Let me paint a picture for you.

A family in Kitsap County is finalizing their estate plan. They've done everything right: met with their attorney, signed their wills and powers of attorney, got everything notarized.

Then they realize: they have a vacation property in Mexico. And their adult daughter lives in Germany.

Suddenly, those carefully prepared documents need to work internationally, and that means they need apostilles.

This is more common than you'd think. International families, overseas assets, or beneficiaries living abroad can all make apostilles a necessary part of the estate planning process.

These two things are NOT the same, and confusing them can cause real problems with your documents.

🔹 NOTARIZATION verifies your identity and that you signed a document willingly. It's required for wills, powers of attorney, trust documents, and most legal paperwork here in Washington.

🔹 AN APOSTILLE is a government-issued certification that makes your notarized document legally valid in other countries. Think of it as the passport for your paperwork.

So if your estate planning documents only stay in the US? A notarization is what you need.

But if those documents ever need to cross international borders - whether for foreign property, overseas family, or international institutions - you'll likely need both.

Knowing the difference ahead of time can save you a lot of stress (and delays) later.

Did you know that some estate planning documents need more than a notarized signature to be valid abroad?

If you have property, bank accounts, or family members in another country, your documents may require something called an apostille - a special authentication that makes your notarized documents legally recognized in foreign countries.

Here's when an apostille might come up in estate planning:
âś… You own real estate in another country
âś… Your heirs or beneficiaries live outside the US
âś… You have financial accounts or assets in a foreign nation
âś… Your power of attorney needs to be used internationally

A notarization is the first step, but an apostille takes it further.

A common misconception I run into:

"An apostille verifies that my document is accurate."

It doesn't, actually.

An apostille verifies the signature or seal of the official who signed the document, not the content itself. It tells another country: this document was legitimately issued. That's it.

It's an important distinction if you're sending legal documents abroad, because knowing what an apostille does (and doesn't do) helps you understand exactly what else you may need, like certified translations or additional authentication steps.
