Lo que es el Propósito y Base de la — Sección 2.88.020 de la Propuesta Ordenanza de Inclusividad de Elgin.

Antes de entrar en reglas y prohibiciones específicas esta ordenanza nos dice POR QUÉ existe. Y eso importa — porque el “por qué” es la base legal y moral que sostiene todo lo demás.
Empecemos ahí. En español claro. De parte de una abogada que sí la leyó.

⚖️ Toda persona en Elgin — documentada o no — merece dignidad y respeto.

No algunas personas. No las personas con los papeles correctos. Toda. Persona. Eso no es una declaración política. Es la premisa fundamental de esta ordenanza.

Si usted se opone a esa premisa no se está oponiendo a una política. Se está oponiendo a la dignidad humana básica. Que quede claro.

⚖️ Las comunidades inmigrantes son esenciales para la seguridad pública — no a pesar de ser inmigrantes sino porque son parte de esta comunidad.

Cuando las personas tienen miedo de llamar al 911, reportar crímenes o cooperar con investigaciones por temor a la deportación todos estamos menos seguros. No solo los inmigrantes. Su cuadra. Sus hijos. Su vecindario. Todos.

Esta ordenanza existe en parte porque la confianza comunitaria y la seguridad pública son inseparables. Eso no es ideología. Esa es la realidad de la aplicación de la ley.

⚖️ La ley de inmigración es ley federal. No es el trabajo del EPD hacerla cumplir.

El Departamento de Policía de Elgin tiene recursos limitados. Esos recursos existen para proteger a ESTA comunidad. No para realizar cumplimiento civil federal de inmigración de forma gratuita. Para lo cual el Departamento de Policía de Elgin no está entrenado ni equipado.

Si Los Sin Bienvenida — Steve Thoren, David Kaptain, Dustin Good, Rose Martinez y Anthony Ortiz — creen que el EPD debería estar haciendo el trabajo de ICE que se lo digan directamente a cada residente de Elgin que espera una respuesta policial. Los estamos esperando.

⚖️ Esta ordenanza existe para trazar una línea clara.

Lo que los empleados de la ciudad pueden hacer. Lo que no pueden hacer. Sin zonas grises. Sin confusión. Sin que cada oficial improvise. Eso se llama política. Toda organización bien administrada la tiene.

Los Sin Bienvenida aparentemente prefieren la alternativa. Anotado.
Esta ordenanza no es radical. No es ilegal. Es una ciudad que dice: conocemos nuestro papel, nos mantendremos en nuestro carril y protegeremos a TODA nuestra gente mientras lo hacemos.

The Purpose & Foundation — Section 2.88.020 of Proposed Elgin Inclusivity Ordinance, also known as Elgin’s Welcoming City Diversity and Inclusion Ordinance

Before this ordinance gets into specific rules and prohibitions it tells us WHY it exists. And that matters — because the “why” is the legal and moral foundation that holds everything else up.

So let’s start there. In plain English. From an attorney who actually read it.

⚖️ Every person in Elgin — documented or not — deserves dignity and respect.

Not some people. Not people with the right paperwork. Every. Single. Person. That is not a political statement. That is the foundational premise of this ordinance. If you oppose that premise you are not opposing a policy. You are opposing basic human dignity. Own that.

⚖️ Immigrant communities are essential to public safety — not in spite of being immigrants but because they are part of this community.

When people are afraid to call 911, report crimes, or cooperate with investigations because they fear deportation everyone is less safe. Not just immigrants. Your block. Your kids. Your neighborhood. Everyone.

This ordinance exists in part because community trust and public safety are inseparable. That is not ideology. That is law enforcement reality.

⚖️ Immigration law is federal law. It is not EPD’s job to enforce it.

The Elgin Police Department has limited resources. Those resources exist to protect THIS community. Not to perform federal civil immigration enforcement for free. That the Elgin Police Department are not even trained or equipped to perform.

If the Anti-Welcome Wagon — Steve Thoren, David Kaptain, Dustin Good, Rose Martinez and Anthony Ortiz — believes EPD should be doing ICE’s job, they should say so directly to every Elgin resident waiting for a police response. We are waiting.

⚖️ This ordinance exists to draw a clear line.

What city employees can do. What they cannot do. No gray area. No confusion. No individual officer improvising. That is called policy. Every well run organization has it.

The Anti-Welcome Wagon apparently prefers the alternative. Noted.

This ordinance is not radical. It is not lawless. It is a city saying: we know our role, we will stay in our lane, and we will protect ALL of our people while we do it.

Elgin, sigue esta serie para aprender sobre la propuesta Ordenanza GXX-26 — la Ordenanza de Inclusividad de Elgin, también conocida como la Ordenanza de Diversidad e Inclusión de la Ciudad Acogedora de Elgin.

Elgin follow this series to learn about proposed Ordinance GXX-26 — the Elgin Inclusivity Ordinance, also known as Elgin’s Welcoming City Diversity and Inclusion Ordinance.

I’m Caroline Hernandez. I am a local bilingual attorney who defends and protects human and civil rights. I have been practicing law in Elgin since 2004. A former Cook County Assistant State’s Attorney, I am a daughter of immigrants. I live here. I work here. I serve here. And I love this city — every single part of it.

I am doing this series to explain and support the proposed Ordinance GXX-26 — the Elgin Inclusivity Ordinance, also known as Elgin’s Welcoming City Diversity and Inclusion Ordinance. for three reasons.

First — I believe in diversity and inclusion and I believe this is a good ordinance that makes Elgin more inclusive and better for everyone.

