bring together people from all walks of life—from grassroots organizers to union leaders, to people who have been through the criminal justice system—in the name of creating better economic opportunities for all people. He met his wife, Sara at William & Mary and they were married in 2015. Sara works to increase access to quality, affordable health care, with a special focus on preventive care.

Thanks to WHRO Public Media for the coverage of my flood risk legislation:

Del. Phil Hernandez, a Democrat who represents Norfolk’s 94th District, has proposed a bill that would require sellers to share what they know about a property’s location within a flood zone and any previous damage from flooding.

Hernandez said in an emailed statement that it's a "commonsense bill to help families better understand flood risks before they make one of the largest investments of their lives."

He said it's particularly important to the Hampton Roads region, which sees regular flooding and has the highest rate of sea level rise on the East Coast, including from sinking land.

"Just this morning, I received an email from a Virginian who recently purchased a home, unaware of the flooding risks, and has since dealt with thousands of dollars of damage, not to mention the stress and safety risks," Hernandez wrote. "Compared to other states across the country, Virginia’s disclosure law is weak and does far too little to inform families about flood risks. This bill is an attempt to remedy that problem.”

Advocates are pushing the General Assembly to create laws around mandatory real estate flood disclosures, following the lead of other coastal states like North Carolina.

I'm excited to share my committee assignments:

✅Finance: This is where tax policy is handled & I will be fighting to create a tax code that works better for working class families in Norfolk and Virginia. The policy choices here have broad impacts on priorities like funding for education, child care, transportation, and housing.

✅Courts of Justice: As an attorney, I welcomed the opportunity to join this committee, as it touches on criminal justice reforms, judges and the courts, public safety, and civil rights. It’s the committee with the heaviest workload almost every session.

✅Agriculture, Chesapeake Bay & Natural Resources. Lots of environmental legislation runs through this committee and I'm looking forward to protecting the Bay, which is a vital natural resource for Norfolk and the 757.

Things I often hear from local families: "I can't find child care" & "child care costs more than my rent."

As a dad to two young girls, I get it!

So today I've filed two child care bills: The first, HB 407, makes it easier for families to access the Child Care Subsidy Program.

The context behind my second bill, HB 408, is that VA has a shortage of 140,000+ child care slots. That leads to long wait-lists and families not getting care. The bill aims to create more slots by simplifying how child care providers are reimbursed via the Child Care Subsidy Program, thus encouraging more providers to participate. This was a central recommendation in last year's JLARC report on child care in VA.

The goal of my 1st bill for the 2024 session is simple: support the mental & physical health of students in Virginia's public schools.

The bill would help fund additional social workers, psychologists, & behavioral health professionals, achieving a ratio of 4 per 1000 students.

We've made some important progress to improve mental health services in schools over the past few years, but we're still falling short of what the Virginia Department of Education recommends. This bill will help us get there.

Yesterday afternoon, in my first act as Delegate-Elect, I was so proud to support Leader Don Scott as the next Speaker of the House of Delegates. He is the first African American to be nominated to this role in the 400+ year history of the General Assembly. It was a moment for the history books.

I'm also exited that Delegate Charniele Herring will serve as the Majority Leader and Delegate Kathy Tran will be our Caucus Chair. Both are seasoned legislators. Together, they are a dream team. I'm looking forward to collaborating with them to serve families in Norfolk and Virginia as a whole.