The Elgin Police Department wants you to believe they're "Proud to serve Elgin."

Let's examine 🔬 what that actually means in practice.

"Proud to serve Elgin 💙"*
*Discriminatory warranty applies. Service explicitly unavailable to Latino residents when federal ICE agents are present.

The Elgin Police Department maintains an unofficial policy to abandon approximately half of Elgin's population—ALL LATINOS—without notice or warning when ICE agents appear in Elgin.

The EPD slogan should read:
"Keeping our community safe—as long as you're not brown, Black, Latino, Spanish-speaking, or perceived to be an immigrant"

THE FACTS:
✅ When ICE arrives, it's "WE LEAVE" o'clock for EPD

✅ Officers scatter like cockroaches when lights flip on 🪳

✅ Latino neighborhoods in danger = "City of Elgin,- Not our problem"

✅ Illinois law enforcement “Mandatory Duties” treated as optional suggestions if the victims are Latinos in Elgin.

✅ 49% of Elgin pays taxes for protection they'll never receive when they need it most. When they are subject to attack when lawless ICE shows up to violate civil rights and use excessive force.

EPD'S PR DEPARTMENT: HERE ARE SOME ACCURATE SLOGANS FOR YOUR CONSIDERATION

"To Protect and Serve (White Residents Only—Latinos Need Not Apply for Police Protection During Federal Operations)"

"Community Safety*
*Community defined as white, English-speaking residents not perceived as immigrants. All others: you're on your own when it matters most.

"We don't just ignore our mandatory duties—we sprint away from them the second ICE agents roll up"

"EPD Discretionary Enforcement: A fancy term for 'EPD decides who deserves constitutional rights based on skin color and surname'"

"Your afternoon EPD shift officers: Experts in racial profiling, masters of selective abandonment, cowards when ICE agents appear"

"Equal Protection under law? Not in Elgin, IL. Here we have a two-tiered system: Full police service for whites, Complete Police Abandonment for Latinos"

"Elgin police officers- ‘We took an oath to serve ALL Elgin residents. We lied.’”

LET'S BE CRYSTAL CLEAR:

"Running from duty isn't discretion—it's dereliction. And in Elgin, IL it's racist."

"EPD: Where 'officer discretion' means constitutional violations and civil rights violations we think we can get away with"

THIS IS NOT DISCRETION. THIS IS DERELICTION.

EPD's selective enforcement isn't just unprofessional—it's unconstitutional. It violates:
14th Amendment (Equal Protection)
Illinois TRUST Act
Illinois Civil Rights Act
Municipal duty to serve ALL residents
More than half of Elgin sees through this performative public relations.

P.S. EPD didn't lose the community's trust. They earned its contempt.

P.P.S. "Proud to Serve" means nothing when police abandon Latinos the second ICE arrives. Community distrust isn't accidental—it's earned.

P.P.P.S. Elgin's Latino community members remember that EPD "service" disappears at the first sign of danger. ICE arrives. EPD vanishes.

P.P.P.P.S. EPD officers retreat faster than their lies and excuses can keep up.

P.P.P.P.P.S. EPD dissolves into thin air when ICE shows up—just like their credibility.

P.P.P.P.P.P.S. EPD doesn't serve the whole city. You protect the badge.

P.P.P.P.P.P.P.S. Cowardice has an EPD uniform, and Elgin has witnessed it firsthand. 👻

P.P.P.P.P.P.P.P.S. The truth isn't in EPD's slogans. It's in the empty streets they leave behind when Latinos need protection most.

P.P.P.P.P.P.P.P.P.S. Abandonment has become part of the official EPD operational protocol. Ghosting Latino neighborhoods? That's their specialty. 👻

P.P.P.P.P.P.P.P.P.P.S. ICE rolls in. EPD rolls out. Every. Single. Time 🕰️.

P.P.P.P.P.P.P.P.P.P.P.S. EPD’s "bravery" ends where brown skin begins. EPD’s "protection" stops when accents are detected. EPD’s "service" disappears when surnames sound Spanish.

P.P.P.P.P.P.P.P.P.P.P.P.S. EPD: Collecting paychecks from ALL taxpayers. Only providing police protection to White taxpayers. Defining "discretion" as "discrimination we haven't been held accountable for yet." Key word - Yet.

P.P.P.P.P.P.P.P.P.P.P.P.P.S. You didn't just abandon Latinos during ICE operations. EPD telegraphed to every criminal in Elgin exactly when and where half the city is unprotected. Congratulations on creating a roadmap for predators.

P.P.P.P.P.P.P.P.P.P.P.P.P.P.S. When history records this era, EPD's "WE LEAVE" policy will be studied alongside other shameful moments when law enforcement chose complicity over courage, racism over duty, and cowardice over constitutional obligations.

P.P.P.P.P.P.P.P.P.P.P.P.P.P.P.S. Every EPD officer who has ever fled a Latino neighborhood when ICE arrived broke their oath. Every supervisor who authorized this policy violated their duty. Every city official who defended it enabled constitutional violations. This is systemic. This is documented. This is criminal.

Equal Protection for Everyone is watching. Elgin is watching. Illinois is watching.
Your move, Chief. But we both know you'll do what EPD does best when confronted with accountability:
You'll leave. 🪳👻

Police services should never depend on the color of your skin.

In Elgin, Latino taxpayers also fund police protection for everyone—not just some.
Walking away from public safety is not discretion.
It’s discrimination.
And it violates Illinois law.
